If you're smart enough to be running 1.5 you're probably smart enough to know how to get around games that require updates.

not even the ability to downgrade, just use the wab version changer with a 1.5 and youll be fine

I'm not worried about being able to play SSX. What I'm seeing is though that we are already seeing 2.0 pre GTA. 2.01 or some smarter way of checking the firmware can't be that far away.
