That's how Nintendo Zone and SpotPass works. Your 3DS automatically connects to the Internet and if there is any SpotPass content that you can receive, your 3DS downloads it automatically. There is no asking or setting up a connection at all.
I've picked up signals from Nintendo Zones while driving on the freeway before, so it's definitely possible that you've passed by a Nintendo Zone unknowingly and your 3DS downloaded SpotPass content for you.
Unless it's a Best Buy, no, I have no idea how to turn off the Nintendo Zone. There's no option to block Nintendo Zone from your 3DS, so the only way to do it is to turn off the actual Nintendo Zone. Do you have proof? Because I'm fairly certain that the 3DS can only automatically connect to Nintendo Zones. If you're not in a Nintendo Zone or a Wi-Fi connection that's set up in your 3DS's settings, then your 3DS will never show that it's connected to the Internet.But it is.![]()

That's odd, because I've tried the same thing once and wasn't able to connect in any way at all. It was during a StreetPass event at a mall and I had brought my DSi because I wanted to give someone else some DSiWare that I didn't want to transfer to my 3DS. You had to log in via a web browser to use the mall's Wi-Fi, and I wasn't able to connect no matter what I tried, on either 3DS or DSi. And I remember testing my Friend List to see if it worked, and it didn't show me as online. No orange lights or anything.Yes it is. One day I was playing with some buddies and all our consoles automatically connected to one of those hotspots that are open but require browser login. We noticed because suddenly, everybody's orange led began to blink like mad and all of us were online in the friend list. Then we went to check the browser and the login page appeared, and we couldn't play online or access the eShop but somehow the friend list uses some protocol or port that is not "catched" by the security system and managed to get through so we imagined the console just tries to use any open wifi around and runs with it.
This is true, for the most part. Sometimes I've found that 3DSes still refuse to StreetPass each other as long as they're connected to the Internet, even if they're closed. For example, sometimes when I'm trying to StreetPass with my roommate, we let our 3DSes sit there and nothing happens. But if we unplug the router, the green lights on the 3DS instantly light up. I assume that one or both of the 3DSes are currently downloading data from SpotPass, which would disable StreetPass at the time. Turn off the Internet connection and the SpotPass stops, allowing StreetPass to work.If your 3DS is shut, you SHOULD still get Streetpasses. From what I can tell, Streetpass is only disable when the internet is being actively used (for Nintendo Zone, that is when the system is OPEN and in a NZ area.)

Nintendo have a deal with a range of wi-fi providers (BT - http://www.btopenzone.com/ - being one such provider) that supply free wi-fi to handhelds. I say handhelds as this has worked since the DS Lite.

When you recieve a Mii in StreetPass Plaza, there's an option on there to copy it to the Mii Maker. With any Mii you've recieved via game invite or whatever (like Mario Kart or SwapNote) the game will clearly warn you that taking it to the Mii Maker will remove it from Mii Plaza.
StreetPass Miis do not give the same warning. I just copied my StreetPass Plaza gold pants Reggie to my Mii Maker, and while I like the fact that I have him in there now (gold pants and all,) I no longer have him available for rehire in StreetPass Mii Plaza. I live in the middle of nowhere and have a total of 2 streetpasses in the last year not counting Reggie, so for me that's a pretty big deal.

Is there any reason a 3DS would stop StreetPassing? I went by the GameStop I'm hosting a MeetUp at to clear the details with the manager and the 3DS demo they have up wouldn't tag me. The wireless switch was on, natch. Upon further investigation, the thing hasn't StreetPassed anybody in almost a month (twenty eight days was the most recent one).
Now, as far as I know nothing has changed, it's the same demo and everybody at the last MeetUp tagged it.
