Well spin the story this way, what if it was a gay girl who thought "Scott" was really another girl with a strap on. But it turned out "Scott" had her male parts and used those but made it like she didn't etc etc. Would that not be rape/sexual assault? and would you still feel sorry for Scott?

I suffer no one who commits sexual assault, rather they are gay, straight, trans or cis. Assault is assault and no one should get special outs.

it sucks to be intransigent about what constitutes assault though; it's not a universal concept and every case is different. the question of consent is all murky as fuck here because was the victim girl consenting to have sex with this Scott or was she consenting to have sex with a male penis attached to Scott? From Scott's perspective, she had consent from her victim to perform sex acts. what if Scott was post-op?

don't get me wrong, this Scott totally fucked up, the victim was duped and has every right to feel betrayed/violated/confused as all hell. I just don't honestly know how I feel about penal proceedings against Scott.

you cant renig your consent to sex you already had. Shouldnt it only be assault if it wasnt consented. I mean what scott did was pretty fucked up, i dont know this is weird.
 
How did 'scott' get registered at the school? 'He' was staying with family-friends-something? How can a teenager be off the radar like that? She must have gone to school, so she must have been registered there as a she. Family must have know she was a she, so why would the person she was living with have to actually check to find out her gender?

Also, giving someone a 3 year sentence for such is insane. I wonder how they gotten to that.

I'd agree with the judgement in this case, but what about situations where the deceived have made an assumption, but they feel assaulted regardless? Does a trans gynocologist have to tell a patient that she was born male? Does a massuer need to disclose that he was born female?

how dark could a room really be? most bedrooms have windows. if your bedroom was in a walled-off room that would be pretty depressing regardless.
 
1. To those of you saying this should be considered rape in the traditional sense, note that the reason she has been charged with "sexual assault by penetration" (s.2) and not "rape" (s.1) is because "rape" requires penetration by a penis.

That law really needs an update. Women can rape men, and men has as much a right to be a rape survivor as women does. Just calling it sexual assault when it happens to a man, or a woman raped with an object (ex: iron rod like the case in India) is really degrading the experience.

All non consensual sex and penetration should be considered rape.

It's a legal gray area for sure. I mean do you know how many guys lie to girls to get into their pants and likewise for girls who lie to guys?

I think the problem is wilful deception. There was a similar case in Israel where a palestinian male told a woman he was Jewish so she'd have sex with him. He was charged as well.
 
Guys rape by fraud is a thing, get educated please. This is not some legal grey area, being willfully deceptive to someone about your identity to have sex with them is flat out morally wrong and illegal. If you're lying to someone to obtain consent from them it is not ok.

Legal grey area? It voids consent, that's not grey at all.
 
Seems to me that the trams rights position of "I don't need to tell you that I was born as a different sex", should be changed to "yes I was born as a different sex, and its normal, and i'm proud to disclose it".
 
How can the victim not tell it's a strap on dildo? Wouldn't a blow/handjob could tell right away? Or at least be suspicious on why there's no cum?
