Trial Day 11:

Yesterdays testimony included the rental car manger who found shell casings in the damaged rental car. There was also blue gum found stuck to a shell casing. Funny enough Aaron had offered her a piece of the same gum. A DNA expert that worked the murder case. Azia Jenkins who is the uncle of both Shayanna Jenkins and Shaneah Jenkins testified about something Aaron said the day after the murder. They were playing pool and watching the NBA finals. A commercial came on and Arron said “My endorsements are gone.” Azia didn't push the matter further.

A motion hearing was also held after the jury was dismissed for the day. The state brought in a childhood friend of Aaron, Robert Paradis. He testified that he visited Hernandez in Los Angeles in April 2013, and that Hernandez said while driving a rental vehicle that he had “heat or fire” under the driver’s seat. Hernandez also said during the visit that he had a .45 caliber gun (the same use to kill Odin), and at one point called Paradis and asked him to go into his room to see “if it was in his nightstand,” Paradis testified. He said he felt an object wrapped in a shirt in the dresser, and the item was “in the shape of a gun,” but he never saw a firearm. The Judge has ruled that he will not be allowed to testify as there were inconsistencies to his prior statement.

First witness today is Mass state trooper John Conron. He recovered evidence related to Hernandez’s video surveillance system in the former Patriots player’s North Attleborough home last summer.

Today in review: Witnesses

State Trooper John Conron:
He was on a team that recovered video surveillance from Hernandez’s home. Gave an overview for the Jury on the DVR system used in Aaron's home. The state had him point to and take out a hard drive while on the stand. He also wrote down the wrong serial number belonging to the DVR.

Trooper Zachary Johnson:
Went to Odin's home to alert the family that he had been killed. He also Interviewed the sister who was the last person to see him. Her text messages to and from Odin are not allowed in at this point, but are compelling.

Odin 3:07 a.m.
"Did you see who I am with?"

[no response]

Odin 3:11 a.m.
"Hello?"

Sister 3:19 a.m.
"phone dead. Who?"

Odin 3:22 a.m.
"NFL"

Odin 3:23 a.m.
"Just so you know"

He was in the car with Aaron and the two other men at this time. It is believed that he was killed between 3:23 - 3:27 am

Trooper Johnson also seized a scale with a pink dish from a safe inside the master bedroom closet. The also took 4 pair of Nike sneakers and a long sleeve white sweatshirt that Aaron is seen wearing when he comes back in the house holding and object that looks like a gun.
B-OIc9jCEAAVxRY.png

Trooper Joseph Collins:
Was responsible for collecting Aaron's blackberry from the law office in Boston. He got some tin foil from a sub shop because he knew he was getting a cell phone. He would use the foil to permit the phone from receiving a signal in-case anyone would send a remote signal to erase data on the phone. When he arrived the phone was in three pieces. The back was off and the battery was out. He was not aware if any tampering had occurred prior to him getting the phone.

Timothy Woods, supervisor in drug ID unit:
He basically tested the pink dish found with the scale and found traces of Marijuana. He also tested the blunt found at the crime scene.

Trial Day 12:

Court is back in session today. After yesterdays testimonies had ended and the jury was excused a Voir dire was conducted on Dorothy Stout, forensic video analyst. She is a witness for the prosecution and the defense wanted to get a feel for her expertise. She spent time at Aaron's home analyzing his surveillance cameras and footage. In the end they asked the judge that she not be allowed to testify as they believed she didn't have enough experience. The judge wasn't ready to rule on whether she could or couldn't testify, so they left for the day.

This morning she has deferred her testimony to give the defense more time to read up on her and doing their own research.

FALL RIVER, Mass. —The judge overseeing the murder trial of ex-NFL star Aaron Hernandez warned the victim's mother to not cry on the stand in front of jurors Wednesday, a reference to the two previous days she left the courtroom in tears when seeing photos of her son's body.

I realize this is a bit old but it's the first time I've heard about it. An outrageous order from the Judge, telling a victim's mother not to cry. Would you not cry when seeing pictures of your dead son? The judge is inhuman.

"I understand this is very emotional for you," the judge told Ursula Ward, the mother of Odin Lloyd who was set to testify for the first time. With the jury out of the room, Superior Court Judge Susan Garsh instructed her to "retain control of your emotions."

What a monster.

Seems fair after she ran out of the courtroom in hysterics twice in two days. And it's worth noting that she was able to comply with the request and "remain stoic."

Emotional outbursts can bias a jury.

Seems like every judges I hear about today are pieces of shit
It's easy to think people are "pieces of shit" when you don't even attempt to understand the context of their actions.

I don't see the problem here. If I were the judge I probably would have given the same disclaimer, it's a court room not a therapy session.

Old news and very standard in court cases.

The judge is there to ensure a fair trial, not to protect emotions (as callous as that may sound).

If the judge did otherwise, he would be incompetent.

It's to avoid influencing the jury but at the same time you can't really blame her. Crying is the proper response to pictures of your son's body.

