Xbox Store emphasizes digital games are licenses, not ownership

Microsoft has started to make it clear that users acquire a license to use digital games, not the games themselves. A new disclaimer appeared on the page. Silent Hill in the Xbox store, which sparked discussion among players. It is now explicitly stated that purchasing any digital product is not property, but the right to use, which can be revoked.

This change, according to users, is related to a California law that came into effect in 2024. The law requires platforms to explicitly state that they provide access under license, rather than selling digital products in the traditional sense. The law also prohibits the use of the words "buy" and "acquire" without further clarification.

Although the requirement formally concerns California, Xbox decided distribute the disclaimer throughout the store. But this doesn't solve the main problem: DRM-protected games may become unavailable at any time, if the publisher shuts down the servers or removes the game. This is especially true for subscribers. Game Pass, where the list of available games is updated regularly, and notifications about deletions are given only a couple of weeks in advance.

Not just 'licenses'.

Digital games should always be cheaper than their physical counterparts, since there's no manufacturing, pressing, shipment etc. The cost to the publisher is lower.

The fact that games are sold at the same price digitally as they are physically, and it isn't fussed over, has been fucking us over for decade(s).

every store does that somewhere in the small print, because they have to... however,
what needs to happen is a regulation that forbids online stores from wording the button that "buys" the game to say "Purchase", "Buy" or any synonym that is typically used to sell a product.

any store that isn't GOG and/or doesn't sell an infinite ownership of the product, should be forced to word the purchase button as "Rent" or "Purchase Limited License"

No shit, even physical versions are technically just personal use licenses. What will always matter is the degree of control you have over the game software.


If you buy sillent hill f on GOG, albeit it's still technically a personal use license, it's one that allow you full control over your software. No different from a no-internet requirement physical version, and in some ways even superior.

It's funny how they put air-quotes on buying/purchasing. Might as well say you are renting the license for an unspecified amount of time which can change depending on their terms.
 
This is just talking about MS emphasizing this in game thumbnails. We all know how the licensing works. Yeah.....it is "Sony too".
this is probably MS lawyers getting the jump on the various legislations pending in many territories that will be requiring this kind of disclosure going forward, since our various govts think their citizens are idiots and do not understand how licensing actually works.
 
Good law. And good ms took it everywhere. It would help us all if more people understood that fact and adjusted their opinions on the value of a game.

Would not doubt if this gets more prevalent. Shit gets annoying. Like the licenses where they make you scroll through all the text before you can accept as if anyone is going to understand all the legal mumbo jumbo. Ironically, if it were not for sue-happy lawyers looking for an easy buck then probably none of this would be necessary.

Xbox players really got screwed this generation. If/when MS stops making dedicated hardware a large majority are going to come out of this with nothing but memories of the games they once "had". That's a scary thought.

Distribution. Not everyone has access to a cool game store close to your home that'll have all the games you want. During the ps3 era, i lost count of the amount of times i went to these only to leave disappointed.

The format of the game is meaningless. What ultimately decides whether you 'own' the game are the terms of the license and any potential enfircement methods for those terms. I "own" my GOG copy of Baldurs Gate 3 way more than someone with a The Crew or Concord console disk.
