Careful bud. MS got exposed on a lot of shit through this. The FTC has dogshit lawyers who apparently don't know how to properly weave a narrative. No matter what the judge decides, there's still fallout from these revelations to deal with and they still have to contend with the CMA.
I dont understand why people keep saying exposed.

Its as if people don't think that massive companies like this make merger and acquisition lists to see who they could buy to improve their place in the industry. Do people not think Sony makes these lists? Do people not think Sony has emails and shit like this around?

The main issue with the FTC is that they should have not used Sony and Jim Ryan as their sources- they should have said- this merger reduces choices by making people have no choice but to go to game pass because they dont have to spend 70 bucks. These guys keep using the harm to Sony players- stop saying sony- say the consumer has a reduces choice. Thats all they needed to.

Yeah- It seems scummy reading some 4 year old email where an exec wants to "destry" the competition. Aint nodbody complaining when Sony was doing some petty ass shit from last gen did they? The FTC has to prove or provide doubt that this merger is bad for the consumer. All they have done so far is say- this would hurt sony's player base.

Because the lawyers were clueless and didn't know for certain but there are surveys done for this case out there with that percentage.
I heard the full hearing from Professor Lee, the creator of that number and statement. This what you're saying is even more clueless than his inability to defend and prove his point.
 
Now he implies skins are included in the base version like a sane person and their lack would devalue other purchases. I wish reality was this good.

At the end of the day... not matter the outcome, it's pretty clear gaming is kinda fucked, like we'll get a good 4-6 years when all is said and done.

But with all documents and emails and depositions etc it's pretty clear things are gonna get crappy before they get any better and by that time I'll be in my 40s. Think I'll be OK with giving up the Controller then.

It's going to get nasty and whatever precedent is set here (most likely that nothing is going to stop Microsoft from doing what they want and be regulated) is going to have lasting effects on the industry.

Either studios are just going to die because they can't sell with stricter rules or Microsoft are just going to outspend their competitors from the market to create essentially a stranglehold (which they've confirmed is their goal)..

Honestly I'm hating Microsoft for starting this shit, they didn't need to be absolutely cocks and go overboard. nothing good comes from this, once precedent is set it's extremely difficult to undo

judge adopting redneck arguments about buying a publisher and turning multiplatform ips into exclusives is the same as first party bidding for third party content that remains third party

LOL you do realize my arguments on the PC strategy is counter-productive to Sony's own strategy (at least around the last time they evaluated it)? If I were carrying for them, I'd be non-critical and just coming up with reasons why it's such a good move, no excuses.

Here I am criticizing one of Sony's strategies and yet somehow that's me carrying water for them 😂. I'm just speaking about what would be best for the PlayStation brand in terms of the console, which is the main part of that ecosystem. This particular argument doesn't factor any impact on my wallet, that would only happen if Sony decided to raise prices and even then, it'd have to be for stupid or greedy reasons.

Does anyone on either side (lawyer, judge, etc) know anything about the industry? I'm not watching but judging by the comments it seems like its a bunch of retirees who don't know how to work a cell phone lol

This judge is 100% paid off. Last hope for gaming is the CMA. The U.S judiciary system is too corrupt.
It's hilarious during this whole year + process. First, Brazil was corrupt, then it was Saudi Arabia is corrupt, now the FTC is corrupt. Then the CMA was corrupt until they blocked it, now they are the only ones that are not corrupt... So, when the CMA loses are going to be corrupt again? I can't keep track lol

Microsoft cant do much if Apple Amazon or Google start Looking at the market.

TBF Microsoft did not start these consolidations; Embracer Group was going big with them (mostly smaller studios though), and Tencent were buying shares in a lot of companies.

But Microsoft did technically kick off this idea that buying large 3P publishers altogether was okay. And yeah, better believe other big tech companies are looking at the proceedings here to see how they can move with their own acquisition strategies in gaming.

And, obviously, Sony will also respond with more publisher acquisitions. Even Nintendo might try acquiring one, or at least more 3P developer studios. There's a small bit of hope that given the scrutiny MS have gone through for this, they basically are demotivated from making further big 3P acquisitions and stick to working with what they already have. And, maybe it makes other companies a lot more cautious with the idea of wanting to do big gaming acquisitions of their own.

That is a hopeful outlook, but that could easily not happen, too.

That's a part of it, won't lie. Not due to brand worshipping, but because I understand the actual value exclusive content brings to a platform culturally and in terms of reinforcing the value of that brand in the market. Again, we see this in practice with Nintendo.

However another reason is because Sony could in fact drive down demand for their own hardware if cross-pollination between console & PC gaming audiences are to a point where they unable to drive value to the console to support sufficient sales. And, that affects things like what type of actual software the platform holder can make, if sales revenue on PC isn't enough to make up for the revenue drops elsewhere.

So, I'm looking at it as part gamer, and part business.

We've heard this since 2010 and they've Still yet to enter.

Both Google and Amazon tried streaming and one is dead and the other is dying.

It's just not a good enough argument anymore
 
Reading along just here, it sounds like the FTC did a spectacularly bad job at establishing the importance of gaming generally, and Activision games in particular, to the judge. Which is really hard to comprehend because they had to know, from day 1, that "what's the big deal, it's just videogames" was always a major risk for their entire case.

We will probably see further smaller studio acquisitions and maybe one bigger japanese dev/publisher play if they can somehow pull it out of their money holes.
 
Judge doesn't even understand what's the purpose of this case, and doesn't understand the regulatory process, or at the very least is highly dismissive