...you ever done jury duty? the instructions are simple dont judge the message by the messenger. Crying is fine long as she tells her testimony and is recorded by the court and understandable to the jury.

Not that it really matters, but I've been called, but excused in voir dire. Regardless, instructions can't unring a bell. Allowing such prejudicial testimony and trying to dismiss it with just a instruction to the jury is a sure path to a mistrial.

Judge is a piece of shit.
Again, if you don't care about the context of the responsibilities a person is required to abide to, it's easy to call them "pieces of shit."

Rocky D'Angelo:
Works for transportation services company that handles customer service for EZ Pass. Prosecutors say Aaron drove through Weston toll on Mass Pike without paying, on the night of the murder. The time synchs to when the state says Aaron picked up and left with Lloyd. He talked about how cars/license plates are photographed when going through tolls.

Jwan Farakn:
Employee of Blue Hill Express gas station/convenience store. This is where Aaron stopped, got gas, gum and a black and mild. He paid in cash because the system to ring up items was down.

Sgt. Paul Baker:
State Trooper in the homicide unit assigned to the DA. He served the search warrant to Aaron in an effort to get his cell phone. Sgt. Baker was also the one who removed evidence items from dumpster, placed them in his truck.

Jean Lorizio:
She works for Boston's Licensing Board as an attorney. In opening statements, Fee said Odin Lloyd was looking for late-night after-party hotspots to hang out on 6/17/13. Ms. Lorinzo stated that the sell and purchase of alcohol is not permitted after 2 a.m. The state was trying to show that there was no club or party for them to attend.

Jose Lopez:
Next door neighbor of Odin Lloyd. Lopez saw Odin Lloyd a few days before the "incident." He saw him in a black SUV. They waved. He also has cameras set up around his home. His camera caught Lloyd getting into the car with Hernandez. (Jury is show the video from Mr Lopez’s cameras getting into the Nissan Altima.)

Trial Day 13:
On Friday there was a heated exchange between the state and the Judge. They wanted to call Odin's sister as there next witness, but the Judge would not allow them to ask her about the text messages. After going back and forth the state decided to wait and maybe filling an appeal to get the judge's ruling overturned. The text messages were sent to her before he was killed. The context seems to be the Judges problem with them.

Odin 3:07 a.m.
"Did you see who I am with?"

[no response]

Odin 3:11 a.m.
"Hello?"

Sister 3:19 a.m.
"phone dead. Who?"

Odin 3:22 a.m.
"NFL"

Odin 3:23 a.m.
"Just so you know"

She replied with "lol..you aggy" (aggravating) As she was trying to sleep. The Judge took it as Odin was boasting that he was with Aaron, but the state wanted to show that he feared for his life at the time. The judge is hearing arguments from both sides this morning to see if she will change her ruling.

Trying to explain the emotional context of those texts is difficult whether it was Lloyd being excited or fearing for his life. I think it can at least be admissible as far as stating, Lloyd was with Hernandez, in the car, at this particular time right before his murder.

The Judge has changed her ruling. They will be able to ask her if she was texting him, but cant not say what the content of the text were. The judge will tell the jury that they cannot speculate about the substance of the texts.

Next witness: Barbara Chan:
Worked at Needle Tech, company that manufactures animal needles, located in the industrial park. She was working overnight shift (11 p.m. to 7 a.m.) on night of murder. At 3 am lunch break she would nap outside in her car. She heard 3-4 loud bangs while napping in car. Says she was half asleep.

Michael Ribeiro:
Another Needle Tech employee. Employee also worked night of murder. He also took break at 3:05-3:10 AM. Heard a loud bang sound, consecutively, 6 to 8 times... sounded like echoing sound'

State trooper John Conroy:
In addition to the 1st degree murder charge, Aaron faces one count of carrying a firearm without a license, two counts of possessing a large-capacity firearm and two counts of possessing a firearm without a firearm identification card in this trial. Conroy, a ballistics specialist, is describing the crime scene and an "area in the woods. He describes an embankment where .22 was found.
B-ie00ZIcAAAoDJ.png

The gun found is not the murder weapon. It was put in evidence and stored. The gun has been tied to Aaron Hernandez. Was purchased in Florida.
B-ifzpLIIAAy9QJ.jpg

The gun as it looks today. Prosecutors have tied it to an alleged associate of Aarons in Florida who recently pleaded guilty to shipping guns to MA. On June 22, went to Aaron Hernandez's house and found a box of .22-cal long rifle ammo. Same ammo as .22-cal gun found.

