Piracy == violation of copyright
Copyright - the rights to copy or distribute the works of another. US legal code requires this to be done in writing. Without this, you have no rights to make copies of someone else's works. "Exception" fair use. You are permitted to make a copy of a work you purchase for your own personal use because that would be fair so that you can have backups in case your original copy is destroyed, or to transfer it onto a different medium so that you can continue to view/use it in case of technological obsolescence.
As such:
Downloading stuff you didn't pay for - not specifically. You become an accessory to a crime, but you aren't the one actually doing the copying. Unless of course you're in a peer to peer environment in which case you are both downloading AND distributing so you're guity of two crimes simultaneously.
Downloading stuff they didn't pay for and distributing it? Yes, because you are directly violating copyright.
Downloading stuff they didn't pay and distributing it for a fee? An even worse crime because not only have you stolen wares, you're fencing them.
Hacking stuff so you can use it without paying? This doesn't make you a pirate, it makes you a hacker. If you're just using someone elses hack to get past copy protection, it makes you a criminal in the US under DMCA.
