Guys you think software patents are bad, you should see the biotech industry. A couple years ago scientists were trying to patent parts of the human genome.

Just one more bullet point about why this system needs fixing.



.....the more I think about it the more I do think reform has a chance of happening. Especially if google ends up getting hit hard with this. With the way lobbying and corporate money are as important as ever to congressmen, if some of these giant tech companies become more and more threatened from companies like apple and similar patent trolls, companies like google and Samsung are going to pour money into coffers in order to get congress to take on the issue. After all for companies like Samsung this is going to directly hurt their bottom line. And the more this keeps going on the more companies that will be recruited onto the Samsung team and less on the apple team.

Yeah, that's one of the most worrying ones. Every smartphone in existence infringes on that, if this BS patent is held up.

I dont understand this. Apple created this feature (ok, well if anyone wants to find some obscure prototype or an unreleased product, FIRST TO BRING TO MARKET), and just because everyone decided to copy it, it makes it "invalid"? Because every phone uses it? I mean, pinch to zoom is one of the prominent features of iOS products.
 
This thread is worth watching the next few days judging by responses. The cheer leading especially.

Don't care for the verdict though and not excited for the future patent wars.

guess the worst thing that could happen would be a software 'update' that gets rid of some features. i still want the bounce back thingy back on my S2 :(

How do you feel about iOS notifications? Arguably a much less 'obvious' feature, yet obviously... inspired by Android.

Me personally? I don't think Apple should get into trouble for seeing a software feature in a competing product and trying to introduce something similar into their own.

The biotech industry is far better than the software industry. There is a requirement to have very specific uses for discoveries and vagaries will get your patent thrown out quick.

They didn't invent pinch-to-zoom. Not even close. They did make it popular in the consumer market, but that shouldn't grant them a monopoly on using it in their products.

You know what the funny thing is, all my professors and supervisors think that it helps with innovation and progresses the industry. I'm pretty sure they all have their names on at least one or two patents.

So should sega be able to sue namco, capcom, and nether realm for using punches in video games since they(I think) were the first to use that in a videogame with heavyweight champs?

You know what's ridiculous? You have companies now patenting genes and DNA. How this helps innovation and progress is beyond me.

actually no. One it was first to invent when these were given, so pinch to zoom is invalid in any sense of the word

You're being too broad.
Apple didn't 'invent' / popularise / whatever zooming itself, merely a method of zooming that up until that point wasn't prevalent within the market.
If Sega had specifically created a method of administering a punch in a video game, by use of a pressure sensitive controller of something, then you may have a point.

Most of it would boil down to "there's more than one way to skin a cat". Trying to get around patents can drive just as much innovation. Case in point, slide to unlock patent. Google turned that into a passcode mechanism and bypassed the patent. Voilà, innovation! Instead of everyone sitting around with the dull old slide to unlock feature they've taken it to the next level all because they couldn't copy it.

What? I think the patent system is absolutely ridiculous. That's why I don't think either Apple nor Google or Samsung should be sued/suing for this stuff, because it shouldn't be patentable.

I have a Samsung Galaxy Nexus phone... what does this mean for me? Is Samsung forced to drop software support?

Samsung doesn't develop the software for the Nexus, Google does.

That patent shouldnt even got granted. Its like theyre forgetting theres door locks that you have to slide to open it....there
 
Ugh, juries.....

This is why my patent prof would rag on juries for extended periods of time. My favorite quote was "You know what the problem with juries is? Think about your last trip to the DMV. There's your jury pool. Have fun."
 
Some of the Apple patents should have been invalidated tho. At least the multitouch/pinch-to-zoom one.

Their main argument is that new ideas, when patented, are able to be shared with the public instead of them being kept a secret. These ideas can then be used in new ways, or be improved upon by other people. They can also be sold or licensed allowing the inventor to reap its benefit.