State Police William Tarbokis:
Works for the Crime Scene Unit. Took finger prints of Odin after death. Crime Scene Services unit. Defense assuming forensic experts don't want to find real killer but just confirm police/prosecution theories

Marilia Prinholato (Housekeeper #1):
From Brazil. Moved to Massachusetts because she had a dream of studying at Harvard College. Worked small jobs but found Harvard to be too expensive. Started taking classes at Mass Bay Community College.
Cleaning woman describes making the bed in Aaron Hernandez's guest room. When she went to put on the fitted sheet a gun fell on the floor. She picked it up and put it back between the mattress and the box spring. She described the gun as an automatic gun and between 30 and 40 centimeters. She saw the gun again a week later.
Aaron and Shayanna were getting ready to go out one night. The maids asked if they could come back the next day to finish cleaning as Shayanna was getting ready in the bathroom. When they came back the next day and cleaned the bedroom one maid found a smaller gun in the pocket of Aaron’s pants.
One day before the arrest she and the other maids that cleaned the house were asked to sign a non-disclosure agreement. Marilia did not sign it. The Defense claims that Prinholato's boss was told of the non-disclosure agreements two weeks before she received them. The document was actually from another Patriots player and was for the state of Rhode Island and not Massachusetts.

Grazielli Andrade Silva (Housekeeper #2)
Also from Brazil. Was the head of the house keeping staff. Aaron asked her to iron his shirt and pants before going out. When she came back the next day to finish cleaning she went to pick up the pants and felt a gun. She pulled it out of the pocket showed house keeper #1 and put it back in the pants pocket.

On June 18TH, Grazi spoke to Shayanna and she appeared to have been crying and was nervous. Says she was paid by check that day. (If Shayanna went to get money for the housekeepers, as she told Shaneeah, why did she pay for the service via check?) She didn’t sign the non-disclosure and did not work there again.

During cross examination, Silva says she is an illegal immigrant in US.
Defense Attorney: "You believe that your cooperation will help you with your immigration status, don't you?" Housekeeper: Yes
On re-direct, McCauley asks Grazi if she's been promised anything in exchange for her testimony. She says no.

The murder trial continues today with the third housekeeper Carla Barbosa. She is testifying today using a translator. She is also from Brazil.

The dude leaves guns just hanging around the house for anyone to see? Some of them unregistered?

I'm sorry, but how dumb can this guy really be? Like, seriously. It boggles my mind how poor his decision making skills are.

Carla Barbosa (house keeper #3):
Carla came to America in Aug 9, 2008 and began working as a house cleaner. Originally from Rio De Janeiro. She cleaned a condo that Aaron owned. She also cleaned his home in North Attleboro.

Testified to seeing a tall black man that would sometimes stay at Aarons home in the basement. (Probably Ernest Wallace) “I would smell marijuana in the basement. I saw the older black man in the living room and in the kitchen.” She says cleaning staff handled trash, never his fiancé. (Shayanna Jenkins seen disposing of black trash bag day of murder) She didn't feel anything under the mattress on 6/18/13. (State’s goal is perhaps to show gun used and disposed of by then.) The basement or “man cave” was very messy after the murder.
Carla saw Shayanna coming out from behind the swimming pool area when she went to move her car. She was carrying a black garbage bag. Shayanna asked Carla to move her car so she could get out. She put the trash bag in the trunk. (She was supposed to be going to the bank as she told her sister to get money to pay the maids. But she had already paid them by check.)
Video was played: shows Carla moving her white car to front of garage and Shayanna putting the trash bag in the trunk.
Not sure how long Shayanna was gone. When she came back later, Barbosa says Shayanna was speaking on the phone, crying, looking at the window, pacing, nervous.

Another video is shown of Shayanna taking out the garbage bag.

Mass State Police Trooper Heather Sullivan:
Trooper did trace examination of Lloyd's body. Detailing the process of how meticulously look for evidence: skin, fiber, hair. Sullivan works in the morgue and worked on Lloyd's body in that room.
Sgt .Daniel Thom State trooper:
Was at the autopsy of Odin Lloyd. Investigators collected blood, nail clippings, hair at autopsy of Odin Lloyd.

Jessica obidoux:
Works at state police crime lab in Lakeville. She saw a grainy photo that led her took look for specific clothing. The witness testifies she tried to find the clothes Aaron was wearing the night of Lloyd's murder. She took 4 pairs of white sneakers from Aaron’s home. They all tested negative for the presence of blood.
She also took a look at the mattress in the guest room. The mattress had an “impression or pattern” in it, police witness testifies.

Daniel Pratt:
Works at state police crime lab in Lakeville. Crime Scene Analyst. He analyzed the Nissan Altima that was allegedly on the crime scene. He diagrammed areas of the vehicle he collected gunshot residue samples from. No blood was found on door handles of Nissan Altima.

Brian McDonough:
He runs a strength-and-conditioning business. Knew Aaron before murders, through teammates and working at stadium. Got a call from him on 6/16/13 to tell him they would be working together and to set up a schedule. The plan was to get Aaron in shape, focusing on his footwork, training camp was around the corner. Aaron missed the 6/17/13 afternoon appointment w/McDonough (about 10 hours after the murder) Brian texted Aaron at 8:35pm on the 17th.

Your welcome.

Trial Day 15:
Shayanna is back in court today after missing the last five days. The last couple of witnesses were really focused on her including a video shown of her taking out garbage after the murder. Possibly getting rid of the murder weapon and clothing. She has been granted immunity at the request of the prosecution in order to get her to testify.

