A SCHOOLGIRL has been jailed for posing as a boy called Scott for three-and-a-half years in order to have sex with another teenage girl.

Justine McNally, 18, duped the 16-year-old into believing she was boy as they dated online - and carried on the hoax after they met.

McNally, then 17, lured the London schoolgirl into three sex sessions, promising they would get married and have children.

The girl was even fooled into thinking she had lost her virginity to McNally - from Glasgow - in a darkened bedroom of a family friend’s house.

McNally’s secret was only exposed when the girl’s mother found a STRAP-ON DILDO in her backpack.

She was sentenced to three years in jail at Wood Green Crown Court this afternoon after admitting six counts of sexual assault.

Sentencing Judge James Patrick said: "She had her first sexual experience with you, and you abused her trust so badly she finds it difficult to trust other people.
"It was selfish and callous behaviour - a grave abuse of trust of her, her family and friends through your behaviour over a period of years."

McNally and her victim started their relationship when aged 12 and 13 after meeting through an online videogame.

Prosecutor David Markham said that during their three-and-a-half year online relationship, the girls "spoke about what they wanted to do to each other".

They eventually met in March 2011, when McNally, posing as a Goth boy called Scott, came to visit the girl in north London, staying with a friend of her family.
They had talked about having sex during online webchats on MSN and on video calls, and the relationship turned physical on the first visit.

But McNally refused to remove her clothes while sexually touching the girl, the court was told.

He said at the first of three encounters, in March, May, and August 2011, the two girls tried to have sex.

The girls broke off their individual relationships and believed they were girlfriend and boyfriend, making plans to start a life together, the court heard.

McNally’s secret was finally exposed in November 2011, when the family friend she was staying with got suspicious and looked through her possessions while on the phone to the girl’s mother - and found a strap-on penis.

Later in the evening, after dropping McNally off at the friend’s house near Tottenham Hale train station, the mother said to her daughter: ’You do know Scott is actually a girl?’
The mother and daughter then confronted McNally, who produced a picture on Facebook of her dressed in pink clothing and heels, and said she wanted to have a sex change to continue the relationship.

Mr Markham said the victim was ’literally sickened’ by the revelations, and eventually ended the relationship and called police.

McNally, from Glasgow, admitted six counts of sexual assault by penetration, contrary to the Sexual Offences Act 2003.

Wait... is Scott possibly transgender? The article mentions Scott saying something about getting SRS to continue the relationship…
 
While I'm not condoning her actions; I am confused, if she was 17 and the girl was 16 and the young girl gave consent...how is the 17 year (now 18) in trouble?

You can get arrested for pretending to be the opposite sex online!?

I don't really see the problem. She didn't force the other girl to have sex with her, did she? If it was voluntary I don't quiye see why that's worth such a long jail sentence...

Sure, she lied, but is that really a crime? What's next? Following that logic you could also sentence a transgender for the same thing... Or am I missing something here?

I don't like this mother, the rest of the situation is more muddy, if the only false pretense to get consent was her gender then I can't label it as rape.

okay, what is "scott" charged with? tricking someone into homosexual sex?
because last time i checked heterosexual sex-lives were full of lying and decieving.
not saying that it is morally right (i don't think it is and have little sympathy for "Scott"), but how are the courts involved in this?

Is it really voluntary if you have intercourse with someone who is not who they say they are? I don't think this is all that different as posing as a woman's husband in a dark room to have intercourse with her. There has to be a line somewhere in legal integrity surrounding sex, and I'm fine with placing gender deceit more toward the side of the above case. Ideally, giving someone an STD without their knowledge should be prosecutable, too.

Section 76

Section 76 of the Act introduces a number of conclusive presumptions. These are where the defendant deceives the victim to the nature or purpose of relevant act (i.e. fraud) and where the defendant induces the victim to consent by impersonating someone known to the complainant. When this is proven, the law states that it is then conclusively presumed that the defendant did not believe that the complainant consented to the relevant act, and that the complainant did not consent to the relevant act.
