yeah participated is almost a given, but what will that give him in sentence time?

If he doesn't go down for this he's almost certainly going down for the other murders he's been charged with and, at the least, if he sneaks out of all murder charges he'll do time for weapons charges.

the dude is done, this is actually the weakest case against him and he might not even get out of this one.

I forgot that he hasn't even been tried for the other suspected murders. This is like the first of many hurdles. Sheesh.

Not really tough at all. You're not going to have a picture of him shooting the guy. There is a ton of stong evidence.

Well with most juries these days anything less than a clear video of the crime and written signed confession it could go either way. Thanks to shows like CSI and the like people expect a literal smoking gun, and if they don't get it "reasonable doubt"

Sadly you're right. At least if the defendent can afford a good lawyer. Which Hernandez obviously can.

Yep, there is a reason most high profile murder cases like these tend to result in accquital rather than conviction the past few years unless there is a smoking gun/confession.

I honestly can't recall the last time one of these high-profile murder "celebrity" cases resulted in conviction.

Shayanna was brought in for a Voir Dire before the jury was called to see if any of her previous testimony had changed. As she had committed perjury before the Grand Jury (lied 29 times). She was asked specific questions and seems that some of her answers have changed since then. Like borrowing the sisters car as a norm and Aaron telling her to get rid of the box in the basement. She will testify before the jury later today.

It's pretty much impossible to lose immunity playing the don't remember card. There is no way to prover she doesn't remember.

Interesting development this morning, one of the jurors was excused from jury duty for personal reasons. Apparently the juror had caused them to reschedule court previously, so I'm guessing its just due to work/job obligations and he couldn't take any more time off. That's just my guess though.

Actually they gave her immunity so they would have leverage over her. With immunity she can't plead the fifth. She has to answer questions and can be charged with perjury.

Today in review: Trial Day 36

Nine Jurors have been brought in one by one to speak with the attorneys and the Judge at sidebar. After a lengthy discussion on what Shayanna can and cannot be asked a voir dire begins. This is done outside the presence of the Jury.

McCauley asks Shayanna if she spoke with AH when police showed up at her house on 6/17/13. Jenkins remembers it being dark. She saw flashlights. She looked at a surveillance monitor. Shayanna says she had convo with AH about police being at home, says she asked what was going on, he didn't know. “We both had question marks” Jenkins said of when she and Hernandez first went to police station.
“Was there any conversation about Odin Lloyd’s murder?” pros asks “Yes” Jenkins says.
Jenkins says after she heard Lloyd was murdered she asked AH if he did it "He said no." Despite finding out Lloyd's body was found near her home, she didn't have any conversations with AH about it.
Shayanna says she did not understand most of text message she received from Aaron. Prosecutors say it instructed her to remove the guns.
McCauley: How many guns have you seen in your home? Jenkins: "One ... in the junk drawer.
Shayanna says she doesn’t' remember having convo with AH about the gun.
On grand jury testimony, McCauely asks her if her memory has been revived Shayanna: In a sense, yes.
Jenkins says her recollection has changed regarding conversations with Wallace, but not AH. On removing box/items from house: Shayanna says she was instructed to take it out of home, didn't speak to anybody else about it but AH. Shayanna says it was important for her to get rid of the item from basement. ( Shayanna's statement about importance of removing items contradicts what she told grand jury in '13)
McCauley: Did you take steps to conceal the box? Shayanna: Yes.
Shayanna admits she removed box in a way concealing it so people wouldn't tell what she was doing. White sweatshirt - she washed one at AH’s request. Doesn’t remember what happened to it.
At Grand Jury, Shayanna said it was not uncommon for her to borrow sister's car. Today she says confused her memory on mom/sisters' car. Today, Shayanna says it's uncommon for her to have borrowed her sister's car, contradicts Grand Jury testimony.
Jenkins said some conversations regarding a confidentiality agreement to housekeepers happened after Lloyd's murder.
McCauley: Did you know Bo's true name before the homicide of Odin Lloyd? Shayanna: No.
That ends the Voir Dire. Next time she will be questioned in front of the Jury.

Another juror has been excused - the third of this trial. The FBI witness will be put on hold so that they can accommodate Shayanna’s lawyer’s schedule.

McCauley asks Shayanna if she had a vehicle in 2013. Shayanna pauses, says she has a white Audi. Jenkins also recalls in spring 2013 a tan Toyota Camry being at the house's garage. "It wasn't a specific vehicle for anyone." When Camry was delivered to N Attleboro house, in April/May 2013, she was home, AH was on his way. Shayanna says AH had told her to be home and accept the vehicle. Jenkins doesn't remember setting up the delivery of the Toyota Camry. (NOTE: Prosecutors say guns were delivered in that car.) Shayanna says AH had told her to be home and accept the vehicle. Shayanna doesn't recall having convo about where Camry was coming from, what it was for. “I was always at home. I wasn’t waiting for the vehicle,” Jenkins testifies. Jenkins spoke to AH after he received a call from the driver. She told him the driver couldn't make it on their street. A few minutes later, AH arrived home, she doesn't recall what vehicle he was driving.
McCauley: "Who is Bo?" Jenkins: "A friend I guess." (Note: It's co-defendant Ernest Wallace) Shayanna not sure how long AH knew Wallace, 'a few years maybe.
June 2013, Shayanna says AH & she rented place in California, 'Manhattan Beach' or Hermosa Beach. Shayanna says she and AH spent time at rental house in California in spring 2013. She's not aware Bo being there at that time.
The day before the Toyota came in, Jenkins believes AH was on his way back from California. Shayanna Jenkins said she paid the remaining balance for the transportation of the vehicle.
Jenkins says she asked AH how long Camry would be in garage. He said not long Shayanna says the Camry 'stayed there' in the garage, does not recall any further conversations about purpose of car.

