Congratulations america! Very glad to see this but why are a bunch of states being assholes and not let LGBT people get married? It's a disgrace and disgusting to see. And yet here in EU in Italy they voted against it also another disgusting sight to see.

Political grandstanding. I'm not an expert in these matters, but I read that technically the losing side of the case has a few weeks to ask the Supreme Court to reconsider their ruling. There is absolutely no chance that they will reconsider and the people who are holding up gay marriages know this. They're just doing this so that they can claim to their political base "ah stood up to the tyranny of the librul courts" or some such bullshit.

He is correct though. No matter how inhumane the treatment, our right to be treated as better does not go away. We never become less just because we are viewed or treated as less.

The problem lies with the conclusion he wants to draw from this assertion.

Essentially he is saying that since all men are equal and will always be thus, it is okay to treat some as less since they will still continue to be intrinsically equal.

You're misreading his opinion. The primary point he makes in that part is that "the Constitution contains no 'dignity' Clause." Thus, the effect of a law on "dignity" is not a basis on which the law may be struck down. His secondary point is that, even if dignity were a proper subject for judicial review, dignity--like liberty, in his view--is something to be protected from government, not something that is bestowed by government. Thomas views this as significant because the plaintiffs in this case are seeking to access government recognition of their relationships and the benefits that flow from such recognition--i.e., they are seeking something that is bestowed by government. To seek a grant of dignity from the government, he writes, "inverts the relationship between the individual and the state[.]"

It should go without saying that when Thomas says "dignity," he isn't talking about "equality," as your paraphrase suggests. His dissent doesn't discuss the Equal Protection Clause, nor did it need to, since he joined Roberts' discussion of the same.

Yo this dino needs some colors. Would you kindly?

DON'T DO IT! If you do it, it means you're subject to his mind control!

Just came in to say how damn happy I am about this. If I ever decide to have kids I can look them in the eyes with pride now. Congratulations to all Gay couples across the country. You deserve to be just as miserable as anyone else damn it! :D

three things

1. That GAF logo is amazing. AMAZING. Please keep it forever.
2. Is it possible to invest in salt? If so, some peeps are about to make a killing.
3. I'm giving every friend I see a hug to commemorate this glorious fucking weekend.

By the way, from the first frame of the OP:

Massachusetts leading the way.
Best state setting the tone for the rest of the country.

Seriously, considering it had been legal for where I lived for over a decade, it was strange seeing other states dragging their feet on it.
But, hey, they got there eventually.

These are pictures from legalization of gay marriage in each jurisdiction.

These are overwhelming with feels. In another post, someone mentioned that there are elderly same sex couples who have been together for decades and this is their moment. This moment should have happened a long time ago.

I'm so happy. My best friend once again shows me how mature, compassionate, and brave he is. His open support of gay marriage is much appreciated by me, someone who's not even brave enough to come out. I once told him that he's like a younger brother I always want and I wasn't wrong.

In that case then its fine.
To me tolerance is a compromise sort of thing. Like "Well ok we will allow you to exist for now". I know every little victory counts but it seems like such a hollow word to describe something.
Due to English quirks, you use "tolerant" to mean "accepting of minorities" when referring to societies. It doesn't necessarily have the same connotation as when the word is applied to people.

LMFAO

also, cheers Connecticut for not being far behind. It was the third state after Mass and California, but it was never repealed unlike Cali. Around here its like old news.. gotta love New England.

Yeah, New England in general is clearly the best part of the country, and what the rest of the country should strive to be.

Oh god, I had to wear socks with sandals yesterday. I knew it was wrong, but I am visiting my brother and quickly slipped on his old sandals to go walk the dogs. I left my socks on... what have I done? I'm a terrible gay. :(
what kind of gay dude doesn't know that prada gave you the ok for this a couple years ago?

Ah, "tolerance". So often code for "I don't like you but I won't actively campaign against your existence anymore".

Unfortunately (or fortunately?), tolerance will be the name of the game for treatment of LGBTs for some time to come. Widespread acceptance will take more time.

It's probably not the best word for it, but typically 'tolerance' is synonymous with 'acceptance' in this context.

Funny how that works.

I'm never letting go of the fact that Michigan straight up banned same sex marriage and was one of the last few states that never legalized it...

This state really confounds me with it's identity issue. Like it wants to be a southern state, but not really, but kinda... but not really though. I hate living here.

Gone over this already. You're choosing an interpretation of tolerance based on what it *could* mean if you took it that way, but as always, its important to put things into appropriate context, and within civil rights issues, tolerance has generally been sort of synonymous with 'acceptance'. Civil rights leaders themselves will proclaim to 'preach tolerance' after all.

I do agree acceptance would be technically be a better term, but I think you should understand what somebody means by it before arguing against them.

"Back when the oppressed were fighting for a modicum of baseline human decency, they didn't have any problem using the term 'acceptance' even though they knew they'd still be hated by swaths of hateful people. Why can't you?"

Yeah, I personally can't wait until Texas is forced to comply with this ruling. Currently, many counties (I actually can't name one that isn't doing the following) are still not issuing same sex marriage licenses because they "need new forms" and/or "are waiting for official word from the state government".

Everyone is giving Justice Kennedy props which he deserves; his opinion is no doubt going to be remembered fondly, even decades from now. Certainly, without his vote this ruling would not be possible.

That said, President Obama deserves an equal amount of praise here, as do Justices Sotomayor and Kagan. For example -- had McCain won in 2008, it's likely that now retired Justices Souter and Stevens would have still stepped down at some point in his first term. McCain would have then nominated two people who are just as conservative as Roberts and Alito. Yesterday's ruling would have most likely been a decisive conservative 6-3 vote against same-sex marriage (with Kennedy, Ginsburg and Breyer dissenting).

You can also thank the Republican party's eternal Lord and Savior -- "The Gipper" -- Ronald Reagan, for nominating Kennedy.

So yeah, THANKS OBAMA... and Reagan. :o

Also, let this decision be a lesson to anyone who states that a Presidential candidate and his/her potential Supreme Court nominees are "not that important" -- this is just fundamentally WRONG. It can be the difference between millions of people keeping or losing their health insurance, and landmark decisions that finally settle the score on whether the country as a whole should embrace or reject same-sex marriage. There are not many things a President can do *cough*short of enacting health care reform*cough* that would leave such a lasting effect long after he or she leaves office.

Bunches of counties were handing out licenses. Tarrant, Travis, Dallas, Harris, and Bexar -- most of the biggest counties -- were handing them out. It's mostly rural counties that have been "waiting for new forms" like Denton, Johnson, Parker, and Wise. Not that surprising given their rural centers and bad direction from the AG's office. The majority of those will start issuing on Monday.

I'd ask for a rainbow avatar, but something tells me Jimmy wouldn't have been too keen on it. He was a man's man of an era where this kind of shit wasn't tolerated.

I'm kidding - he was heavily rumored to be gay, despite being a "ladies man". Studios supposedly forced him to go to brothels to prevent his lack of interest in women from becoming headlines. He was also openly gay with friends apparently.

I wonder the people that agree with the judges that voted no, can't being themselves to post on gaf becuase of the logo.

Who is that?

The GAF logo made me shed a tear. I went out last night to celebrate and had an incredible time. Yesterday was an unbelievable day.

I got a call from my mom when the ruling hit. She was in tears because she was so happy for me. Even though I'm no where near the point of marriage, but just knowing I can made her so happy. Was surreal for me.

Anyway, glad to witness, and be a part of, such a huge moment in history.