Testimony will continue today although it will be a half day.

Only two witness today as it was a half day. The first witness was on the stand for over 3 hours. He spent a majority of the time explaining his profession and the difference between pistols and revolvers. He went through the many ways he determines the size of a round, caliber of weapon and a run down on Glocks.

Sgt. Stephen Walsh Mass. State Police:
Walsh worked in ballistics in the firearm identification system. Walsh responded to the crime scene on 6/17/13. Another trooper received 5 spent shell casings, took them back to crime lab. All of the discovered shell casings/projectiles came from the same Glock, according to Walsh. Even the one casing that was found in the trash at Enterprise.
Police found .45-cal ammo boxes in Aaron Hernandez's apt in Franklin, MA, but that evidence is out because of problems with a search warrant. Prosecution in pretrial tried linking Aaron to a Glock, even tried submitting a college pic of him holding the apparent gun. The judge did not allow that photo to be used.

Vanessa Sanchez:
She went to South St. Cafe in Providence the evening of June 16. Sanchez went with her boyfriend, says she met with her boyfriend’s cousin, his girlfriend, Aaron and Shayanna. This was a dinner for Father’s day. They were drinking, talking about their children. The group had a picture taken and then Aaron and Shayanna left around midnight.
B-tR57jXAAIDMuw.png

Aaron appears to be wearing a white, hooded sweatshirt. Prosecutors have said he was wearing the same the night of Lloyd's death. Vanessa is seen in yellow. Says Aaron appeared to be acting normal during dinner. This was her first time meeting him as he was friends with her cousin.

Kelly Rose Belanger, civilian witness:
Was the manager at the South Street Cafe, where AH ate the night before murder. She says AH went outside several times. He arrived at the cafe around 9:15pm. Which means he was texting Wallace & Lloyd while he was there w/friends. She smelled marijuana and saw AH and another man smoking outside. She asked them to put it out as other customers could smell it.

For the party of 6 AH paid $273 for the bill - grey goose vodka, wings, Hennessy, Bud light and a sex on the beach were ordered.

Dr. Assaad Sayh:
Owner of Blue Hill express service station where AH was spotted in the driver's seat in Altima & bought gas, gum and black and mild. Owner of gas station simply testifies he made copy of video for investigators. Witness testifies time on video system was accurate.
Video is shown to the jurors from the gas station.
Video shows AH getting out of the driver’s seat and apparently telling Ortiz to get back in the car. AH swipes his credit card, gases up the vehicle. Ortiz is seen with a white towel around his neck. The same one found at the crime scene. He goes into the store and Ortiz follows. AH returns to car area, with Ortiz, and appears to do small dance in parking lot. AH driving is significant because shell casings were later found underneath the driver's seat.

Trial Day 18: After lengthy talk about phone records on Friday, the trial continued today with a late start due to snow. We started with the same "professional" witness from Sprint and in the last 30 minutes got to Odin's sister.

Ricardo Leal:
Records Custodian for Sprint Telecommunications. He's a professional witness. Testified 200 times all over the country on behalf of Sprint record keeping.
Testimony continues from Sprint employee. Going through phone records and such.

Justin Darrow:
He works for Sprint as a radio frequency engineer. Testified that he went to the cell locations from the phone records and took photographs. Described the Sprint network and how pinging works to give the location of person based on their cell phone.

Shaquilla Thibou:
Odin Lloyds Sister.
2:30 a.m., 6/17/13 Shaquilla was in her boyfriends car, saw Odin get out of the Suburban, threw Red Bull can in the trash. Saw Odin leave in suburban for 1 hr before returning. Saw a silver sedan, maybe a "Nissan Maxima" drive by her and stop outside her house. No damage to the car. Shaquilla saw her brother get in the rear passenger seat and then the car drove off. Her phone died so she put it to charge. Once the phone was turned back on, she saw there were two texts from her brother Odin. She had two texts from her brother at 3:07am and 3:11. She replied at 3:19. He responds at 3:22 and 3:23. Day of 6/17/13: Shaquilla sees Suburban in driveway, no contact with Odin. That evening, state police contacts her. Prior to and after murder, Shaquilla says she never saw, had no contact with AH.

Those text message records are fascinating to read. The scrambling to try to cover it up and the back and forth with his trainer...wow what a piece of shit

After 18 or so days, how fucked is Hernandez looking
In the beginning it was looking like he may walk. No murder weapon and no witnesses leaves you with circumstantial evidence. But as of late the State has stepped up and the evidence is mounting against him. He may get a lesser charge than first degree, but he will get something.

That's what I was wondering. Just over a week ago I read more about the trial and about how much of the evidence was circumstantial. It really sounded like they didn't have the bullseye they needed. I also hate hearing about defenses playing the 'he was happy and smiling just hours before, do you REALLY think he's crazy and committed a murder after being happy that day' game.