Jenkins identifies the Toyota that authorities say AH used to transport guns. “Was the car ever used?” ADA McCauley asks. “Not to my knowledge,” fiancée says.
Jenkins said she had never heard of Oscar Hernandez, before her lawyers told her after the murder. McCauley asks Shayanna about the gun in the house. Shayanna tells jury it was in the junk drawer in the kitchen. Shayanna says the gun was black, doesn't remember the size. McCauley indicates Shayanna previously said gun was an inch shorter than piece of paper 'on long side'. “I don’t remember how big it was” Jenkins says of gun she found in junk drawer.
McCauley: "When you saw that firearm, what did you do?" Shay: "I gave him a stern look. Not sure if we exchanged words."
Shayanna Jenkins says next time she looked in the drawer, gun was gone. She says she doesn't know how much time passed. McCauley is now showing Jenkins a photo of AH holding a black object in a surveillance shot. Asks if Jenkins recognizes the item. Jenkins: I can’t see the full item. “Only a black blob it looks like”.
McCauley holds out the Glock .45 (not murder weapon) that jurors saw. Jenkins says shape and color are the same.

Prosecutors asks Jenkins if she ever knew Wallace as Gregory Moore. McCauley asks Shayanna if AH ever referred to Wallace in family terms. She's not sure. Shayanna says Wallace would stay in basement, says she has 'no idea' what AH & Wallace would do in basement. Shayanna Jenkins says AH would smoke marijuana in basement of home. Jenkins now recalls that she met Odin Lloyd through her sister, Shaneah.
McCauley: Are you close, as sisters?
Jenkins: Silence.
McCauley: Were you?
Jenkins: "We're estranged, kind of."
Shayanna says she had cordial relationship with Lloyd. Shayana says she had convo with AH about where he got marijuana, he said from two contacts, one of them being Odin Lloyd. Shayanna: AH said he was paying Lloyd for marijuana. Shayanna says relationship between Lloyd & AH: "they were friends." At grand jury, McCauley says Shayanna described AH & Lloyd as 'cordial'. Shay, after reading her previous testimony: "I said they weren't the best of friends." Shay: "Just because I said they weren't the best of friends doesn't mean they weren't friends."
McCauley now asking Shayanna about Friday before Lloyd's murder; night AH & Lloyd went out to Rumor nightclub. Shayanna says she doesn't really remember the Friday night, only 'vaguely' Morning of 6/15/13, Shayanna, AH & AH's mom were supposed to go out for breakfast, but AH had crashed overnight at flop house. Shayanna says she tried calling AH, no luck, then called Shaneah to contact Lloyd, get message to AH. Shayanna says AH texted her the morning of 6/15/13.

“Did he tell you what the spot was?” prosecutor asks. “I’m not sure” Jenkins says. McCauley asking Shayanna to explain 'bugging,' she said to be 'out of your element'.
Shayanna says AH arrived home the morning of 6/15/13 in black rental SUV. AH was with Lloyd, who left a few minutes later in the SUV.
Shayanna says she called babysitter, Jennifer Fortier, to come over night of Father's Day. Shayanna says Fortier accompanied her and AH to Mexico in March 2013 trip. In Mexico, Shayanna recalls using her phone, having to make international arrangement.
Jenkins discusses the surveillance footage at her home. We're looking at footage from June 16, 2013. Video shows AH & Shayanna going out for Father's Day. Shayanna says AH was smoking marijuana as seen in the video. Jenkins says AH smoked marijuana at this time. "It was frequent" it was on a daily basis.

On the way to dinner, she learned her and AH were going to South Street Cafe in Providence, RI. Shayanna describes arriving at South Street Cafe, sitting at high-rise table with AH& company, having food & drink. Jenkins remembers hanging out with AH's barber and his fiancée that night. Roberto Olivares (barber) would go to her house to cut AH's hair and supply him with marijuana. Says the party stayed at South St Cafe 'until closing,' around 1. Shayanna says she doesn't recognize the white shirt with a hood AH is wearing in the photo of her standing next to him.
Now looking at phone number information with Shayanna's name. Jenkins asks prosecutors to remove the AT&T bill, because it featured her social security number.
AH borrowed my phone because his "died." She doesn't remember seeing him use it. Prosecutors believe he was setting up the murder. When AH walked outside bar, she stayed in at the table. Didn't have convo with AH what he was doing outside the bar. (Bar manager testified she saw AH & friend smoking pot outside the bar) Jenkins said both she and AH were a little drunk when they left the bar that night.
Jenkins said she didn't have any contact with Ernest Wallace. After arriving home, Shayanna recalls talking with babysitter.
Now looking at video showing AH & Shayanna arriving home, 12:39 a.m. 6/17/13. Jenkins watches herself park the SUV at her North Attleboro home. She moved it closer than AH parked it.

