I broke up with my girlfriend at the beginning of February and since she was living with me gave her until the end of February to move out. I asked her to ask me if if she has friends over and her answer was since she was paying me rent, legally she shouldn't have to. The problem is that she isn't on the mortgage and we don't have a lease, so does she have any right to tell me anything? My thought is that I have the right to tell her to get the fuck out and change the locks if I want and there's nothing she can do, other than taking what she owns. Please tell me I'm right.

no name on any paper : kick her out at the end of the month if she paid her half of the rent. Tell her that she has a week to move out

Legally you could probably give her the money back and mail her stuff in a box to her mom's. But maybe you just need to have her move out ASAP.

If a person has lived somewhere for a certain amount of time and/or other conditions apply, such as that they receive mail at that address, then you can't simply kick them out (or change the locks). The laws are different everywhere, but 30 days of warning is pretty standard.

If you're common law you can't kick her out so easily.

you need to proactively get this person out of your home. Check with the Sheriff Department about what you can do, and go from there. You do not need to be in this situation, and neither does she. Its only going to be horrible.

Look in the mirror and read the thread out loud,

then read your post about her fucking 17 guys behind your back.

Then call to figure out your options.

She gave him money. She didn't make a 'legal transaction with receipts and invoices.' Her name's not on any paper, so unless the law specifically protects her, she's probably living on his good graces.

The cops in a lot of these situations will tell the owner they have to go to court to get them out since she has set up residency. This depends on a lot of factors though, jurisdiction being the biggest one. If the gf plays on sympathies they might tell him to go to court.

Paying her part of the rent or not for the final month she's lucky to have a place to live. You're being very generous allowing her to stay at all after that when you would have been in your right to kick her out long ago. She at the very least should be more considerate. Then again that she cheated the way she shows you what she's really like and her reaction is likely not a surprise. You have a week left though. Is it clear she's preparing to leave at the least? Boxes and bags being packed? Etc. If not then be prepared to make some calls to have her kicked out.

I asked and her answer was April when the apartment she got will be ready. She hasn't paid me any "rent" for January or February and what she gives me doesn't cover half the mortgage.

Probably is not a good thing to go on in these cases. It's best to consult someone who can tell the OP what, if any, her legal rights are. Heck,

If you're a tenant without a lease or not on the lease, it's called tenant at willI. If you are a tenant at will, your landlord can evict you without giving a reason. However, he must give you 7 or 30 days notice in writing. At least accoring to the brief look up "rights of tenant without lease" gave me.

It's definitely a state by state thing, but tenant at will laws are, from what I remembered from watching years of judge judy, apply in most states.

Edit: OP just make sure you do everything within the law. An extra few days of pain sucks but in the long run it may just be better.

I agree with this advice. Call the police and consult with them about when you can legally kick her out, and proceed to do so as soon as you can.
