Turkey annuls provision against child sex abuse

The Constitutional Court has ruled to annul a provision that punishes all sexual acts against children under the age of 15 as “sexual abuse,” stirring outrage from academics and women’s rights activists who warn that the decision will lead to cases of child abuse going unpunished.

The Constitutional Court discussed the issue upon an application from a district court, which complained that the current law does not discriminate between age groups in cases of child sexual abuse and treats a 14-year-old as equal to a four-year-old.

The local court said the law does not provide legal consequences for the “consent” of victims in cases where the child victim is from 12 to 15 years of age and able to understand the meaning of the sexual act. “This creates an imbalance between legal benefits and sanctions that should be preserved in crime and punishment,” the application stated.

With seven votes against six, the Constitutional Court agreed with the local court and decided to annul the provision. The decision will come into effect on Jan. 13, 2017.

Activists are likely to seek a reversal of the Constitutional Court’s ruling. The head of the Turkey Federation of Women’s Association (TKDF), Canan Güllü said they are now considering bringing the case to the attention of the European Court of Human Rights.

“This decision will lead to unwanted marriages. People will be able to kidnap and rape children, marry them at an early age, and prevent them from going to school,” Güllü said.

“The most important point is that unless this provision is urgently addressed, child abusers will start walking around freely because there is no new regulation [to fill the void],” Baransel said.

The Court has recently also annulled a provision that foresees at least 16 years of imprisonment in cases of child rape for the same reasons.

Uh dude, this law removes punishment of sleeping with children udner 15 and to stop it being considered as sexual abuse and your thought is that it was done for all the poor 16 year old teens sleeping with their 15 year old boyfriends or girlfriends or prevented adult pedophiles from molesting children?

What a backwards step and I am not surprised. Turkey is really becoming a horrendous nation. Erdogans actions after the failed coup have been crazy too. Going from a modern nation that was on cusp of joining EU to a dictatorial and theocratic nightmare where women and minorities and now minors are losing protections.

There are "Romeo and Juliet" laws for cases like that. Not in Turkey because reasons.

This is just removing punishment for having sex with anyone 15 or younger.

So they just made their country a hellhole. Like this is not something indirect, they literally are passing laws that allow children to be raped.

I hope those in power go down and quick, but I guess there's no chance of that happening.

Even tho the punishment should be more severe when it's about children, if someone was caught raping a child he still can be punished for rape right? As if he raped anybody older than 15?

I don't think I know enough about Turkish law to really comment on this. It sounds like this law was conflicting with the legal age of consent?

This law was there to protect minors and children under 15. Forget the legal age of consent, a 40 year old can coerce a 14 year old now, have sex with her and not be charged with sexual abuse of a child. The country has just become a legal haven for child molestation in a sense. Disgusting.

Kids between 12 and 15 can now say their consent is enough. But tell me, if some rich pedophil turkish politician or celebrity has sex with a child and then threatens her to say she consented is that not child abuse? Wtf. Who are the brain dead judges who voted 7-6 in favor of this. Guarantee you're going to see the trafficking of children and increase of child pornography now.

They're also removing the mandatory minimum of 16 years for raping children now as well. Fucked.

Law changes in question are regressive but how is this a plus for Erdogan or his supporter? Iirc He wants the death penalty back, if he had his way I would guess that he would hang child rapists.. no?

Because that happens in radical muslim countries... and not that the girls are forced to marry their rapist or just get stoned.

Didnt they just want chemical castration for sex offenders recently. I cant follow anymore.

These chemical castration laws are usually made by people who deny rape culture so strongly they think a rapist is an imaginary monster who acts possessed by the devil or whatever.
It is common for the same people that want chemical castration to also go easy on sex offense because they don't consider a sex offense a lot of the things we do (like molesting teenagers or workplace harassment).

It's an outlandish weird punishment for what they consider an outlandish weird crime that almost never happens.

And just this past week someone at my job was going on a rant how "we westerners" were demonising Erdogan", including our media and how we have it all wrong since he's really a great guy who was elected by his people and is doing wonderful things for the country.
So much so that the whole world is jealous of Turkey for having one of the biggest airports in the world...

This is no surprise. Human life is not valued anymore. Goodbye Atatürk's Turkey. Welcome to Erdogan's hell. Mark my words this is only the beginning.

Next they'll bring back the death penalty to execute anyone who opposes the government without any due process. There are already reports of the detainees being tortured. As the economy continues to tank, they'll blame Europe/America. Finally they'll modify the constitution to retain/obtain more power.

I'll refrain from posting in anymore topics relating to Turkey. I have close friends that have fled the country already because of the recent events and their atrocious human rights violations. If you're unsatisfied with any of these sources, feel free to use Google; there's too many sources reiterating all these accusations made by people within and outside the country.

The human rights violations will continue until Erdogan's removed from power. Until that happens, this shitshow will continue. Stay safe Turkey GAF.
 
The report somehow contradicts the needed age of marriages in turkey, which is still 18. I guess the article is pretty biased, because I know that turkey (judges and government atleast) is extremely hard against "child" abusers.
Furthermore, the report was already published a month ago. We would certainly heard a way bigger shitstorm if the reform would be really against the protection of minors.