Prosecutors have said AH texted Shayanna morning of 6/16/13, said he was 'bugging' that Lloyd knew about "the spot" Prosecutors said previously 'the spot' may have been the Franklin apt that AH and Lloyd brought two women after leaving club. Prosecutors also suggested 'the spot' may have been scene of Boston 2012 double homicide, but defense called that 'fantasy'
Lloyd's phone shows 3 outgoing calls to AH phone around 1am on June 17, the morning he was shot.

6/17/13; 2:24 a.m., call from Ernest Wallace's phone to Odin Lloyd, 24 secs
Call logs now showing incoming calls Odin Lloyd received after 8 am. on 6/17/13; all calls went to voicemail. Prosecutors said Lloyd was killed around 3:30 a.m. on 6/17/13
B_Lq5AuW8AA9Mzh.jpg

Logs now showing times of text messages Odin Lloyd sent his sister, between 3:07 a.m. and 3:23 a.m. 6/17/13 After 2:32AM, no more voice calls from Odin Lloyd; but records confirm he sends texts at 3:07a, 3:11a, 3:22, 3:23 final text. Odin Lloyd's sister testified yesterday about receiving text messages, but prosecutors cannot tell jury what messages said.

Glaucia Santos:
Santos immigrated to the US in May 2013. Santos worked at a bakery, cleaned homes, she also worked as housekeeper at AH house. Santos worked for Grazi, the Brazilian housekeeper who ran her own housecleaning business. Said she first went to AH home on 6/4/13 (13 days before Lloyd's murder) Santos testifies (through interpreter) that she cleaned AH home on Tuesdays in June 2013, including June 18, day after murder. Santos said in the basement area, she noticed smell of marijuana. Santos saw 'a considerable amount' of marijuana on a basement counter on 6/18/13.
Day after LLoyd murder, she sees AH touching security camera in the ceiling in the basement. While in basement, Santos said she 'made a noise' so AH knew she was there, he then left basement. Santos spends another hour in the basement cleaning, saw three people in the house: two men, one women, 'his wife'

Santos says she heard Jenkins tell the other housekeeper to move her car. 5 p.m. on 6/18/13, Santos finishes working at AH house, saw Shayanna on phone, crying, seemed to be nervous, and looking outside.

David Mackin:
Massachusetts state trooper. Finger print specialist
Trooper was the person who took the picture of the .22 found in the area of the crime scene.
B_MhT-9WwAAaObG.jpg

He didn't find fingerprints on either the gun, the magazine, or the two rounds within in. No fingerprints on the shell casing found at the crime scene or the one found in the dumpster. Mackin was in charge of processing the Altima and Suburban, looking for prints. Altima had 35 latent prints; Suburban had 21 marks/latent prints. Trooper says he compared prints to AH, Odin Lloyd, Carlos Ortiz, & Ernest Wallace...among others.
3 latent prints from Odin Lloyd were in rented Chevy Suburban. Nothing from AH or co-conspirators there.
Wallace's prints in front passenger area, Ortiz' prints in rear driver's side area.

David Mackin:
Attorney Sultan continuing his cross-exam of the Massachusetts state trooper. Defense questioning why gloved trooper separated gum from shell casing found in car before his DNA crime lab could see it. Trooper confirms prints of Darryl Hodge were also in Suburban - that contrasts what he said yesterday.

Sherri Menendez of the Mass Crime Lab:
Examined the sweatshirt AH was wearing. Examined a firearm, magazine and two rounds recovered the same day, June 17, 2013. Menendez testifies she didn't find any rust on exterior of the gun. Examined the 6th casing pulled from Enterprise dumpster. Says it had a bit of green staining. She examined the white towel found at the scene. Found several dark hairs, tested for DNA. No seminal fluid on towel, also tested for fun shot residue. Menendez also examined spent projectiles found at murder scene.
“Jury taking its morning break. Judge now hearing from both sides on the Alexander Bradley motion. Judge won't allow testimony of Bradley, allegedly shot in the face by AH.”
Crime lab witness describes holes, red/brown stains on back of Odin Lloyd's sweatshirt. 11 holes total in Odin Lloyd's hoodie.

B_RP4POUwAA6YqJ.jpg

Menendez describing how she tested for gunshot residue on Lloyd clothes. Odin Lloyd's killer fired one shot from 4 to 5 feet away. A second test shows Odin Lloyd's killer fired from "within three feet." Odin Lloyd apparently raised right arm to ward off gunfire. Hole #9 in sleeve shot there fired from about 3 feet away. AH voluntarily gave a DNA sample to the lab. The defense verified that crime lab supervisor couldn't give an exact distance from the body the gun was fired. Just a range. Chemist can't tell more exact distance because the murder weapon is still MISSING; gun must be test fired; no gun, no test.

Christina Hanley "fibers" analyst:
She works in the trace, arson and explosives unit. Hanley says she examined Lloyd's shirts. Took cuttings from shirts as "fabric standards”.