Shayanna says she saw Wallace walking up driveway, gave him a hug. McCauley asks Shayanna if she noticed anything unusual about Wallace, 'was he wet to the touch?' She doesn't recall. AH cousin said Wallace & Ortiz were jittery, sweaty, after smoking PCP.
Shayanna testifying about when she & AH returned home from Providence bar, seeing Wallace & Ortiz at the house. Jenkins says she never saw Carlos Ortiz before that night. Shayanna says she didn't know Ortiz's name at the time, later learned it but doesn't remember how. Shayanna identifies Wallace & Ortiz after being shown their mug shots.
Jenkins: Wallace would stay in the basement bedroom. <Long pause> Maybe a couple times a week or month. Shayanna says she made no observations of Wallace & Ortiz's demeanor while they were at her house.
Jenkins said she saw the men - Ortiz, Wallace and AH - go down to the basement. Asked if she saw anything in anyone's hands, she pauses, 'not that I can remember'. After trio walked out of basement, Shayanna not sure what they did, not focusing on them, she was talking to babysitter. After a couple of minutes," AH, Wallace & Ortiz left, says she's 'not sure' if they had convo about where they were going. After they left, Shayanna says she might have gotten call from AH, maybe for Lloyd's telephone number. Shayanna says she texted her sister, Shaneah, after AH asked her for Lloyd's number. Jenkins sent Lloyd's number to AH. After sending AH Lloyd's number, Shayanna doesn't recall having any further contact that night with AH. Jenkins stayed up for a while after the men left. She stayed up talking to the babysitter. She later went to bed. Shayanna says she's early riser, woke up next morning at 7 a.m., she doesn't remember seeing AH that morning. Shayanna tried contacting him, doesn't remember if she made contact, she got out of bed, remembers seeing him in the basement.
Jenkins is now saying that she doesn't think she saw him in the basement. Now she says that she saw AH in "the kitchen or family room" in the morning after Odin Lloyd's murder.
McCauley: "How did he appear to you?" Jenkins: "Normal."
Shayanna says she also Ortiz/Wallace in kitchen/family living room area. 'They may have been talking, but I'm not too sure'. Jenkins said she made breakfast for them. AH was interacting with the baby. They were at the pool area. Shayanna describing seeing AH, Wallace & Ortiz hanging poolside on a sunny day. She made them smoothies. That afternoon, Shayanna saw AH, Wallace, and Ortiz leave in a car (the Altima). (They returned about 20 min later in a different car). The next time she saw AH, he was at the house. She doesn't remember if there was anyone there with him.
McCauley asks Shayanna if she remembers going out evening of 6/17/13 with AH. She doesn't recall. Evening of 6/17/13, McCauley indicates Shayanna & AH went out to Home Depot, a steak house. Debit card records correspond to that. Around 9:45 p.m., 6/17/13, Shayanna recalls seeing flashlights/lights going through her blinds. Shayanna says she & AH went to home video system monitor, scanned their perimeter. Are you able to use control panel in bedroom to have a view from different cameras? Shayanna: Yes
Shayanna saw two people outside her house with flashlights. These were the two initial police officers. Shayanna not sure how much time passed between when they saw the men with flashlights and when someone went to front door. Shayanna was watching from bridge inside the home as AH answered the door. "I was peering over, watching". Shayanna doesn't remember if either she or AH made comment about the two men on video being police. AH went outside home for few minutes, came back in. Inside the house she asked him what was going on. He said "He didn't know." Shay says she believes AH asked her to drive him to police station. Shayanna drove AH to N Attleboro police station, 5 min drive, dropped him off.
Jenkins dropped off AH at police station, then was pulled over on the ride home. Jenkins says she spoke to police for a few minutes. Jenkins says she doesn't remember receiving a phone call during the stop. Jenkins says that when she was in parking lot talking to police AH called "to check on me, letting me know he was ok". He told her to call his agent. After leaving the police station, Jenkins says she went to meet up with Bo (Ernest Wallace). (Shayanna did not tell grand jury in '13 that she met up with Wallace after leaving N Attleboro police station) Aaron called her after she was done talking to police. He told her to meet Bo and give him money. Shayanna doesn't recall seeing or hearing of a conversations between AH & Wallace on the evening of 6/17/13. Shayanna says she was just given an exit number from AH to meet Bo. Shayanna drove to a shopping plaza in Franklin to meet Wallace, she had 'several' phone contacts with Wallace on the way there. Shayanna says after making contact with Wallace, she got back on highway, drove toward Providence. Shayanna: "I believe (Wallace) said he was coming from Connecticut" Shayanna says she drove through Providence, got off on an exit on I-95.
McCauley asks Shayanna if she's ever been in E Greenwich, RI Shayanna: Not to my knowledge. McCauley asking Shayanna about flop house apt, Shayanna says she never went there, never given directions to it. Shayanna: after getting off on I-95 exit in RI, Wallace showed up 10-15 min later. She was at a McDonald's. Shayanna says Wallace asked her if she was okay, 'that everything's gonna be okay,' how baby was doing. Wallace didn't say what money was for, says she went to bank 1 or 2 buildings over to make withdrawal.
Shayanna: it was dark out, early morning. She doesn't know bank branch, says she withdrew $500. $500 was max she could withdraw. She doesn't recall how much Wallace asked for, but it was more than $500. After making withdrawal, she went back to meet Wallace, saw Ortiz with Wallace in a car. She pulled up next to Wallace car, Wallace was driving, got out of his car, walked around to her, she gave him the money. Shayanna told Bo to be safe before she left McDonald's. During this time, Shayanna recalls having conversations with her mom, Shaneah, and Brian Murphy who appears to be AH agent.
Shayanna says she doesn't recall receiving a text message from AH while he still was at N Attleboro police station. On the screen, we are seeing text AH sent to Shayanna, about box their daughter played with in basement movie room.

