Boston: One dead, one captured, city re-opened

Just for perspective I'm a card-carrying ACLU member and I'd let them in and make them coffee.
They probably wouldn't have time for coffee, but I get what you're saying, heh

Let em do their job, pass em a couple of bottled waters, and thank them for a job well done. What's all this fucking fuss about YOU'RE NEVER COMING IN MY HOUSE

And what if the renewed interest in Sunil help his family find him?

Look the FBI ASKED for HELP. People tried to help. 99% of the leads called in where probably wrong.

I don't get the hate for people legitimately trying to assist police in tracking this guy down.

There's a difference between contacting the FBI with a lead and hiveminding towards an incorrect conclusion and then directly involving the family of that person via accusations and threats.

going off this tangent of invalid searches and such, I wonder if there's some sort of protection against anything the searching parties see in your house, against you.

I imagine there's been quite a few toilet flushes in Watertown.

All the internet civil rights lawyers in here are amazing. Keep on keeping on.

Get off your high horse.

None of it would be admissible in court. And I doubt they care about anyhting other than catching this guy.

Because I don't allow strangers in my home. And since this is America, that is enough of a reason (especially since systematically searching multiple blocks does not fall under the hot pursuit doctrine). This search is bordering on martial law and despite the intentions (the road to hell is paved with good intentions), anyone who respects the Fourth Amendment should be wary.

How would you act if this affected your family personally? Would you be a true Patriot(tm) and deny them entry? LOL I'd bet you'd be the first one to call/help the cops if it did.

I smell bullshit, tough-guy internet syndrome.

I would think they would have the right to force search a home looking specifically for the suspect only. It would be exigent circumstances.

It wouldn't fall under hot pursuit because once you lose sight of the suspect, it becomes fresh pursuit, and under fresh pursuit rules you can't go into a hone without permission or a warrant.

Even though the exigent circumstances is a bit of a stretch, I'm sure this is spelled out under the Patriot Act for domestic terrorism.

Its not like they give a shit about your dime bag laying on your coffee table, they have something a little more important going on at the moment.

Talk about your false equivalents

The mechanic said that the suspect was biting his finger nails (something that he has never seen him do) and was acting nervously (for obvious reasons).

He insisted that he needed his car immediately which surprised the mechanic, considering that he wasn't finished working on the car

They aren't forcing themselves into your house. Of course if you don't want them to enter the house, they will be forced to get a warrant. And just lose time and resources.

they would not be allowed to arrest you or take evidence that is unrelated to the reason they entered the house. Any tangential arrest / evidence would be tossed in seconds from any court system

Rookie Move you tape it to the lid.

If you allow the officers into your residence or if they obtain a warrant, they can arrest you for anything in plain sight. Doubt that's happening, but this "refuse and we get a warrant for a vague address" is a mockery of the Fourth.

Dude what happened when I went to sleep around 10am? They had him held up in the house, with a rocket in the basement I thought? Still nothing? Is the kid on the lose or in that house?
Dude is still missing in action.

They gunned down police officers and tossed bombs into a neighborhood? Did you happen to notice how the city wasn't shut down before they did that? They were identified and nothing got locked down until they started killing more people. Is that not clear?
So which trumps liberty: Bombs? Dead cops? What specifically is your test case here?

If the cops went in and searched someones home and they found a small scale grow-op I don't think they would even give a shit right now. Besides I don't think it would even hold up in court. They are looking for a specific person and that is likely all they can legally achieve.

Except unrelated evidence of unrelated crimes found during a search under the idea of hot pursuit is admissible isn't it?

This is a good point, but at this point I really do feel like we're getting into civil liberties danger here. Obviously there must be a limit to the use of hot pursuit, and it strikes me that charging you with a crime based on evidence seized during hot pursuit of a suspect who isn't you, doesn't live in the building in question, and may in fact never have been in that building seems past that limit. Note that Warden v. Haydn uses the phrase "particular apprehension or conviction," suggesting that the evidence seized should be pertinent to the particular suspect under pursuit. Exigent circumstances are still a matter of individual judgement, after all.

Guys, this isn't Martial Law. Your rights are still in tact. You should have e dry right to refuse police searches on your private home if that is how you feel and you have no reason to be suspected or have a warrant. I'd certainly encourage people to help the police by complying as much as you are comfortable with, but rights still give you that option. The acts of the few shouldn't destroy the rights of the many.

Was following this thread at work through my iphone.

I really hope this dude hasn't managed to hole up somewhere and take hostages.
