She was wreckless, either she disregarded it, was doing something that caused her not to see it, but in any case she ran it. You'll excuse me, when you've had a friend killed by stupid drivers you have a tendency to lose your tolerance for people that don't seem capable of controlling a vehicle in a safe manner.

I've ran a red light before. I wasn't paying enough attention. Had there been a collision it wouldn't have been accidental. I would have caused it by being an idiot and not paying attention. Just because you don't mean for something to happen doesn't make it an accident - you still need to be held responsible.

Gotta go with teiresias on this one. I cannot think of any possible explanation for this accident except recklessness or incompetence of the driver.
Even if her brakes did fail, I've yet to see a vehicle that didn't have THREE SYSTEMS that can be used to stop it.
Given that the overwhelming majority of vehicle accidents are caused by driver error, there is no other arguable position.

All this arguing ignores what I think is the main problem with the story, namely that if Ms. Martinez really had an angel as her co-pilot, said angel wouldn't have had her impaled with a fence post in the first place.