McCauley: Did Avielle play with a box in the tub? Shayanna: With toys, yes
McCauley asks if bath toys were kept in movie room. &#8220;I don&#8217;t think so, I&#8217;m not sure,&#8221; Jenkins says.
McCauley: "Do you know what LMAO means?" Jenkins: "Um, laugh my ass off."
"Wink wink - does that have any meaning to you," Prosecutor asks. "I guess just being a jokester," Jenkins says.
Jenkins remembers responding to this text message. Texts show Shayanna responded 5 min later, with 'OK that was awful... perfect TV... love u". At time she received text, Shayanna says she was either with Wallace or on her way home.
Shayanna doesn't remember the name of town where ATM she withdrew money for Bo was located. McCauley shows Shayanna ATM record showing she made $500 withdrawal at 12:48 a.m.; about 1/2 hour after receiving text from AH. McCauley is now going over phone records with Jenkins on the night of 6/17/13.

On night of 6/17/13 into 6/18/13, Shayanna was calling Wallace several times. 1:24 a.m., 6/18/13 Shayanna had a phone call with her mother. Jenkins received phone call from her sister around 1 am on June 18. Shaneah Jenkins on one of these calls told Shayanna Jenkins that her boyfriend, Odin Lloyd, was dead.
State: How soon after hearing about Lloyd death had u been able to speak with your sister Shayanna: A little after leaving police.
7:46 a.m., 6/18/13, call from AH to Shayanna.
Calls continue throughout the night and into the early morning between Shayanna, Shaneah, mom and Brian Murphy.
Shaneah and her Uncle arrived at Shayanna's N Attleboro house later on 6/18/13. AH was sleeping when Shaneah arrived. Shayanna doesn't remember what time AH woke up the morning of 6/18/17. Shayanna says she later saw AH watching TV when he got up. AH asked Jenkins to wash one of his shirts for him. She doesn't remember what type of shirt. He then left the house in her white Audi and went somewhere.

Right before we get to the testimony about trash bag and box in basement, Judge Garsh suspends testimony for the day. Jury leaves the court room.


Jenkins' attorney Janice Bassil is being combative, says she's never seen a direct exam drag on as long as she's seen today. Garsh said her client will be held in contempt if she is not here. Bassil says she has a federal case going on, wants to be here in courtroom when Shayanna is testifying. Judge essentially says - too bad. Jenkins must be back on Monday.

It's one of the mysteries of this case. Odin was at the flophouse with him at the time. Not sure why that would be a big deal. Shayanna doesn't seem to remember if he told her what it was. "Spot" would typically mean a place. People speculate that Odin knew about the other murders and it may be a motive.

I think her testimony about having to get rid of the box, and hiding it and how important it was is going to be the final nails in his coffin.

Anyone following today's testimony other than the OP? I'm in the office today so I'm unable to watch/listen to the testimony live feed. Instead, I'm periodically looking at the twitter feed for Brian Fraga.. He's a staff reporter for the Fall River Herald News. He is doing a great job of posting trial updates.

Seems that they're discussing the box.

ADA McCauley resumes direct exam, begins asking about AH’s use of her phone on 6/16/13 at South Street Café. Shayanna says she doesn't know who AH was communicating with on her phone on 6/16/13 while out at Providence RI bar. ADA McCauley shows calls AH made from Jenkins phone to Ernest Wallace hours before the murder.
Seeing phone records from 6/16/13, from Shayanna's cell. Shows text to Wallace at 11:30pm. Shayanna doesn't recall sending that. She says she had no reason to contact/text Bo that night. Shayanna says she was at South Street Cafe in Providence RI when texts were sent to Wallace from her phone.
Several texts sent between 11:29 p.m. and 12:11 a.m. from Shayanna's phone to Wallace. She had her phone returned to her after they got home. 2:19 a.m., 6/17/13, Shayanna says She sent Wallace a text, to wish him a happy father's day. Record shows 7:54 a.m., Shayanna sent text to AH, after she didn't see him right away that morning of 6/17/13. Shayanna says she doesn't recall if Aaron used her phone on drive home from South Street Cafe in Providence RI.
Shayanna says she does not remember where she was when AH called her at 2:15 a.m., does not know what phone AH used to call her.The record above the ruler is call AH made to Jenkins from a new phone early morning of June 18.

Call lasted 1 min 17 secs, Shayanna says she doesn't recall what she and AH talked about. Shayanna not sure what time she arrived home on 6/18/13 after dropping Aaron off at the PD and giving money to Wallace. Doesn't know how long after she arrived that AH returned home.
Now a video shows Shayanna's white Audi pulling into driveway around 2:16 a.m. on 6/18/13.

Jenkins then pulls the car out of the spot - backs up - and drives toward that garage. She gets out, on the phone. Jenkins says she believes she is talking to her mom on the phone. Shayanna says she went to bed, doesn't believe AH was home at the time, not sure how long after he arrived, 'maybe couple of hours'.
McCauley: When you next see the Defendant, what did you talk about? Jenkins: "I asked him if he did it, and he said no."
Jenkins says she first learned of Lloyd shooting “when police stopped me”. Says she spoke to sister a little after that. The morning of 6/18/13, Shayanna says AH came downstairs, stayed home for half hour, then left. After he left house, 6/18/13 12:46 p.m., Shayanna says AH called her (from 'burner' phone prosecutors say). Call was 54 secs on afternoon of 6/18/13 from AH to Shayanna on the new Tracfone AH obtained.
Shayanna says AH told her to 'remove a box' from the basement in the storage room. It was a cardboard box and said it was important. Shayanna says AH tone of voice was 'normal' when he asked to get rid of box in basement storage room. Jenkins says the box was in the storage room. Says it was the only box there - everything else pushed to the side. Jenkins uses her hands to show how big the box was. He stands up and shows the jury how tall and wide it was. Shayanna says she didn't examine box's contents.

