Not really, I'm seeing a lot of disinterest in Microsoft taking Activision under their wing, but they are the ones most suited for the job.
If the goal is for Activision to become a deadline missing, shit game producing and poorly managed footnote about to be consigned to the annuls of history, then I agree 100%.
 
I think it's safe to start predicting Microsoft's next move after the injunction is denied. Immediately close the merger and go to "war" with the UK or use it as a boost for getting an extension with ABK and go through the CAT process?

They were listed in the 'exhibit K' email. Guess you consider that part to be just a thought experiment.

I find this part particularly funny. Ryan says that it is beneficial for third-party developers to have exclusive deals. Well that's great, but isn't the whole discussion about defending consumers ? How is it beneficial for Xbox/other consumers to not have access to the next Final Fantasy game when the exclusive game is actually one from a previously multiplatform series ? Sadly we will never know, as his testimony was only a video.

The other point is : if it is beneficial for developers, then being bought by a big company like Microsoft should also be very beneficial for the exact same reasons, as it will reduce the development effort if the game is released on less platforms.
This question -not the discussion- was to know why it's good for the third parties to make exclusives. Not every single question has to be about the consumers, this time was about the devs and their incentive to make exclusives.

What he said was right, but I think it would have been a better reply to add that even if both 3rd party (external deal) and 1st party (acquired) exclusives are exclusive, but only in the case of 3rd party deal case the platform holder pays to the dev enough to compensate the revenue loss of making it exclusive.

I do feel like MS hired the big guns to represent against the FTC here... makes me feel like they are hopeful against the CMA if they are going in this hard in the US. They could have just come to the table with basic defense and said well damn we tried.

There is a reason they are used for fear and uncertainty and not Apple. Where King would be just as attractive to them if it truly is about mobile SLC.

Those e-mails, as I understand it, were from 3 years ago. While Microsoft obviously wouldn't want to try and buy two publishers at the same time, there were still opportunities outside those purchases to do so. So the question begs, why didn't it happen already?

It's possible it was all bad timing for them and other deals. But, Microsoft has already shown that they won't just spend any amount of money to get what they want. Sony basically outbid them on Bungie. So, did Sega ask for more money than Microsoft was willing to pay? Did Sega outright refuse them? Did the stricter Japanese control of foreign investment, which went into effect the same year that e-mail was made, interfere with their ability to buy their shares? Did Microsoft's higher ups turn down the idea? As far as I know, we didn't see what the answer was on the request to pursue them.

All we know is that they were targeted back during the start of the generation, but nothing materialized. Either they never pursued them, ran into serious difficulties, or Sega declined. That being said, I was surprised to see that Sega was the greatest extent of their ambitions 3 years ago. That Capcom, Square Enix, Bandai Namco, or any of the others were apparently not really considered.
 
My head will never get past this nonsense about Nintendo not competing in the same market. It's simply absurd.
They're game consoles. You walk into Walmart.. they're in the same fucking corner. WTF does compute power have to do about it. That's just a lifecycle choice by nintendo.

So if Nintendo releases a console next year that is more powerful than Xbox and PS5... it just created a whole new market?
I would argue the switch is almost 100 percent a handheld... i mean sure you can dock it.. but its pretty much just a handheld

What's the point of Sony blocking games on Xbox if they don't sell on Xbox to begin with ? Pretty poor investment, if you ask me.

No, it was forced so MS and Activision could have a decision before the merger deadline of July 18th. The outcome of this trial will determine whether they close or agree to an extension as they continue to appeal against the CMA, however, if this preliminary injunction is approved, then it's highly likely this acquisition is over.
 
MS can't close the acquisition, the CMA already killed it.

thats untrue. they can close. meta closed giphy even before CMA approval.
if the CMA appeals fails, MS has options. you heard about the ones about activision carving out the UK, yada yada yada
or they'll let the CMA take them the court, just like the FTC did.

For the same reason that when a regulator of a country approved it the rest didn't go to approve it.

Each market has their regulator with different processes that they have to follow and complete independently of what other market regulators say.

The acquisition can't be completed without the greenlight from all of them. The CMA didn't give the greenlight so it's over. But they have to continue the process in the remaining countries (USA isn't the only one, I think there was a couple more pending at least some weeks ago).

Regarding the CAT, as far as they know they can't revert there the CMA decision. They will only discuss there about if the paperwork was done properly etc.

The evidence we have is that Kotick approached some big tech companies from USA to see if they were interested to buy.

Regarding MS, we know that a few days after ABK had that shitstorm harassment scandal Phil sent a mail to the MS employees saying that he was going to review their relationship with ABK. And 2 or 3 days later called Satya and made an offer to Kotick to acquire ABK.

The more I hear from this the more apparent it is that between the judge, Microsoft's lawyers and the FTC, none of them actually understand anything about how this industry works or what its products are.

It's actually very interesting to hear both sides make arguments with such a modicum of understanding, but of course their knowledge of the law is what is most important at the end of the day.

It's hard to follow what's going on because we can't see and it's pretty boring but I'm pretty sure said 5% of PS users would switch but 20% of COD players.
 
They act like Sony's not allowed to have ANY 3P exclusives at all unless they just outright buy the publisher. Does this lawyer have any idea whatsoever that 3P deals are considered FAIR rules of engagement by many regulators? Including those in the United States?

She is wasting the court's time. Kick her off, move on to another argument worth having an argument about FFS.
