A Hollywood production assistant was mistakenly killed by deputies during a chaotic confrontation involving a a knife-wielding suspect who held three men hostage, including the victim, and stabbed at least two of them, the L.A. County Sheriff's Department said this afternoon.
The victim was identified as John Winkler, a 30-year-old P.A. for Comedy Central's Tosh.0 show.

Deputies responding to a "man-with-a-knife" call Monday night in West Hollywood believed that Winkler fit the description of the suspect, the department stated:

Contrary to its initial account of the 9:31 p.m. incident at an apartment complex at 939 Palm Ave., the sheriff's department now says that two innocents were struck by gunfire:
As deputies continued attempts to contact the people in the apartment, the apartment door suddenly opened and a male victim came rushing out. He was covered in blood and bleeding profusely from the neck. Simultaneously, Victim Winkler ran out of the door, lunging at the back of the fleeing victim. Both ran directly at the deputies. Winkler was similar to the description of the suspect and was wearing a black shirt. Believing Winkler was the assailant and the assault was ongoing and he would attack the entry team; three deputies fired their duty weapons at him. Victim Winkler was struck by the gunfire and fell to the floor, and the male victim also collapsed; struck once by the gunfire.

Deputies said they were originally told only two men were in the apartment, indicating that cops believed the two who burst toward them were victim and suspect.

But after the shooting deputies went inside to find who they now say is the real suspect on top of a man, choking him and "tearing at his face," the department's statement said:

Deputies could see the victim was about to go unconscious and a large knife was on the floor near them. The deputies were able to use physical force to subdue the suspect and end the assault. The suspect was taken into custody without further incident.

Sheriff's investigators now say that the alleged choker, Alexander McDonald, was the thin man in a black shirt that they were looking for. Deputies allege that he held Winkler and two others captive inside an apartment before allegedly stabbing them and fighting it out with them as they tried to subdue him, according to the statement:

One of the victims was a roommate of the suspect; Winkler and the other victim were visiting at the time of the incident.

No less than three people contacted the Weekly prior to today's revelations to say that the department's original version of events, including that the man they killed had "aggressed" toward officers, was sorely wrong. But none would speak for the record.

Deputies say Winkler died after he was taken to a hospital. The L.A. County Fire Department twice told us he was dead upon their arrival at the complex.

The victim who was also shot took a round to the leg and was hospitalized in stable condition, officials said. He also sustained stab wounds to his neck, they said. A third man sustained stab wounds to his legs, arms and chest but was already out of the hospital, authorities said.

The District Attorney's office charged McDonald with "one count of murder, two counts of attempted murder, and one count of torture," the sheriff's department said. He was being held in lieu of $4 million bail, according to the sheriff's statement. Sheriff's inmate data indicate's he's 27.

tragic but I don't understand why he was "lunging at the back" of another victim?

So an innocent man was killed due to the police thinking he was going to cause injury.

The actual assailant who was causing injury at the scene was subdued without further incident...

Because the police thought they were in danger with Winkler running towards them, while the real assailant was too busy trying to kill someone else.
 
I would rather 5 cops die in the line of duty than to have cops kill 1 innocent person. Risk is inherent to the job that you chose. Erring on the side of risk towards innocent people is the utmost of cowardice and any cop that is involved in something like this should realize that they are horrible people and should be punished severely.

What a tragic story. But the cops seemed to be acting appropriately given the (wrong) information they had and the little time they had to react.

I can see that. Sounds strange to say he was lunging at someone.

What that means is that it would not be unreasonable to question the veracity of that report, and cops have been known to embellish the truth or outright lie to cover up bungled arrests or outright murder
 
There were 3 cops. If the guy wasn't armed (and he wasn't, he was one of the hostages), there was no need to shoot him.

You can't shoot anyone that "lunges" at you. You have to be in fear of your life.

Given that they already gave one false account of the incident I will deserve judgment on whether they were acting on faulty information or not.

Ahh I get you now. And yeah I can kind of see that as I can't picture him lunging at another victim for any reason.

I guess if I'm ever in a tense situation with police involved I'll just lay on the ground and hope I don't get shot. Or take my chances with getting stabbed
 
This is so messed up. Not only did they shoot and kill a victim they apparently thought was an assailant, they also apparently accidentally shot a guy they knew was the victim in their eagerness to shoot a guy they (wrongly) thought was the assailant to halt his attack against the victim (who they ended up shooting in the leg.)

This makes running towards cops when being attacked sound pretty unwise--if they feel like your attacker might move on to them, shooting you becomes an acceptable risk?

Yeah.

I just hate how everyones like, *Shrug* shit happens, but I refuse to believe with better training/stricter oversight things like this wouldn't happen

This makes running towards cops when being attacked sound pretty unwise--if they feel like your attacker might move on to them, shooting you becomes an acceptable risk?

They will get 1 month suspension with pay
 
It he only has a knife, why are they using guns instead of tazers?
 
This shit is only going to get worse.

I bet cops are probably trained to shoot first and ask questions later, now that they know they're basically immune to any kind of criminal or legal consequences.

Wait. The attacker got charged with one count of murder? He's getting charged with the cops mistake? Am I reading this right?
 
So they were able to use physical force to subdue the real attacker who was actively attempting to kill someone and had a weapon nearby, but shot at two people with no weapons (further) injuring one and killing the other.

Well done.
 
Man, how do you screw up so badly? I know being a cop isn't the world easiest job but damn.

I would imagine cops are scared to death in situations like these, and since they know nothing bad will happen to them if they kill the wrong person, they're ready to shoot anything that moves.