John Biello Analyst:
Also works in the arson and explosives unit. Tested for gunshot residue. White towel at murder scene was negative for gunshot residue. No gunshot residue found on stubs taken from Altima either. But lack of residue doesn't mean gun wasn't fired. Biello says any friction, cleaning, vacuuming could remove residue from a surface.

Todd Girourd, Mass. state trooper:
Talked w Carlos Ortiz who has also pleaded not guilty to murdering Odin Lloyd. The witness took photos of Carlos Ortiz's feet. Officials confiscated multiple pairs of AH Nikes - size 13. Not same size. Girouard testifying about what he looks for in IDing tire-tracks.
B_R-ZF5WsAAYbYC.jpg

Took photos of tires on Altima, was given photos of tire tracks at the murder scene. Says he was immediately able to determine certain tire characteristics. Girouard says Nissan's front tires not consistent with tracks found at the scene, but rear tires had same general design.

Todd Girourd, Mass. state trooper:
Resumes testimony from yesterday. Witness describing groove patterns in tire treads. Prosecutors will likely use testimony to place Nissan Altima at the scene.

Once the trooper matched the tires, he then worked on matching 'tire anomalies' ie. cuts, holes. Says several matched. In this mold u can c where 3 stones were inside tread. Trooper says could stay in for 1000s of miles.

Barbara Scardino:
Realtor that helped patriots players find homes. Barbara was contacted by Kevin Anderson who works for the New England Patriots in April 2013, asked to look for rental properties. Showed Aaron 4 condos. Rental address shown to AH was at 599 Old West Central St. Rental apt has come to be called his "flophouse" rented in 1 month before Lloyd murder. Rental application for the flophouse; 2 bedrooms, 1 bath. 1-year rental began 5/1/13
B_WEOoeWwAAhiGV.jpg

Prosecutors says AH took victim Odin Lloyd too apt to party after the club 2 nights before Lloyd is shot. At 'flop house,' police seized 7.62-caliber, .45-caliber, .22-caliber ammo, boarding receipt for Ernest. Police also confiscated clothing, white sweatshirt similar to the one AH was seen wearing the night of Odin Lloyd's murder.

Phillip Buxton:
A neighbor who lived in the Franklin apartment complex where AH rented. Witness describes seeing man moving items into apartment at the condo complex. (Ernest Wallace) The prosecution has suggested in the past AH rented the "flophouse" primarily for Ernest Wallace.

Carol Bailey:
This witness says she has lived at the Franklin complex since the 70s. Met an "extremely nice man" named "George" that said he was moving into the apt. w/ his cousin. Older black male. Witness says she saw 'George' (AKA Ernest Wallace) and AH together at apt complex. Ms. Bailey shared a wall w/ AH across the entire length of the apt. She heard male voices, loud, a few times a week. Neighbor describes a frequent "skunk" smell coming from AH’s condo. The smells stopped sometime in June, when she no longer saw AH or Wallace in the complex.

Patrick Quinn:
Senior RF deployment manager at T-Mobile. State showing maps trying to show they can track Lloyd's movements the night of murder. Lloyd's phone show a series of communications after 2 in the morning in Dorchester, around the time AH picked him up. 2:50a Odin LLoyd phone tracked along Mass Pike. 2:53 a.m., cell tower at intersection of Mass Pike and Route 128 picks up Lloyd's phone. 2:55 a.m., cell tower south of int of Mass Pike and Route 128 picks up Lloyd's phone; shows route of travel to N Attleboro. Fits the Prosecutors timeline.
3:14 a.m. cell site near Foxboro picks up LLoyd's phone
3:17 a.m., cell site at 495-95 split picks up Lloyd's phone
The last text from Lloyd's cell phone - 3:23 a.m. 6/17/13 - serviced by cell tower in N Attleboro.
7:30 am., 6/17/13 - 4 hours after murder - the N Attelboro cell tower connects Lloyd's phone to network, for data update Over the next several hours, the same tower in N Attleboro services Lloyd's phone (shows phone, Lloyd had stopped moving)

The front tires on the Altima didn't match treads at the scene. Trooper Girouard off the stand to give the jury an up close look of tire impressions.

wait, did they or didn't they? seems that they did but that line confuses me.

Thanks guys!

The front tire treads didn't match but the rear tires did. Sorry I left that off of that entry.
Girouard said that he eliminated the Nissan's two front tires as the source of the tracks because the design was so different. But he also concluded that the two rear tires were of the same design as the one that left the track.

Today in review: Trial Day 22

Patrick Quinn:
Senior RF deployment manager at T-Mobile. We pick up from yesterday, goes over logs cell towers connecting O Lloyd's phone to network on 6/17/13.
After 2:23 a.m., 6/17/13, prosecutor notes no more outgoing calls from Lloyd's phone.

Maureen McCabe:
Mass. State Police crime lab. She's a DNA expert. DA McCauley shows DNA expert a document, it is the DNA profile of Odin Lloyd.

