Would like to see legal gaf answer this.
I'm suspecting that they are innocent of the bombing crime, but guilty of the separate crime of evading arrest and attacking cops. You can't presume guilt in the former simply because they are guilty of the latter.

This is why suspected criminals should be captured alive if possible, but I guess that proved hard in this case.

They aren't guilty or innocent. Those terms only have meaning in court and you can't try the dead. They won't be declared guilty or innocent of anything unless a trial occurs (i.e. if one of the victims tried to sue their estate).

Obviously the FBI's case report and history itself will label them as the cause of the bombings.

For those waking up here is the summary of what happened in Boston overnight. Attempted to rob 7-11, they killed an MIT police officer, hijacked a car, stole a police vehicle, threw explosives out of window during chase, got into firefights in neighborhood, one of them died from being shot to death by the cops and a bomb vest going off(suspect 1), and the other is hiding and there's supposedly bombs planted all over the place(suspect 2) .
