The problem with people like Brad and most xbox fans (Destin and Tom) is that they misconstrue the Jim Ryan email when it was an email to employees to instill confidence in Sony and the leadership team that they'll be fine and is was an email prior to the deal discussion between Xbox and Jim. the email was just after xbox claimed things would remain the same then offered a 3 year deal.

They know the truth. Just carrying the water after the last "thought experiment" disaster which MS distracted the masses with price raise announcements. *look over here* To keep it out of the new cycle going into these hearings.

I see your reasoning, I just think there is not any legally sound argument here for Sony to have this deal blocked cause of you know, Xbox game pass in the event it ever becomes "a big deal". We will see I guess. It's funny that Xbox is being villified for making Starfield "exclusive" to console and PC, but Sony is not vilified for doing the same with studios they own. It's like this huge sticking point by the FCC re the acquisition, yet Sony is the world fucking leader in this by example. And this practice has immeasurably contributed to Sony's market domination. Yet MS are the ones being scolded for it. And, again, MS already put it in legally binding contracts for a decade that COD would never go xbox exclusive.

If a court compels MS to release its biggest games on their rivals console, like to get this deal done... some day a ruling might be required on whether the rival too should be compelled to release their biggest games for MS's console. Or Nintendo's console. It certainly opens the door. What if a studio Sony owns or buys (Bungie) comes out with a new game t hat's bigger than COD? No one blocked Sony from buying Bungie. It's a slippery slope there and I'm surprised Sony is even trying the tactic. COD isn't what it was. I just can't buy that COD is the sticking point in any way here. And if the sticking point is Game Pass or the sticking point is Cloud, I don't think any of Sony's arguments stand up.

"If you allow this deal then MS might apply a feature to some of the games, a feature we chose not to invest in!" Again there was a time I could steam Destiny 1 on my PS4 to my Xperia phone. It's all BS imo. And I'm still not convinced this is deal is even good for MS! Not unless there's still "something bigger" we all don't know about.

I love the discussion. I'm legit surprised Sony, the dominant market leader, has managed to successfully lobby so many influential regulators to its side here, with these flimsy arguments that don't pass the smell test.

I'm sorry but this is a foolish opinion.

They're building their case against the dishonesty of MS, not against exclusives as a whole.

Sure but they haven't any sort of case yet... so far i haven't really seen any "lies" people keep dancing around here about. Yeah they are being smeared a bit in court because of OLD e-mails from 2019 but so what? It's all business on both sides of the fence. Sony wouldn't fare any better in the hot seat here if the tables were turned. It's all a bunch of bullshit. At this point to me it just feels like what we have to endure with our own politics, two sides of the same coin yet people are yelling back and forth at each other as if there is anything worth fighting about on either side.

Ms wants them to lose by failing to get a PI basically leaving the CMA alone. it is highly probable that the FTC will be asphalted during these 5 days. If microsoft is willing to look so "weak" to get what they want in tribunal, i don't think they are interested in the "bad pr" they will get from a small number of forums hardcore gamers

As a technical matter in the ongoing injunction proceedings, I am not certain that even the FTC is saying that it actually "has a case."

Could be wrong, but isn't the entire point of this hearing for the judge to decide if closing should be delayed until the FTC decides if it "has a case" after the August regulatory hearings?

Pretty sure that's the procedural posture here. Which is why all the smoke from yesterday was a big deal.

We can debate whether its a strong conclusion or not but they did get it across pretty well that all games will be exclusive and Bethesda had no say in the matter, despite the claim that it will be case-by-case.

If you look back i said this deal would go through but to see people bending over for MS, a multi-trillion dollar company, like they are weak is sickening and a major reason why big corporations run politics in America.

This is only for in injunction, the trial hasn't even started yet. It's been a well played chess match so far, Better than I expected, actually.

I appreciate you taking the time to call my thoughts foolish. Microsoft said they wouldn't make COD exclusive, not that they wouldn't make any of their in house studio games exclusive. We can continue without the name calling, right?

Calling your opinion foolish is not name calling.

Microsoft did say that games would be on other consoles on a case-by-case basis if they have the audience for that. So far Indiana Jones is no on it, ES6 is almost definitely not on it, Starfield is not on it....are you claiming PS players don't like those games? Is there no audience?

You should justify all your points about why the FTC should be asphalted when it already hasn't happened in the first day (quite the opposite tbh), how you have calculated the 99.9% chance of FTC dropping the case if they fail to get the PI (when the first thing they can do is to appeal the PI verdict) and so on.

Instead I see we're just parroting the usual Microsoft's propaganda points my dear Neo Member with 3 posts since 2017.

Sure, will see. I haven't read yet the opinion of any lawyer who thinks the FTC will be able to obtain a preliminary injunction let's say it seems highly probable the opposite as many are already saying