Jenkins: "I don't know if I grabbed the black trash bag" before I went to the basement or after. Shayanna says she put clothing on top of box 'so nothing was exposed,' says 'natural instinct' kicked in. Shayanna says she had no convo with AH about contents of box. “I wasn’t necessarily hiding it from certain individuals,” Jenkins testifies. Jenkins then carried the box out the back door. Went up to the patio. It was "maybe 35 pounds."
Jenkins said she asked to use her sister’s car before she talked to AH. She put the bag in the trunk because 'it wouldn't stand in back seat'.

Shayanna says she went back inside the house and down to the basement again. Jenkins had her cleaning lady move her car so she could get to her sister's vehicle. Video then shows Shayanna leaving in her sister's car. Says "I went to get the items I was originally going to get." Jenkins "disposed of" the box, in "a dumpster." She doesn't remember where the dumpster was. “So how did you find the Dumpster?” “I drove around,” Jenkins testifies. Shayanna says she was nervous 'with everything that was going on'. Shayanna says she doesn't know what road Dumpster was off, maybe was in a residential area but not sure.

Shayanna: There were a lot of things going on.... everyone’s emotions were on me.
Shayanna says she was also stressed out in part with having to comfort her sister, Shaneah, who dated Odin Lloyd.

Shayanna says she went to bank to get money, doesn't remember what it was for.

Defense attorney Rankin starts by asking Jenkins about her Bristol, Conn. Family. Shayanna graduated Bristol Central High School in '07, attended a local community college. Shayanna worked at Marshall's and Big Lots in high school. Jenkins says her last job was at Big Lots in Bristol, Conn. as a store manager in 2011. She moved in with AH at his condo in Plainville in spring of 2011.
2012, Shayanna became pregnant with AH child, gave birth to daughter Avielle in Nov '12

Shayanna says she ordered TV/home theater/entertainment man cave room for AH as a Christmas present.
Rankin asking about March '13 trip Shayanna, AH took to Mexico, and brought babysitter along. After NFL season 2012-13, AH & Shayanna rented house in Los Angeles, California. Jenkins testifies that while they were in California, alarm went off “a number of times” at her N Attleboro home. Shayanna: open door, alarm gave her concerns, especially since AH was famous NFL player, so she inquired into upgrading home security system. After returning home from Cali trip, Shayanna met with security company rep, arranged to install upgraded security system.
Rankin: "How long have you known each other?" Shayanna: "Since elementary school." “So at each step along the way you were in the same grade in school?” defense atty asks. Jenkins says yes.
Shayanna: Her family & AH family knew each other, didn't really socialize with each other. Jenkins and AH "grew close to each other" in middle school. The relationship evolved in high school. Jenkins said "it was a high school dating relationship." They went to dinner, passed notes, hung out. Shayanna: She & AH had on-again, off-again relationship, had 'rough patch' in high school, 'high school drama' girls wanted him. AH went off to Gainesville to play for the Gators and they would talk "maybe once a month - twice.
Shayanna: Death of father caused 'profound sadness' in AH, who became closer to his cousin Tanya Singleton. Jenkins "never really understood" the relationship between AH and Tanya Singleton until later. "She was like a mother figure."
After AH had the first NFL off-season in 2011, Shayanna says she & AH decided to make it official, become a committed couple. Shayanna talks about a 'falling out' with AH over infidelity "I caught Aaron cheating". After she went through his phone and "found some things I didn't like."
Asked what kind of accommodation they reached, Shayanna pauses, clearly emotional, teary-eyed. Attorneys go to sidebar.
2012, Shayanna & AH looked for home, in December '12 She, AH and baby moved into N Attleboro house.
Rankin is now asking about the relationship between AH and Odin Lloyd. Rankin: Was Aaron a regular user of marijuana? Shayanna: Yes At Plainville apt & N Attleboro house, AH had designated spots to smoke marijuana. "Man cave" was spot in N Attleboro house. Shayanna recalls AH & Lloyd hanging out until 5-6 a.m., smoking marijuana. When Shaneah visited MA, Shayanna says she & sister would go out shopping, AH & Lloyd would smoke pot, play pool in basement. “Would you describe Aaron and Odin as friends?” Rankin asks. “Yes.” Jenkins testifies.
Couple of occasions, Shayanna says AH would drive Lloyd home to Dorchester after socializing. Shay says it wasn't unusual for AH to go out late at night. Part of "mental compromise" to not "pick arguments over it." Jenkins says she tolerated AH's late-night shenanigans and figured he would eventually grow out of it.
Jenkins knew that AH had the Franklin flophouse. Never went there, knew about it before 'all this happened' She understood that it was "rented for Bo." Rankin turns attention to 6/14/13 - When AH went out to Rumor with his barber & Odin Lloyd. He also asks about tension between Aaron and his mother. They were supposed to all go to breakfast the next morning.
Rankin: Source of tension between AH & mom was his mother having affair with Tanya Singleton's husband, and later marrying him. Jenkins says the relationship between AH and his mother was "a work in progress."
Morning of 6/15/13. Shayanna says she understood 'the spot' in AH text to her to mean the apt in Franklin.
On the evening of 6/15/13, Shayanna describes going out to dinner at Longhorn steakhouse with AH & their child.
6/16/13, Father's Day, Shayanna says she planned picnic in park, did that in afternoon, 'pleasant day' with AH & their daughter.
Shayanna says before all this happened, they had plans to marry in April 12, 2014, in California. Says he proposed in October '12 - day of her baby shower.
Rankin now asking Shayanna about gun she saw in kitchen 'junk drawer'. Shayanna talked about gun in junk drawer at 2013 grand jury, 'at some length,' Rankin says. Jenkins said last Friday she doesn't recall having a conversation with AH about the gun in junk drawer.
August 2013, when she testified at grand jury, Shayanna estimated box she carried out of basement weighed 25 lbs.
Defense asks if she smelled anything when she took the box. “A sort of skunk smell” which she recognized as marijuana.

