There's no expiration of the contract per-se - I believe that's what

was commenting about earlier..
There's a deadline, and once the deadline has passed, the companies can elect to terminate the contract.
If you want to continue to refer to the contract as "expired" - that's your perogative.
Based on what I can tell - the contract will continue to be in place until either Activision or MS elect to terminate.
They can also potentially elect to amend the contract - but there may be some limitations as to what they can amend, etc. I expect that if there are any discussions happening - it's about the amendment details.
Until we see a formal notification by either company that they've terminated the merger agreement - then it appears that the contract is still viable ...
