so the future are the services and the cloud according to the judge? I missed something because I didn't read the whole thing, but this decision doesn't stand imo

This reads like a Judge that agrees with Microsoft that consoles need to go away and the cloud is the Future of Gaming.....

Nah in 20 years everything will just be service apps. It's basically already become the norm for media. All TVs are smart TVs now. Hardware is getting smaller and faster. The line of skill / budget / time vs graphics is hitting gaming hard now. The writing is in the wall for both dedicated console fans and physical media fans.

The point is Microsoft is delaying on its own by asking CAT to pause the appeal. So there really is no need to disallow FTC a stay because there is literally 0 harm in that.

It's not like Microsoft is planning to close the acquisition illegally over the CMA, isn't it? 😉
That's the thing about it all. Both the FTC and CMA are worried about losing in an actual court case but they think they can work together to delay so Activision pulls out.

When the CMA blocked the deal on cloud gaming the FTC gained leverage. When the FTC lost, CMA lost leverage.

It appears to me that the judges so far have been aware of these delay tactics. Which is why the CMA failed to get and extension and the FTC failed to an get injuction

And both have made the argument that it should be delayed because the other is still investigating instead of using their own merit.

Why do I need to sell my Xbox to get a Switch to play a catalog which I will be getting via game pass ?

It's not about gamepass, this whole discussion regarding the switch has never been about gamepass.

This is about whether the switch version of COD will be technologically sound compared to the Xbox Series and PS5 versions. You're insistent that it will be, so put your money where your mouth is.

I really hate when I launch Apex on Steam and it still opens EA desktop. Same with Jedi Survivor. Is there no way around this?

That works both ways. The FTC could have filed a long time ago as well

MS never extended the deadline. Either because they couldn't get ABK to agree, or because they thought that, somehow, the deal would be done before then.

Are you now going to tell me that the "native" version of COD on the switch will in fact be the mobile version? Or will it be the same game that exists on consoles with crossplay etc?

I think the judge had a point though. If the FTC said they were suing to block, why wait til end of June and conveniently when Xbox is rumored to threaten to close to take em to court. They should have done that earlier this year. I side with the judge that they were using the deadline of July 18th and the courts ability to do a PI to kill the deal entirely.

That doesn't seem ethical given they announced this in December of 2022.

It's sad that you have so many issues with PC because for me the moment my consoles stop taking discs and cartridges is the moment I go to PC full time, no point in paying for online and having to buy only from one closed and overpriced store.

I do think Sony will keep supporting discs at least for the PS6 because they get paid for every blu ray. I also think Nintendo won't leave physical behind just yet. I have very little interest in xbox as a console anymore.

I agree with u but I hope at least pc master race stays as an option of dedicate local hw.

But right now infrastructure is a shit for cloud worldwide and latency still a problem even for entreprises. Mayve in 20 years they will solve that. Doesn't matter if works great in 5-10 countries. They need scale.

But, again, ABK isn't pulling out, is it? If there was any risk of ABK pulling out, why would Microsoft ask CAT to pause the appeal and potentially add 4+ months to the whole thing?

It will be a version tailored to its respective hardware. Literally no one expects them to dump the 300GB PS4 version on Switch carts in a 1 : 1 capacity.

I have no problem with PC... at least not in the post you quoted. I have 600 games on steam.... + other stores :P Anoying to see some of them be modified though....
console is the last bastion of physical games and I don't like seeing it die.

MS and ABK, despite also being blocked by the CMA, which is notorious for taking a long time to ultimately still say no, were not extending the deadline. The FTC probably anticipated that they would when the August date was set and the CMA already said no. When there was no extension movement and word started that MS was looking to just close, that's probably when they jumped. The onus is not on the regulator to ensure sufficient time. To which there was, for them to renegotiate a new timeline.

If I ever decide to get a Switch, I will surely consider at least game flying it. But since I already have an Xbox and GP, it's not an immediate concern.

Who said anything about need? Releasing CoD on Nintendo hardware is just something they weren't doing, nor did we have any indication other than Kotick's "we'll consider it" that it was going to happen.

With the acquisition, we *know* that it will happen.
This was more than likely due to hardware limitations than anything else. If it's actually on the Switch then it will take more than a year to develop it.. So all signs point to ABk already having plans to release on the new Switch console.

So you're saying the FTC expected an extension? Why would they hedge their bet on that? They have no inkling of the inner dealings between Microsoft and ABK. If they had a stronger case, they should have gone to court immediately, giving Microsoft less time to prepare for this.

The fact of the matter is that the case was not strong to begin with, and they were likely relying on the regulators to stop the deal. I'm sure they didn't anticipate Microsoft considering a nuclear option. However, if a strong case was presented, the FTC wouldn't have to rely on the judgement from the CMA, they could have stopped the deal themselves.

Well, I can't vouch for what every user said but my post history is pretty transparent. I've also maintained that when they (MS) say bringing the games to Nintendo hardware, it likely means the next one. Not the current one.

I guess the main question is who gets to decide to pull out of the deal or not? Cause if it's just Bobby I would expect him to pull out of the deal the minute he gets a chance to. He did not seem like a man who wanted to sell. On top of that he comes across as someone who likes being the CEO of one of the largest game developers in the world and the #1 selling game year after year. That title comes with privileges that no amount of money is going to get him.

The FTC set the administrative court date many months ago. The ball was then in MS's court to decide how to proceed. EVERYONE was waiting on the CMA decision. When they said no, the FTC likely thought that was either the end of it, or that the deadline would be extended because of how long it takes to argue with the CMA. MS, knowing both situations, did not extend. The FTC started hearing that MS may just close. They were likely caught off guard with the situation or Lina Khan wanted to use this somehow, so they jumped. No matter how you try to slice it, MS knew months ago what the situation was and either wouldn't or couldn't extend.

The strength of the FTC case is irrelevant to the point. Blaming the FTC for the timeline of events is absurd.

I agree with your sentiment. These companies have tons of money to blow bow but this will not last forever. Disney plus, for example, bleeds a billion every quarter and Disney only has 10b cash on hand. Stadia. Luna. Netflix has never been profitable and only exists because of stonk hype and ever decreasing interest rates on loans.

The streaming rent everything model isn't working so well, but companies are still fighting for dominance within the sphere.

I read that ftc asked for a stay and that must be granted by friday. I'm not understanding anything, I don't even understand if it's this ninth circuit that has to agree or the judge who denied them the pi lol what's the point of asking judge corley