How can you prove she committed perjury? How do you prove she recalled when she said she doesn't?

Yeah, I still don't understand this. Her excuse is essentially an alternative to pleading the fifth. Prosecution has nothing to go on, because everyone suddenly has amnesia related to the murder.

Why? There's evidence that shows his DNA being at the scene of the crime.

His fiancee being very evasive and unable to remember any details does not help his cause.

Remember that he can be convicted unless there's reasonable doubt. It doesn't mean that there's no doubt. People have been convicted on lesser circumstantial evidence before.

Tons of people have been convicted with far less evidence. There is a ton of circumstantial evidence.

Went to weight room. “I went directly to the weight room. I saw two of our sprint coaches and AH”. Kraft says AH told him he was not involved, was innocent, and was in a club at the time.
Kraft: "I wanted to get him help." Says every player is considered part of Patriots family.
Kraft wrote an affidavit related to this case. He's reading it now. He spoke with AH for about 10 min, didn't speak about anything else. Kraft: I think he said victim was boyfriend of his fiancée’s sister.

Kraft takes second to recall AH went to Univ of Fla, when Urban Meyer was coach. Fee asks Kraft if he remembers that AH was first team All American at Florida and won best tight end award. On reporting policy, Briggs says NFL employees involved in potential criminal situation had to report that to team/league.
June '13, Briggs, after learning of murder, met with AH in weight room to talk to him. Briggs says he asked AH about the murder, "I asked him if he was involved in the incident." AH told him "No".

Prior to training room convo, AH had not reached out to him. Briggs said he tried to contact AH "3 or 4 times". In the training room, Briggs said he told AH he tried contacting him. AH said he had phone problems, would get new phone.
Briggs: On June 20, "I actually asked Aaron to leave the building."

Security Director says he asked AH to leave because "it was bad for business." He confirms "business-element" is why he asked. Briggs says they shook hands and AH left without incident.

Hodge & Lloyd played semi-pro football together with the Boston Bandits. He & Lloyd played semi-pro ball since 2007/2008. Says Lloyd played tight end, long snapper
He and Lloyd would work out together and see each other daily in Spring '13. Hodge says he knew Lloyd smoked marijuana, on daily basis. Never saw Lloyd with AH. Hodge says Sat 6/15/13 Lloyd drove up to scrimmage in Black SUV. They hung out, went to friends’ homes.
6/16/13, Hodge & Lloyd hung out, Lloyd picked him up in Suburban. Later that night, around 8:30 p.m., OL got text message. Hodge says he noticed Lloyd got a text on his phone from a “distinct name”. (Reminder: AH was listed as 'Dis Nigga' in Lloyd's phone) Odin dropped him off at his home and that was the last time he saw him.
Hodge says he got call around 8:30 p.m. on 6/17/13, from OL's sister asking if he had spoken to Lloyd that day. Hodge was at home when he learned Lloyd had been killed. Went to Lloyd's family home, stayed there 2-3 hours.
Hodge says at Lloyd's house he saw family, police & black suburban.
Friends gather at Lloyd's home on hearing of his death. Prosecutor to Hodge: "Did you ever see AH there?" "No." Hodge says he never saw AH at Odin Lloyd's family home. Two weeks before murder, Hodge says Lloyd showed him two sandwich bags full of 'doobies', marijuana joints.

Hodge says he had never seen Odin with this much weed before. Odin never indicated what he was going to do with the bags. Hodge testifies that Lloyd didn’t frequent clubs. “He’s a homebody, he’s usually at home, and he didn’t do a lot of going out”.

Dumont was tasked with determining route prosecutors say AH & associates took from N Attleboro to Dorchester to pick up Lloyd. Dumont was looking for surveillance cameras on possible routes AH & associates allegedly took from Lloyd's house. Dumont says he recovered surveillance video from Mass Pike West cameras.
Dumont says he was able use video to track Altima to Weston toll booth. Says he go there in in 20 min. Dumont says he headed down 128 South toward North Attleboro area. Trooper says he was doing 70-75 mph.
Now the trooper is discussing his reenactment of the drive from Dorchester to North Attleboro.
State is done with the witness. Now under cross, Rankin again criticizing accuracy of trooper’s drive times. Did this to prior trooper.

What was the point of having Kraft come into the courtroom? Seems a bit random.

