Hulk Hogan v. Gawker jury selection was pure fuckery.

I don't get why Bubba telling the feds that is even relevant. It's hearsay, and the only reason it would be relevant is to show Bubba can't keep it straight.

terry is done

these documents are certainly telling.

How so? Hearsay about Hogan knowing he was taped and after one tape was out, that he knew there was one with the slur in which is already public knowledge?

Even if he did know he was being taped, other than painting Hogan as a liar, I'm not sure it would actually do much for the basis of the case.

This doesn't do shit to absolve Gawker of what they did. Even if Hogan knew the tape existed it does nothing to change what Gawker did.
It could effect the damages he receives, right? It doesn't effect Gawker releasing it but if he knew, he can't be due all the damages he wants?

Right.

"We know there's more than one tape" could mean he found out later, not that he knew it was happening at the time. I believe it's come out that he was being extorted.

The jury literally does not know about it, it's 100% irrelevant to the case.

These documents aren't being released because they're smoking guns that the defense just forgot to introduce into evidence; they're inadmissible.

Ah, thought the sealed evidence was still available to the jury, just not shown in court like the tape was. Still, even if this is available in a theoretical appeal, I don't see it helping their case that much.

So if I'm to understand correctly, Bubba and his wife asked Hulk to bone her while they record? Was this a consensual deal where Bubba would get off on the idea that his wife took it from the Hulkster? I feel like I totally misread the situation (I thought it was an infidelity thing).

According to proceedings, Bubba and his wife kept bringing it up. In her deposition, Bubba's wife said he wanted it, she didn't.

When it did happen, Hogan asked if it was being recorded and Bubba cursed him out for questioning him.

Bubba was in the room watching, according to the defense's closing argument.

Some other pertinent info:

When Bubba was asked about a 2012 TMZ story that reported he has said, on tape, “if we ever did want to retire, all we’d have to do is use this footage” moments after Hogan finished having sex with Heather Clem, Bubba denied it. He said he was “speaking as a smart ass showing off … I wouldn’t do that, ever.”

Cole and Hogan did it a total of four times, in her bedroom, at his home, in Bubba’s studio and at a Tennessee hotel.

“What do you recall about the sexual encounter in Tennessee?” asked Hogan’s lawyer, Charles Harder (that’s his real name).

“I performed a sexual act,” Cole said.

“Do you recall what it was?” Harder asked.

“I was asked to go to Mr. Bollea’s room by my husband, and I did.”

The tape, meanwhile, was made at Bubba and Cole’s house.

“At some point after the encounter at our house with Mr. Bollea (Hulk’s real name), Mr. Clem showed me a videotape of myself with Mr. Bollea having sex. I did not watch it. It was brief.

“I was upset,” she said, adding she didn’t know the tape was made, probably by security cameras hidden in the room.

“Bubba had told me that his attorney said it might be a good idea to have a camera in case something ever happened,” Cole said.

Cole denied having anything to do with the video’s release.
