The real question is why don't you sign this deal with ABK or MS regardless of this going through?


I was about to ask the same thing. Did they not know what they signed or something? When their deal was announced it read like they were going to get access to everything Microsoft have ownership of - therefore that should still be the case minus the ATVI content.

Did they really only sign something that was conditional to the deal going through?

At least they are now free to put their business locations back to their original (and correct) places though.

Looking forward to the Defining Duke podcast on this one. Matty has mostly had his head on straight when it comes to the state of Xbox, but Cog has been going off the rails a little more each time.

And yeah, they are only risking increasing their penalty to ABK. This appeal won't do any good.
Any appeal will lead right back to the CMA, which will certainly be met with another "Fuck you, we've made our decision. Take it or leave it". They'll be running in circles. The CMA functions as its own court, it will drag on forever, cost potentially billions more and lead to similar outcomes reaching a dead end street. Microsoft underestimates the power the CMA possesses as an regulatory entity, especially in the UK, which is CMA's own turf.

Considering the fact that they have seen and experienced first hand how games tend to turn out under Microsoft's management I can't quite work out why thats what they would want. Surely third parties would be better off staying third party if you want the best chance of experiencing high quality games?

But no, that's not what it's really about. That's not what any of this has ever really been about for them unfortunately.

And supposedly when it comes specifically to antitrust concerns, the CMA has never been successfully appealed.

Didn’t the CMA already hear from Boosteroid during this process? I am confident that the CMA was aware of Boosteroids stance prior to this decision.

I don't claim to know how the appeal process works and I also don't know how much of the cloud deals MS were making had these regulatory bodies involved.

Interestingly, the EC seemed to have given the go ahead in terms of their satisfaction for the whole cloud issue earlier this year. If they approve the acquisition based on cloud while CMA is denying it, that's gonna be a fun impasse.

And to finally end the discussion about Sony being the only one against the deal:

- MLex says that only Sony and an undisclosed third party agreed with vetoing the deal. But the final report notes that four other third parties were supporting a block. A fifth said it would be appropriate if a behavioural remedy wouldn't work. Thanks to @gofreak for the correction.

I would expect every company that stood to gain from the acquisition is going to disagree with the CMA. It really sucks for them but maybe MS can still work on deals to bring Xbox/Game Pass games to those services.
Probably useful ammo in the appeal process.
No, the deal was about ALL Xbox games. So services like Boosteroid should still get all current and future Xbox games for 10 years. Why would Microsoft backtrack if their goal is to "make games available to more players?"

Boosteroid just wouldn't be able to get Activision games via this deal. But they can always strike another with Activision for only those games.
 
I don't know much about big business (so grain of salt) but I suspect the deal will eventually go through. There were already several roadblocks in this deal that MS was able to get past and this is likely another one, very likely in appeal they will find remedies the CMA (and likely UK if they share the same concerns) will accept. Their ruling comes off as weak since Amazon and Google didn't do poorly in cloud gaming because of MS or even Sony or Nvidia. They tried to sell consumers bad products that nobody was interestested in, and it should be clear.
