In the US, does the defendant have the choice of being heard by a judge instead of a jury?

Yes, but a Jury Trial is more beneficial for the Defendant than a Bench Trial. In a Jury trial a decision has to be unanimous, so convincing 1 person that you are innocent means you go free.

You can waive your right to a jury trial in most cases, but the court and the government have to ok it more or less. I think as long as the defendant and the defense are competent, it is allowed just so it can't be brought up on appeal.

The funny thing about all of this is that aiming your gun at someone IS deadly force (drawing isn't though)You're absolutely right, it shouldn't be happening. The only time it should be happening is for public safety/self preservation.

No joke. I saw footage of a cop putting his rifle into a car window with the barrel at point blank range from some guy's face.

It is astounding and this is the norm in America. Always a hand on their gun ready to whip it out at the sight of minimal danger.

There's zero call for them to be drawing it as well, at least in my eyes If you draw your weapon, and it doesn't immediately follow with aim -> shoot, you didn't need to draw it there. It's end-time stuff.
 
J. Cole was on point, telling Vice to get there earlier so they can capture some of the more positive protesting.

Yeah, this is blowing me away as well. I mean, I hope they're rubber bullets, but still... I would think anyone who has actually handled guns would get a very queasy feeling actually pointing one at someone. It isn't something you just kinda casually do. It's not even that hard to learn, imho. Pointing a gun at someone feels like holding a knife to their throat, just instinctually, once you actually have experience with firearms.

Like I've said before in here, I only know the absolute basics of gun safety and have very little experience with firing them.

It still makes me very uneasy to see this sort of thing. Rubber bullets or no. The person you're about to shoot can't tell the difference until you shoot them.

so what happens when one of these protesters gets a gun pointed at them by police, fears for their life and busts back? these police are really instigating a situation that doesn't need instigating. if i was one of the protesters down in MO i'd definitely have my North Face on and have a ski mask tucked in my pocket given how wild the police are getting.
 
I like this guy, pretty spot on analysis.

Seriously, the last two protesters on the Vice stream have been giving great commentary on the situation

I agree. I remember hanging out with my friends about 2 years ago in a mall and one of the clerks inside the sword shop said to the mall cop "Isn't weird that we get one of these and you guys don't?" he was referring to a taser. He's able to use or sell them in his shop but the mall cop isn't authorized to carry one. Where is the logic?
