Everything to do with copyrights generally occurs on January 1 of the year in question. I believe the estates are getting their rights on 1/1/13, though it could be 1/1/14. That won't likely effect the movie though. DC will probably just use the expected revenue they'll receive as leverage in settlement negotiations. "Do you REALLY want to block this movie coming out rather than raking in this huge amount of money?"

In 2013, but so long as the movie is put into production prior to that, it remains unaffected.

The reason why Superman movies are hard to make is because its hard to put together a story when the protagonist is unstoppable. Easier to do in books and comics, hard to do in a 2hour movie. You get like what, 25-35 minutes to set things up? Then the conflict, then the end. Hard to make an antagonist look like he can really be a challenge for someone like Superman. Unless you choose someone that is also fucking powerful for him to fight and just go fucking dragon ball z crazy.
