Fire HUH!

Highly inappropriate use of work facilities? ☑
Uncomfortable and unreliable worker relation? ☑
Powder-keg lawsuit awaiting detonation? ☑

drop him, get into orbit

How's this a possible lawsuit? Unless we take The Onion's "Why won't these homosexuals stop sucking my dick" article as a possible truth.

Also why don't you link to the WebP if it's from GfyCat? GIFs are olde.

Totally. I've been giving five cent mustache rides for years now and I've only recently made enough to cover the cost of the t-shirt I had printed up. Times is hard.

Your avatar suggests you would have more business sense, hell, you let dudes eat your shit for free!

If he's willing to engage in this sort of behavior on the first day, do you think he's going to be any better in future incidences? Fire him.

I live in philly...fire him and replace him with me. I guarantee no oral sex will be performed during work hours!

The rest of the conversation is a blur, mostly because I was too busy mentally confronting the fact this employee was standing really close to me, and my face was currently being caressed by the musty steam of a strange man's dick, balls and semen on his breath. I laughed it off, gave him a non-committal "You're soooo bad!" and looked for the most immediate excuse to leave the room.

What the hell kind of response is that? If anything it sounds like you approved of his actions.

how does someone just go into a bathroom and initiate the type of conversation for sucking another persons dick? the whole OP confused me on a lot of levels.

the real issue would be that if he had said it with the other being a woman, or himself a woman, there would be somewhat subtle high-fiving in the office and here as well. Far fewer people would be willing to fire him.

That said I would argue than ANY claim to sexual activities during work hours is really not desirable at all. He may just be really excited, or alternatively legit crazy, or trying to get some unlawful termination lawsuit money. So make sure you fire him for unprofessional conduct. (or whatever counts as legally legit)

I would probably have fired him on the spot. After asking for the receipts, of course.

I've sat here scrolling through this thread with one arm extended and eyebrows up wondering the same thing.

And he just ran up to OP and told him this. What is for to in how do know why?

What's this based on? I assume most bosses frown upon sexual activity in the office.

Have you given any consideration to the possibility it was just an awkward tongue-in-cheek joke he was making because he was on the shitter for a long time?

While the reaction probably wasn't ideal, what happened was just so outrageous, I can't expect any Manager wouldn't have been thrown off guard.

Except Melkr_, who seems to be defending this kind of on-the-job behaviour.

I would have fired him on the spot. That's completely inappropriate...and quite creepy to randomly say to your boss on your first day.

You have to fire him, any number of things could lead to your boss finding out, and if he finds out you knew about this, you'll get a hell of a wedge.

"I did not have sex with that woman"

This really isn't the rocket science division of gender norms and all. And self-justification also makes for other hilarious scenario's where say, an anti-gay politician can actually have a gay affair and not see how those two should collide. This being a case that was widely reported, it's far more common on the same-sex side.

Who jokes like that??

My friend and I joke like that all the time. He comes back from a bathroom break: "dude what happened, you get stuck in the toilet seat?" "Nah I just went around blowing every guy in the bathroom". It's just crude humor.

I'm just saying, if Roy's boss finds out and comes down on him he could say he misread it and thought it was a joke since no sane person would seriously just announce it to their boss that they're suckin down anonymous dongers.

sorry OP. That's just an extra-long smoke break. It's usually standard that most employees are allowed to take a 15 minute break in addition to lunch during work shifts.

Or maybe he could claim it was his lunch period? Anyway, I don't think you can fire him for some volunteered information, can you? Or without proof anyway. And it isn't harassment, although I guess you could argue he harassed you...

I am talking against the relevance of the blowjob as the primordial issue here, nothing more or less. Imo he is totally being shamed for it and well, I'm not into being a puritanism apologist.

difference between joking around with a friend and your boss who you just started working for.

Was totally expecting Vince McMahon to be the OP.

You have no idea how confused I was when I realized he wasn't the OP

I'm not even sure what would possess someone to say that to someone they work with.

Well, there's a litany of issues that could justify him being fired for such an action that have nothing to do with puritanism

If he was my employee I'd fire him. Just not professional conduct at all, whatsoever.

That and theft of company time.

Doesn't matter if it's a joke. Still falls under sexual harassment.

Yes but people can just read situations badly and make stupid decisions or say dumb things because they want to sound funny or edgy.

He's the boss, he has the power to decide whether it's a forgivable offense or not. Believe it or not, some people care more about resolving individual issues rather than just throwing the book at every offense.

Idc who you are. If you're giving random dude's blowies in a public restroom I'm going to shame you.
Somethings deserve shaming. Anonymous sexual acts (outside of the profession of sex) are one of those.
