I just got denied citizenship foooor *drumroll*

Honestly, if the US CIS had said that i was denied citizenship for a misdemeanor I would call it idiotic but at least it would make sense.

Calling me an aggravated felon for the crime, however, is non-sensical. A felony has a technical definition, and as far as I am aware there is no case in nor circumstance under which my charge can be considered a felony. So, this is where I'm confused. I've already spoken to a lawyer who says it sounds like this was a complete ****-up on CIS' part.

actually.. any form of THC residue can be considered as having pot.. I remember when I used to smoke, I was 16 got busted with a pipe with about 2 grams of pot stashed inside.. and got charged with .003 grams of residue.. bastards smoked my dope and charged me. But now I live in Japan, and wouldn't think of smoking because it will mess up my visa and my chances of getting a permament status here.. The states is actually quite lax compared to Japan and some other countries..

Was never charged with possession of pot in any amount.

I should probably ask the Delaware court that. I'm honestly not sure.

edit: I actually admitted having used it for smoking weed when the trooper asked me. I figured that if I said tobacco, they would simply test the pipe and find out I was lying, and at that point it didn't seem worth it. So maybe this is how it came together.

What kills me about this is the letter makes reference to my only charge, "possession of paraphanalia." Then it says I'm guilty of an aggravated felony. I just want to know how they came up with this.

I have to give it to the State Trooper, she was VERY cool about the whole thing, and by the time we got around to discussing the pipe I really felt no need to lie to her.

She and I actually had a great conversation on the way to the station; about where we grew up and stuff. She was obviously just doing her job, and she made it a point to make me aware of that. Plus I was allowed to sit in the front office with one handcuff and the other hand free to read magazines while they did paperwork. I saw a judge at 7am and then they let me go.

they cuffed you and took you to the station? hahahahh I was 16 and got a ticket and they left..

But hey to be honest the states is better than most like I said.. I have a good friend here in Japan. He was born here and has never lived anywhere else... but Japanese laws are shitty if you are Korean or Chinese. His father is Korean so he is. If his father was Japanese he'd be Japanese (the law is still going.. doesn't apply to western people.. )

He was about to take his test to get his citizenship and got denied for a traffic ticket and Japanese laws are so strict that he COULDN'T re-apply (if ever knowing Japan).. don't know for how long but it sucks bad for him. Born here, half Japanese.. and a damn traffic ticket keeps him from being Japanese..

Pot is the same as coke or meth, or smack here.. they would have deported his as for a pipe that has been used..

Yea...you know I think that part of Delaware is very SLIM pickings for arrests. I'm sure the State Trooper was excited that she was getting to make one for once. But she was very sensible and polite about it, probably because I was polite and honest with her. I've only dealt with cops in traffic incidents but she was the coolest cop I had dealt with by far. The guys at the station were also very friendly.
