they're just going to take it. they made a bunch of false claims in the order, i guess to try and scare the registrar and my hosting service. they claimed i was trying to turn a profit for it on ebay, that i was holding it in bad faith (which has a set of 4 or 5 rules, all of which were untrue.. mostly dealing with holding a domain to make profit or to keep a competitor from having it). they also claimed i have a history of doing this with celebrities and that i have many other domains similar, which is also entirely false and they claimed i violated my registrar's agreement (which pertains to copyrights, none of which are violated). really the only issue is whether or not uweboll.com can be considered a common trademark.

Dude, they're not making any of those claims against you. It says:

"...the following circumstances, in particular but without limitation, if found by the Panel to be present, shall be evidence of the registration and use of a domain name in bad faith..."

They're not saying that you actually did all those things, just that if you violate any of them, they can take it away from you. And so they are. I don't really know any specifics of the common law trademark right (could surely google it), but I'm pretty sure they have a case, simply because you're using his name for the domain. Just like you're not allowed to register www.residentevil6.com just because you know it will eventually come out and they'll have to buy it from you.

That has to be bull. I mean there's a difference between cyber squatting and that right? What if I made a domain name with the name www.andreww.com. Does that mean that if someone famous has the same first name and letter in last name, that they can take my site away? Just wondering how the laws work with respect to URLs with names in them.

According to the letter, Dr. Boll (:lol) holds common law trademark in his name because he has an international reputation. Since his domain name is "confusingly similar" to Uwe Boll, it violates Dr. Boll's (:lol) common law trademark rights. Since he has no formal association with anything regarding the name "Uwe Boll" and he's not offering any sort of goods or services, he does not "hold a legitimate interest in the Domain Name" and the content violates Dr. Boll's (:lol) common law trademark rights. I'm no lawyer, and like I said I don't know any specifics about common law trademark rights, but I'm pretty sure they have a case.

There's an interesting article here about how a guy was able to defend himself from a similar case and he won, setting a precedent for parody sites with dustindiamond.com

Apparently parody and critical commentary do fall under fair use, I'm feeling pretty confident that I'm in the clear now. Thanks for the EFF link, I contacted them as well as the Domain Name Rights Coalition in an effort to get some legal support.
