Not necessarily. A contract becomes invalid when it asks you do something unreasonable (or illegal) in the eyes of the law. If there was information out there that said the XB1 will basically be a useless brick come launch and will cause material harm to consumers, you'd be fine with making that information public. There are a lot of 'journalists' in the industry right now that aren't under NDA that have important information. They just refuse to share it out of fear they will be blacklisted.
The industry has never had a 'fuck this' moment as a whole, where everyone just decided to do the right thing. Now is a good opportunity.