One reason is because Aaron told him that he was at a club when the murder happened. It shows for one that he was lying and two he knew the time of the murder without being told exactly when it happened.

Robert Paradis, high school friend of AH:

Paradis talking about April 2013 trip to Los Angeles that AH invited him; Paradis flew 1st class to LA, paid for by AH. Aaron and “Bo” (Ernest Wallace) met him.
They stayed at a condo in Hermosa Beach from April 26-May 1. They hung out, went out to eat, went to bars. Paradis talking about marijuana smoking AH & Wallace did in LA; says they smoked 'every couple of hours'. Paradis says AH borrowed his phone while they were in Cali, made calls to Fla (where Oscar Hernandez Jr lives).
Paradis: Aaron flew out of LA on 4/30/13, Paradis stayed behind until next day. 4/30/13, day Paradis says AH left LA, is date that Toyota Camry was to be delivered to AH's house.
Paradis says shortly upon his return from LA he was contacted by three people. FBI and State Police.
Paradis as he identifies number AH called from his phone on April 27, 2013. McCauley showing documents indicating Fla phone number AH called using Paradis' phone is the number of Oscar Hernandez's parents.

I'm trying to understand the timeline for the above bolded statement. When did Paradis get interviewed? It was after the murder around June 16th, right? I mean, he didn't get interviewed before the murder was committed right? The word "shortly" seems to imply within a week to me.

In April 2014, a federal grand jury investigating interstate gun trafficking slapped Oscar Hernandez with a 5-count indictment. Mr. Paradis returned from his trip with Aaron the end of April. His number appeared in Oscars phone records.

Today in review: Trial Day 39
We got testimony from Alexander Bradley. He has a civil suit against Aaron for allegedly shooting him in the face when they partied in Miami one night. Alexander Bradley Civil Suit He is not allowed to disclose that to the jury however.

This morning there will be a Voir dire (testimony not in front of jury) for Alexander Bradley. He was shot in the eye by Aaron in Florida. He is not allowed to mention that he shot him in the eye. Can talk about guns.

Bradley met AH through mutual friend in 2010. &#8220;It wasn&#8217;t much of a relationship - I met him thru a mutual friend,&#8221; Bradley says of beginning of their relationship. Bradley started considering AH a friend in 2011, after first full season in the NFL.
AH and I would hang out three or four times a week. We hung out at both Plainville and N. Attleboro homes. Bradley would bring AH marijuana, did favors for AH, and did shopping for him. Bradley says their relationship at beginning was based on him bringing AH marijuana, 1 to 4 ounces at a time. Sometimes he didn&#8217;t give me the money up front&#8221;. AH smoked marijuana &#8220;quite often,&#8221; Bradley says. &#8220;Chain smoking&#8221;. &#8220;The times I would bring it from Conn to N Attleboro, those were the smaller quantities,&#8221; Bradley says. Bradley: "I would spend a majority of my time in the basement" referring to AH's North Attleboro home. Bradley says he would smoke marijuana with AH in basement; says he saw gun in basement lock box. There was also money and weed in the lockbox. He would sometimes put the box in a closet, "but mostly it was in the bar area."
Bradley: his relationship with AH ended in Feb '13 (month he alleges AH shot him in Fla). &#8220;Up until February I considered him a good friend, one of my best friends,&#8221; Bradley says.
Bradley is talking about the trip to Florida during which he says AH shot him in the face. Bradley, at the hotel, saw "at least five guys" at AH's hotel when they were down in the Florida. AH had it in his hand. He left the firearm on the chair when they left. "It looked like a Glock to me." (Bradley is talking about his trip to Miami with AH 4 months before Lloyd murder, says he saw a black Glock in hotel room.) &#8220;I never saw the firearm again,&#8221; Bradley says.
Bradley met Oscar &#8220;Papoo&#8221; Hernandez while in Florida. Bradley says Oscar Hernandez Jr - "Pappoo" - was one of guys in the hotel room in Fla. Bradley says he saw AH with Ernest Wallace & Carlos Ortiz several times. Bradley says the three were together at Tanya Singleton's home in Bristol at holiday gathering. Bradley: one time driving from MA to CT, he got flat tire, called AAA, but AH called CO & EW, and they went to pick him up.
Bradley says he met Odin Lloyd at AH kitchen Dec 12 or Jan 13. Lloyd was with his girlfriend.
Bradley: AH told him he had a hard time trusting people in general, felt people were trying to use him. AH said friends were ungrateful for favors he did for them, felt he was used, 'unreasonably suspicious' of people. "I thought for the most part he did trust me, I know a lot about him&#8221;. In convo with AH, AH told him 'he doesn't like people knowing his business'. AH didn't want him using iPhone around him, thought convos would be picked up by the iPhones. AH told him a 'special operations' guy told him during team meeting that iPhones can pick up convos. AH said he'd been followed by law enforcement, helicopters. Voir Dire questioning is finished.

