CMA didn't choose to do anything. MS is going to present a restructured deal and CMA has to consider that. Just part of the process.
 
Hard to say what MS can come up with to satisfy CMA or what CMA can ask for as this cloud thing is still very young, so many permutations with how it unfolds with new or existing companies. I doubt MS will be too worried, possibly will be minor change or a stipulation too ambiguous to matter if and when cloud gaming becomes big deal.

You're talking about something different from the post from adamsapple adamsapple that I was responding to. He was saying that divestiture of cloud would be removing xCloud from UK, and that's what my response was in regards to.

What you're saying is something different, as you're talking about Microsoft still having xCloud in the UK, but separating it from Game Pass. How does unbundling xCloud and Game Pass help with the Activision acquisition when the CMA has blocked the deal over the cloud gaming piece? Even if Microsoft makes xCloud and Game Pass separate products in the UK, this wouldn't change the CMA's decision as they are concerned about the cloud gaming market.
 
I am interested to see if Activision chooses to extend this on the 18th. If they do, then I'm going to bow out of this thread until something actually happens as it'll be several more months (most likely) of court cases and appeals. If Activision doesn't extend on the 18th, then I'll get my popcorn and watch the show.

If they do, would they have to resubmit worldwide and not just the UK?
 
Plot twist: the 18th comes, the deal doesnt get extended, Tencent swoops in with a $120 billion offer that gets accepted. People realize that they have trash talked other console warriors for 1 1/2 years for nothing.

I can only assume that a potential restructure would remove Activision games from Xcloud, removing the CMA's concern that this acquisition would see MS establish an unassailable position of dominance in the cloud market.

So it would certainly sting.

At this point would be better if all big pubs goes to Amazon, Meta, Alphabet, Apple and Tencent and nothing goes for Sony and MS.

I think they would be able to. The rest are a lot smaller. And they don't own IPs that considered as 'important' as COD. Maybe they have to make promises to keep GTA everywhere like they do with Minecraft and intend to with COD (choosing my wording carefully because people are kind of sensitive over whether they will or won't)



I'd say focus on some devs with talent and hot games. . I've already said they should buy CDPR based on their relationship. They should also grab T2 just before somebody else does. Because they are a hot publisher to own like ABK. IO interactive would be a good fit,that would design some really good single player games. and I think they will acquire GSC shortly after stalker 2 releases.



I think it's worth buying BioWare from EA too. I wouldn't buy EA, but certainly come to agreement to buy BioWare and it's IP.

Yes, there is reason to pause it and both CMA and Microsoft agreed to do just that. It doesn't matter if you are "sold" or not.

Yes, the expert testimony from the economic consultant did little if anything to support the FTC's case. Now, is that all the FTC brought forward or is that simply all you want to focus on?

FTC isn't out of the way and are still blocking the deal. The previous case was about a preliminary injunction which it looks like CMA have just created their own version of.

But removing Activision games from xCloud results in consumers having less choice. So this "remedy" is actually worse for consumers than just blocking the acquisition entirely. If it is blocked entirely, then Activision can put their games on whatever cloud service they want. Microsoft isn't going to pull Activision games from xCloud and then turn around and provide Activision games to all competing cloud services. If they are forced to remove Activision games from xCloud, then this acquisition will result in zero Activision games coming to cloud. Blocking the acquisition is a better option for consumers in that case.

It doesn't conflict. The EU was simply happy to accept the 'lesser' remedy, so to speak, of the ten year licensing deal.

You can have different commitments in different jurisdictions.

Either we'll see a new CMA investigation with all that filthy laundry out in the public eye? OR Activision takes the 3 Billion and tells Microsoft they've taken too long as stipulated in their contract. It's going to be fun either way.

Aside from tencent….. I don't think apple, Amazon, meta, Google, care much for buying any of these pubs. Especially not apple. And they couldn't give a rats ass about the console market when they would rather sell games for the mobile devices on their own app stores. Console game publishing,are the least those companies are interested in. If anything they see consoles as competition. They would rather you play games on their devices and OS, on their stores. It's probably because they would be expected to make console games that they probably avoid buying these kinds of publishers.



It's really just tencent and embraced group…… or MS. As far as the big boss baller money players, that is….

100%. Nail on proverbial head.

And that's exactly what MS will argue.

I'm obviously just chewing the fat here. I have zero idea what's actually being proposed or reconsidered. Restructuring a deal suggests fundamental changes and, off the top of my head, I can't really think of anything (other than separating Activision and Cloud) that isn't just a different type of remedy.
