The case is a bit more complicated than that. The full article has more info, but since it is a pay site, I don't want to paste the entire thing. Here is some key stuff:

His attorneys claimed that there was no proven connection between his shooting and the death of the two women, and that the two events occurred in different times. They further argued that indicting a soldier for the killing of an anonymous victim, when no body was found, is questionable, and that many other soldiers also opened fire in the said event.

There really wasn't enough proof for the conviction it seems, this plea bargain was probably the best they could get.

The accusation was laid out in the UN Goldstone Report. Not sure what proof they had in that report though. Anyone here read it?