Lindsay Bird:
DNA analyst at Massachusetts state police crime lab. Has worked there for three years. Bird has analyzed/tested 'about 1K' DNA samples. She analyzed the known saliva sample from AH and created his DNA profile.

Diane Fifi Biagiotti:
DNA analyst at Mass State Police Crime Lab. Biagiotti has tested "several hundred" DNA samples in her experience. Tested 16 items in this case. Began processing samples on 6/25/13 - 8 days after murder.
Discharged shell casings "quantity limited", had to consume entire sample for DNA. None left to re-test. Wasn't able to develop a DNA profile on this item.
Witness said there was DNA from multiple sources on towel, but they couldn't match it. Again "insufficient."
Blunt found at the crime scene being shown, which was tested for DNA. Had a mixture of DNA from two individuals.
B_badMsUwAAV8Jr.jpg

When this item was processed the DNA analyst had only 1 known standard to compare, Odin Lloyd. Assuming there are 2 DNA contributors and 1 is Odin Lloyd, AH "matched", according to the witness.
Witness saying odds of someone else's DNA on blunt is in 1 in several 'quadrillion' people (world has 7 billion people)
On black Puma pants at house; AH DNA matches major leading profile, no DNA from Lloyd and Ortiz on pants. Again 2nd person DNA, but no results. The pants matter because they were found with a firearm (for which Hernandez had no license) in a Camry inside the garage.
On the .22-cal gun found on Landry Ave; DNA on gun not sufficient enough for testing.
Insufficient quantity of DNA for testing on magazine and 2 rounds; no detectable DNA on ammo box at AH house. Or the 28 .22-cal rounds.
On shell casing found from Dumpster at Enterprise, male DNA profile consistent with AH profile.
B_bkfjeWQAIXW9_.jpg

Defense asking DNA expert about cross contamination or "transfer DNA", regarding chewed gum stuck to the bullet casing in the dumpster. Witness testifies that she was never told the casing was attached to bubble gum when she tested it.

Today in review: Trial Day 23
Testimony continued today with the DNA analyst cross exam. Things got interesting with the testimony of Jennifer Fortier. The babysitter for Aaron and Shayanna.

Diane Fifi Biagiotti:
DNA analyst at Mass State Police Crime Lab. The witness resumes the stand for cross examination. Defense now challenging finding DNA of both AH and victim Odin Lloyd was found on blunt at crime scene. Biagiotti admits that there's no way to tell when, where or how the DNA got on the blunt.

Jennifer Fortier:
She is the sister of Shayanna’s personal trainer. She was hired to be the nanny for AH and Shayanna. Fortier went to Mexico with them to babysit. Fortier says her babysitting was 'random,' whenever Shayanna needed her. Witness said she always babysat at the home. She saw Odin & "Bo" (Ernest Wallace) at the house. She recognized Lloyd on news. Fortier did not know Odin Lloyd's name until she saw him on the news after his murder.

On 6/16/13 Fortier says she had no plans to babysit that day, got a call that afternoon from AH. Fortier says she didn't speak with AH; she called Shayanna, babysat that night, arrived at the house around 7:45 p.m. Fortier said she babysat for about 4 hours, from around 8 to midnight. They left at 9:00PM with no return time given. After they left she went to get the baby, fed her, played with her. She was startled when Ernest Wallace arrived at the home around midnight and knocked on the door. He was with a light skinned man (Carlos Ortiz). Fortier had never seen him before. Bo and Oritz told Jennifer that AH and Shayanna were on their way home so she let them in. About 20 mins later AH and Shayanna came in through the garage door. AH went up to his room. He was wearing a white sweatshirt. He came downstairs and left with Wallace and Ortiz around 1a.m. Stayed and talked to Shay for about an hour. Left around 2a.m.
Fortier: Received a phone call after Ortiz and Wallace arrived. She gave her phone to Wallace. He went into the kitchen.

Video is played showing the babysitters arrival to the home that night. Different camera angle shows Fortier knocking on front door. AH answers and lets her in.

B_qYFDdW8AA9k40.jpg

Video also shows Shayanna walking down stairs, with Fortier following her.
B_qX1wiWEAAZz7U.png

In her previous visits, Shayanna had never shown Fortier the home's surveillance system. We can see Shay "showing" Fortier surveillance system shortly before 9pm when she and AH leave. Fortier had no contact with AH from the time he opened the door until he left.
Now, video outside garage shown, later at night. Video shows AH and Shayanna; AH stands outside white Audi, lights up a cigarette or joint, and walks around the driveway.

