So yeah, the whole deal with the HR 3261 bill. If the US can start blocking websites to US residents, (or sites based in the US) that would be pretty bad. I'm hearing very little about it.

The Congress' hearing on it is today. And if I get this right, if it pass, sites like Youtube could completely be taken down.

Our senators are either technologically moronic or bribed (usually both!) so this bill's chances are much higher than they would be in a rational society.

Huh? Youtube is already censored. They take down gore and nudity content, amongst other things.

They could take it down if they see copyright infringement instead of just taking the video down.

I wonder if there will ever be a time when the people in positions of power (in politics) are tech savvy or even knowledgeable. Maybe in another 20-30 years...but by then it'll be too late I guess

That's not government censorship(and you can find plenty gore and nudity provided it meets youtube's terms).
 
They don't take action if whatever they are trying to censor can self-regulate. I hope they are looking at situations where the internet can be abused

this is more like a symbolic threat if nothing else

Yep. I suspect that if a Republican wanted to gain youth support, all they would have to do is say they would overturn this bill.
 
If this passes it kills youtube, Justin.tv/USTREAM, Thatguywiththeglasses, angry video game nerd and all the people from TGWTG like Spoony and Brad will be out of a job. As would every youtube personality you love.

I mean, as far as my limited understanding of the US Constitution goes.

Copyright protection powers are explicitly granted to Congress in the Constitution.
 
So, if this is passed, every person who has ever uploaded a video will probably be breaking the law in some way. How retarded.

we have a highly politicized supreme court controlled by corporations. There's no checks to anything in this country if a corporation throws enough money at it.

In theory, yes, this would probably be unconstitutional. However, I don't have a lot of faith in our current Supreme Court.

Geeze this is bad. This would kill the internet almost instantly. No wonder why I've been seeing so many people talking about this bill. Retarded and I wouldn't be surprised if it was the Republicans who were most in favor of this bill.
 
We've seen the Internet in action before. If this happens, hell will break loose.
 
If a site is hosted in say China, how would the censorship be enforced if the site's owner didn't agree to remove the content in question? By just blocking it for all US users? It's obviously impossible for all website owners outside of the US to make a censored version of their webpage for US readers only.

Where is the right to create derivitive works in the Constitution? The ability to make derivitive works is granted by the Copyright Act, not the Constitution.

There ARE legitimate Constitutional questions here, and I don't mean to deny that. But it really frustrates me when everything political that people don't like suddenly becomes "unconstitutional." Conservatives and Liberals both do this. Not everything is a fundamental right, and treating everything like fundamental rights weakens the real fundamental rights.

I also don't think the Supreme Court is getting paid by corporations. That's absurd. Citizens United is an oddly broad case, but the notion that the 1st amendment protects speech generally regardless of the speaker is a conceivable interpretation. In fact, it's an interpretation that would support a constitutional challenge to PROTECT IP. The defense, I presume, is that PROTECT IP blocks foreign domains that don't get first amendment protection. But if the 1st amendment is about speech and not speakers, that defense is gone.
 
Sucks, but this will unfortunately get snuck in somewhere, and we'll wake up one morning with less freedoms than we had the day before.

The vimeo video already mentioned a few other laws they have in place, if they got those they'll get this one, it's all a matter of time.

I have no faith in this government to do the right thing.
 
I have no doubt something like this will pass eventually, I don't think it's now though. The internet is still too young and dominated by the users. That's slowly changing with hulu and big media companies getting more involved though.

Voter turnout among young people is much lower than it is among older people. Unfortunately.

Basically if the bill passes as is, someone could face Felony charges if they post a video of them self rapping to a song they love, and if they post it to FB, the entire site could potentially be shut dow. If someone posts a still from an episode of It's Always Sunny... or The League or HIMYM to their Tumblr account, the site could get shut down and that person could be arrested and forced to pay huge fines.