Now testifying in front of the jury. Bradley says he met AH in 2010 in Bristol. Bradley says at first he saw AH once a week when he was going into NFL. Bradley says he and AH had a &#8220;business relationship&#8221; in 2010. &#8220;He would call me for marijuana&#8221; He would purchase 1-4 ounces. Ranging in price from $300-1300. Bradley says they became friends after about a year. Bradley and AH would smoke weed and play video games the first year of the friendship. Bradley was Hernandez's dealer.
Bradley says relationship progressed. AH invited him to Miami after Aaron's 1st year in NFL. Bradley said he met Shayanna Jenkins. He had gone to AH&#8217;s condo in Plainville. Bradley visited AH at his N Attleboro home, stayed over 'quite often'. We would smoke marijuana, play video games, and go out. Bradley spent most of his time there in the basement man cave. Bradley: "We were cordial," describing his relationship with Shayanna Jenkins. Bradley says he usually brought AH 1 ounce of pot for $300. AH would roll it and smoke it. Smoked 'very often,' 'chain-smoking,' sometimes back to back. He sometimes would finish an ounce of marijuana in one day. He would do errands for, AH driving him to stadium, picking up clothes for him.
Bradley discussing the box: "It was a black safe," it was "in the bar area." Bradley: AH had opened box, saw a silver-grayish semi-automatic firearm with brown handle, money, marijuana joints inside. Bradley is now discussing the different in size between a joint and a blunt. He saw "a few at a time" in the box. Demonstrating With hands Bradley says gun was 8-9 inches long.

Bradley said he was supposed to be the godfather to AH&#8217;s daughter. We had a solid relationship, we were good friends. He went 3 times with AH to Fla., last time was Feb '13 trip to West Palm Beach. 2 friends of AH picked them up at West Palm Beach airport, went to local hotel. Bradley says they went to hotel and Oscar "Papoo" Hernandez was there along with other friends of AH. Bradley mentions seeing the black handgun in the hotel room; says friend passed gun to AH, who held it & looked at it. Bradley: before they left, AH put gun on chair in living room area of hotel room. Bradley says gun 'appeared to be a Glock'. They left, and came back to the hotel. Didn't see gun again. Bradley says black handgun appeared to be 5-6 inches long. Was with AH in Fla for 3 days. Saw Pappoo at Super Bowl party in Belle Glade, Fla housing complex.
Bradley is now testifying that he has met co-defendants Ernest Wallace and Carlos Ortiz in the past. Bradley saw Wallace 3 times, Ortiz 2 times. Saw both at Holiday party 2012 at Tanya Singleton's home. Bradley now testifies he met Odin Lloyd, saw him in December 2012/January 2013 at AH at his N Attleboro home. Saw Lloyd enter home through kitchen area door, saw OL with his girlfriend, Shaneah Jenkins, holding hands. Lloyd & Shaneah walked by, walked upstairs, AH told Bradley he thought it was rude for Lloyd to walk in and not say hi. "Did you see that?" AH said to him. Bradley, on other occasion, saw Lloyd leaving AH house with Shaneah as Bradley was arriving at house. Bradley says he had no other conversations about Odin Lloyd with AH besides the 'rude' remark. Bradley now testifies about AH not trusting people. He didn't like people 'knowing his business'.

Cross Exam:
Rankin asking about prior trips Bradley took with AH to Fla, including trip in 2011. Rankin pressing Bradley on details about dates he spent at AH homes in Plainville & N Attleboro. Rankin asks if this basement lock box w/ the gun looks like this. Bradley: "Yes, similar." Bradley says he 'believes' he saw the silver gun more than once in the basement box/safe.

Defense asks Bradley 'bout gun at AH home: "that gun, a silver gun with brown handle. It was not a glock? No sir.

Bradley testified at 3 grand juries, spoke to police several times, but 1st time he mentioned Oscar Hernandez was Dec '14. Rankin says Bradley made no prior mention of gun in hotel room until Dec '14. Bradley agrees. Rankin asking Bradley what kind of marijuana he dealt in - 'Usually, anywhere between 10 to 30 lbs."
Bradley says he doesn't recall previously denying providing marijuana to AH previous statement shows otherwise. Bradley saying court transcript of his previous testimony that he did not provide pot to AH is 'an error'. Rankin now mentioning Bradley's July '06 conviction of possession with intent to distribute controlled substance in CT. Rankin says Bradley has pending 3rd degree burglary case in CT. Bradley also has pending April 2013 case for disorderly conduct, criminal mischief 2nd degree, assault 3rd degree. Rankin is going into all the charges that Bradley is currently being held on in Connecticut. Bradley is disputing some of the exact criminal charges he's facing, not that he has pending criminal cases. Rankin mentions jail convo Bradley had in Sept '14, 2 days after he rejected plea deal; Bradley hoped deal would improve.

RE-Direct:
McCauley gets Bradley to say he has no plea deal in MA. McCauley says Bradley previously testified at GJ about gun in Fla hotel room, that it was semi-auto. McCauley saying Bradley testified about gun in Fla hotel room before Dec '14 police interview Rankin mentioned earlier.
Bradley says he saw media 'news flash,' pic of Oscar Hernandez, notified prosecution. Bradley saying he saw photo of Oscar Hernandez in Dec '14, first opportunity he had to share that info with prosecution. McCauley holds a gun out to Bradley and asks if it's similar to the one in the box: "Dissimilar."

Re-Cross:
Rankin: two separate meetings with prosecutors in Dec '14, Bradley denied ever dealing marijuana to AH. Jan '13, Bradley arrested for operating under influence of alcohol in MA, Bradley violated probation, arrest warrant issued.

Re-re-direct:
Bradley says he didn't know about the probation violation or the arrest warrant. Bradley tells pros he learned that today.

The prosecution expects to rest their case today.

Saw a tweet that their IT guy, Racette, has watched over 560 hours worth of surveillance video from AH's house. Wow.
 
So has the prosecution established a motive yet? Because while it seems that a lot of this is point at AH no motive makes this a tough sell, no?
