I don't see how anyone can honestly think that. Regardless of device, AndriodOS always runs clunkier and slower than iOS, and feels like a cheap knock off to boot.

It's like reading a post from 2009 when it was actually true.

So Galaxy Tab 10.1 4G LTE -- was accused of direct infringement and inducement of D889 patent, and dilution and infringement of iPad iPad 2 trade dress that the jury's response was no. But $219k of damages was awarded. And Intercept, found no infrginement of 915 patent, but found inducement of 915 patent and awarded $2.2M in damages - Koh wants them to look at damages again.

Yeah, but the whole "LOL APPLE IS TEH CRAZY!!!!1!!!" argument doesn't hold up as well anymore. If a jury, made up of everyday people who buy these products (called consumers, fyi) siding with them, isn't it damning evidence that they're not lunatics? The people who go out and give these companies their money agree that they're right, but you think it's just luck of the draw on the jury?

How can you be wrong with a case like this? It's all matter of opinion, as evident by this thread. Most people in here are biased one way or another but I doubt the consumer is.

Two words: Prior art.
 
You know, i don't feel so bad now. I can see the appeals going in the favor of Samsung for sure. There is no way this judgement will stand as is.

No. It's just a commodity. It works and it doesn't really matter.

Two inconsistencies found for damages for products that didn't infringe, but the damages are a small percent of the total. No major issues.

Yep. Apple's oh-so-obvious goal is to make Android (which has run them over in the marketplace) less desirable as a whole, and this - winning a major case against the largest Android OEM - is one step on the way toward that goal. My feeling is that they won't stop until Android is either dead or a shadow of its former self. That's not only gonna fuck over Google and Android OEMs, but also everyone who legitimately thinks Android is a better OS than iOS. And that's why Apple is never getting a cent of my money.

As opposed to the Android vendors who are trying to beat their competitors over the head with standards essential patents that should be offered under FRAND terms and who should also know better about complete articles in the context of patent exhaustion.

Yeah. Fuck Apple.

I was standing in front of a hipster the other day, he pulled out an Iphone and i laughed on the inside, true story.
 
Well, that's just BS. If Android was still at 2.x I could possibly agree, but try using a Galaxy Nexus with Jelly Bean for a while, and you'll realize how wrong you are. Android has made great strides lately, and is now an awesome (and very smooth) mobile OS.

People say that with every android update. Customers stuck using their slow/non updated android phone for two years may leave with a shitty impression when it's time to upgrade.
 
What a great day. As an Apple share holder, I am going to go out to a nice dinner tonight and Samsung will be picking up the tab (no pun intended).
 
Yeah, the jury very obviously rushed through this, and made mistakes. What other mistakes have they made?

Maybe no more, odds are the lawyers will be poring over the documents.

But now they got sent back to the room with all their shit and have to mark any more problems in red. They aint done yet.
 
If this is where it ends between Apple and Samsung, Samsung can be happy to have become the #1 smartphone vendor by ripping off iPhone for pre GS3 stuff, making massive profits from it and only having to pay 1B in damages.

Happy owner of GS1 and now GS3, but pre GS3 stuff definitely was heavily 'inspired' by iPhone. Some of the Apple patents should have been invalidated tho. At least the multitouch/pinch-to-zoom one.

That's hilarious. I saw some random guy the other day staring at some hipster pulling out an iPhone. This guy looked like a creep just standing there and staring with these weird eyes.

Just an FYI but for everyone talking about some magical "appeal", findings of fact by juries are very rarely overturned by appellate courts.

Yeah, I think it's like 10-20% of the time, if Samsung is lucky they can probably get some of their phones taken off the infringement list and save some money, best case scenario is I think 500mil (out of my ass number).

But the real damage is done, software and design patents have been validated that I really don't want to be made valid.

If Apple just -sits- on this and doesn't use it to sue anyone else, damage will still be done - lot of people are going to be shitting bricks over their software now, and patent trolls (real ones) are probably going to be reinvigorated by this.

Yeah, that's one of the most worrying ones. Every smartphone in existence infringes on that, if this BS patent is held up.
 
Truth. Sad that only a tiny fraction of the actual Android phones in circulation are running those OS though.

Seconded. I just had the ICS upgrade pushed through earlier this week and my Droid 4 runs so much better now.

As for the case in hand, I think I agree that the patent wars will get uglier from here on out until some of these patents start getting invalidated for various reasons (being too vague, etc.) Because there is some sheer lunacy out there in the patent world.