Video shows Carlos Ortiz bending over, saying hi to the baby, walking around living room with his hands in his pockets.
Babysitters phone rings and she hands it to Wallace.
Now on courtroom monitor; video of Carlos Ortiz walking to front door, Fortier also walks to front door, closes door. Carlos Ortiz leaves out the front a little after 12:30 am on June 17, 2013.
Surveillance shows AH gets home before 1 a.m. He goes to meet Ortiz and Wallace.
B_qtIMCU8AAMMZ3.png

Ernest Wallace and Shayanna Jenkins embrace on the driveway after she gets out of the car. Living room cam, 12:45 a.m., shows Fortier on couch with the baby. AH and Shayanna walk through the room, Ortiz close behind him.
B_quAwUUsAEsETz.png

Video does appear to show AH holding something in his left hand as he walks through living room.
Now looking at the camera in the foyer, time stamp 12:45 a.m., shows Wallace enter door into basement. Foyer cam, 1 a.m., shows AH and Wallace coming up from the basement door.
B_qw1dPUsAEsQch.jpg

AH seen going down into basement followed by Oritz. They come up quickly after and go upstairs.
Great Room cam, 1:01 a.m.; AH, Ortiz and Wallace in living room, appear to be say something to Shayanna, then leave. Video shows AH picking up his daughter, holding her, while talking to Ortiz.

B_qyKr4WAAAarBv.jpg

AH appears to kiss his baby daughter good-bye before leaving with Wallace and Ortiz.
Shayanna Jenkins and babysitter Fortier continue to talk in the living room.
Switching to the driveway cam, AH, Ortiz and Wallace are seen walking down the driveway.
B_q1MyCU0AA0MpP.png

They back the Nissan Altima up to the garage. They put something into the trunk. Aaron gets in the driver’s side, Wallace in the passenger and Ortiz in the back. They all get out and go back in the house/garage.
They return to the car at 1:09a.m. Wallace got in the driver’s seat and AH in the passenger, and Ortiz in the back. They drive off.
DA alleges that at some point the trio stopped and AH took the wheel. He was driving when they arrived at gas station.
Video now shows Shay saying goodbye to babysitter at approx. 2 a.m.
B_q5gWsVAAAJuxp.jpg

Around this time - 2 a.m. AH, Wallace & Ortiz were pulling up to gas station in Canton.
Fortier says she never again babysat for AH and Shayanna. She signed the non-disclosure form brought to her by Shayanna's friend. Fortier was interviewed by N Attleboro police days later, says she didn't tell everything she knew.
Fri June 14, went out to dinner with a friend Amanda, met in New Hampshire and drove to Boston ended up at Royale (night club). She went to several bars and clubs with her friend. They the left bar at 2 a.m. They had parked by the W hotel. She was walking back to Amanda's car, saw "Aaron in his car a black SUV" parked out front of W hotel. Asked him for a ride back to her car. AH said get in. I asked "a good amount of times" to take me to my car, but "he kept driving." They left Boston. “I kept telling him I needed to leave because I was the babysitter and I was uncomfortable”. AH offered to drop her off at rest area, she refused, because she didn't know the area and her phone was dead. In the front passenger seat, she saw darker-skinned man, Odin Lloyd. In the car, Fortier says AH, Lloyd & 3rd man were smoking 'what I would think was marijuana, and listening to music. Fortier says AH drove to the end of his street, dropped one of his friends off. "He said he didn't want Shayanna to see his car," which is why AH stopped at the end of his street. Before that night, shwe had seen Lloyd one other time before, at AHs house, with Shaneah Jenkins.

Someone said let’s go to the spot. (Referring to the condo he had rented) Witness couldn't remember if it was AH or Odin.Fortier said she had never been there before and hasn't been there since. We went to the third floor, and AH let us in. "He told me his uncle lives there." AH got wine out of his fridge, she didn't drink any, they sat and talked, 'the boys were smoking' marijuana. They were in the living room for 1/2 hour, AH left to a bedroom. AH called her name, she went to the bedroom. AH was sitting on his bed, she talked to him for 10 min, AH 'tried kissing me,' Fortier says she pushed him off. She told him, I'm your nanny, I can't do this. Says AH took no offense. She asked to use her friends phone and called a cab to take them back to her car at the W. Cab took Fortier and her friend back to Boston, they walked back to her car, they drove back to New Hampshire.

Says she next got contacted on 6/16/13 Sunday at 4 p.m, when they asked her to babysit that night. Fortier didn't have any further conversations with AH about what happened on Friday night/Sat morning before murder. The babysitter was paid given $250 for babysitting for 4 hours the night of the murder. She typically made $20/hr.

On Cross Exam:
Fee points out that Fortier never spoke to defense attorneys throughout this process. Since September 2014, Fortier says she has met w/police, prosecutors more than 4-5 times. Fortier did not testify before the grand jury. She interviewed with authorities instead.
Fortier on cross exam says it wasn't unusual for AH and Shayanna to pay her more than $20/hr base pay.

Christopher Ritchell, AT&T employee:
Works on cell sites. Registers customer complaints and 'Keeper of Records'. Ritchell IDs records from AH AT&T phone. Record regarding cell phone account in Shayanna Jenkins name from AT&T being shown. Records show phone calls between Shayanna Jenkins and Ernest Wallace phone at 5:55 p.m. 6/16/13

This is a great thread. As obvious as a verdict may seem, you never know what the jury is going to do. There is always a chance AH could get off.
