Eh, it may have been a footnote but I don't think a single game is big enough to have a rippling effect in a court decision like that. The FTC lawyers did a poor job of making their case, I think a majority of people who actively participate in this thread would agree to that.

So, I guess that means the CMA has now received the revised proposal from MS ?

That sort gets me thinking about the full 4D chess screw up by the CMA. They've already served Sony up from their pre-emptive decision making backdoor dealing, making the market even less competitive before the deal even closes and even in making that major mistake, that gives some small form of market protection for 8-10years, they are still showing cowardice to fight the JR on its merits to "powerful" arguments - with effectively nothing to lose, given that their concessions are nothing and protect no one compared to the damage being done from the deal passing.

Who on earth would become a barrister for the purpose of arguing the merits of things, then take a job as the senior legal authority at the CMA where arguing on merit in the big leagues is guaranteed, and then when they get the biggest case of their life, go missing in action?

Am I the only one that sees them pulling out of the tackle is the only truly bad outcome, now? because it makes the CMA look weak, powerless and cowardly too IMO.

I think it boiled down to a few things.
1. MS is not a monopoly in gaming, and still won't be after the aquisition.
2. MS is keeping COD on PS.
3. The FTC was basically just trying to protect Sony's dominate market position, which the judge actually called out.
4. The judge was well aware of Sony paying companies to keep their content off Xbox. Sony didn't come off well during this hearing, and it's why you saw Sony not mention the word "exclusive" during their showcase.
5. The reality of competition is companies fighting each other to convert each other's customers to their own product.
The FTCs witness stating that if MS made COD exclusive it would cause some PS customers to move to Xbox just points out how it makes more competition not less for MS to buy ABK.

The big mistake alot of people made was that they believe the aquisition is bad as it is moving towards consolidation in the industry, while that isn't forming part of the court case.

And the biggest reason other than the fact that there were no grounds to block it? The FTCs lawyers were terrible. Basically the FTC hired Lionel Hutz to argue their case.

I certainly will. I want more exclusive content on both consoles.
Let's have a totally different gaming experience on the Playstation than we will have on the Xbox.
Having a situation where 98% of games on both consoles are the same, and maybe 2 or 3 first party exclusives games a year on each is pretty shit.

The only issue for Sony is that it doesn't have the ability to buy one of the big publishers like EA or T2. Not only that, but the board of those companies have a legal requirement to get the best deal for their shareholders.
Say T2 was looking at selling, and Sony put in a offer, the T2 board wouldn't just accept it. They would approach all other potential suitors like MS, Amazon etc and get them to all bid against each other.
The problem for Sony is that some other companies have the ability to out spend them for it.
If you don't think that's true, remember when Codemasters agreed to sell to T2 for a certain amount of money and then EA crashed the party and offered Codemastera more money than T2 was offering? Codemasters didn't say "oh, sorry EA we already agreed to do a deal with T2". No, they had to accept the higher offer from EA as they have a legal responsibility to get the best deal, and the shareholders would never have voted to approve the deal knowing they had a better offer from EA.

Now, that doesn't mean that Sony would always be beaten out. All companies do their due diligence to value the company they are looking at, and they won't just offer a larger amount to beat out Sony. It would have to be worth it to them from a ROI point of view.

We still don't know if Amazon, Apple or Google are going to make that leap into console and PC gaming yet. Apple is already big in gaming through the IOS game store, and both Google and Amazon have flirted with gaming already.
I think Google have got burnt and will stand back for awhile after Stadia.
Why both Amazon and Apple haven't bought a big publisher by now I really don't know.

That would certainly be something. While money talks, I doubt Gabe sells out to anyone other than Microsoft. He seems to have a soft spot for his former employer.

I think a MS acquisition of Valve would be very hard to get past regulators with Windows already dominating the PC landscape.

As a fan of Sony's games, buying Valve/Steam just seems to suck. They hardly make games. A storefront is boring. But it provides tons of PC third party revenue, so Sony would really be cornering Microsoft on the PC/Console market.

IDK, regulators seem to fold like a deck of cards when politics come into play.

Who knew owning Giphy on a social platform was more industry disruptive and shattering than buying the top 3rd party publishers as a platform holder.

Yeah.....no idea what to expect anymore really. Just hope Valve remains independent post-Gabe. Certainly wouldn't want either Sony or Microsoft taking over PC gaming.

Really? I prefer Steam's storefront to most. Not the best looking, but definitely tons of features. Love the support forums.

It seems consistent with older valuations of the company in the Wikipedia entry and equity of the business in 2019 being around $10b.

Certainly would hate to think this was retaliation rather than a strategic move for when consoles runout of meaningful next-gen runway, which is on the cards sooner rather than later, but even if it was a move and it convinced Microsoft to abandon their ATVI merger, it would be hard to argue - Sony as $140b vs Microsoft $2.7t consolidation war - surviving and trying to kill Windows gaming in the process might need to be one in the same thing for the next 10years.

Steam being available on PlayStation 5 at reduced RX5700 settings and Sony doing their own range of Steam Machines and bringing steam to MacOS could really give Microsoft's 95% dominance in the PC gaming OS some healthy competition. I suspect they'd have some deal that would take them even closer to Epic, too.

Consolidation sucks, but using the misassigned quote from the other day: "Play silly games, win silly prize", would certainly apply if this was a deal, happening as a result of the ATVI merger.
