I pirated 360 games and MS banned me, what the hell?

Then the user should be refunded for the purchases he no longer has access to.

Because if I purchased something I should be able to use it. If something is preventing me from doing so then something should be implemented to circumvent the system.
Wrong. So many people have already stated why this is wrong, please reread the thread. He broke the rules, paid the price.

Again, two wrongs don't make a right. If he legitimately purchases something and no longer has access to it due to other activity, that doesn't change the fact that he legitimately purchased that content and no longer has access to it.

I can only assume you're referring to his two TOS-breaking (if not full-on piracy laden) xboxes, correct? I mean daaaaaamn, he did have one he totally legit paid for stuff on!

Don't feel sorry for the OP but the email he got doesn't mention piracy at all. They could at least be a little clearer.

C'mon man. Seems to me that 99% of the time a permaban comes from a modded console with the other 1% being taking MS Points to rank people up and other misc offenses. Even the OP knew what it was about but still tried to play dumb.
 
So you pirated games, got banned for it, ranted and raved here and threatened to buy a PS4 and acted like you did nothing wrong.

Detective GAF always wins. Maybe its time to start taking responsibility for your actions in life and stop acting like an entitled victim when in fact you were stealing and violating rules all along.

Do Sony a favor and don't buy a PS4 please.

Doesn't make it right. And it's something that's going to have to change in the future when it will be impossible to find physical media.

There aren't two wrongs here. This is my last post about it, because it's getting really old. He didn't have his games taken from him. He has them on his HD. The ability to re-download a game is a part of the service. He's an admitted thief/pirate and was banned from the service for it. Along with that ban from the service comes the inability to re-download past purchases. To suggest he should have the right to a refund or access to their service that he exploited/stole from is amazingly out of touch with reality.

I'm not sure he does since he broke the tou, I guess he can bring them to small claims court.

These 3 bullet points in combination definitely seem to point toward piracy without using the word directly. Also, they leave in phrasing to indicate that there are other reasons not listed.

Yeah, I remember that. Hence why I said most of the time. They've gotten a little more lenient in regards to their profiles where you are allowed to put your orientation, not sure if they did that for locations as well.

Uhh... no? This isn't Microsoft making a big mistake, or their servers about to shut down or whatever...

This is the OP dishonoring the Terms of Service, basically voiding any rights or privelages he would've been entitled to. Not that you would be guaranteed to get your money back anyway.

Obviously the entire argument was based on the fact that he legitimately purchased games and that he was banned for something more nebulous than blatant piracy.

And you know what- Even if he did pirate 90 games but purchased 10, does he not have a right to the 10 games he purchased?

If I have a modded console where I download 90 games, I still own the 10 physical copies I purchased. The argument is more about ownership in the 'digital age' than anything else.
 
Well, it all due respect sir, but: You are NOT a fellow GAFfer. You started a Thread in this fine Community and many people tried to help you because no company is perfect and they make their own mistakes. Many good GAFfers in here were trying to help you, finding a solution for your problem but it seems that your problem is that your 360 was banned for Piracy. And that's is very easy to understand.

I almost feel sorry for the kind souls, discussing in here to help you while taking their own time to provide you solutions to your problems only to find out that it was your own fault from the very start. It's always sad because you do not understand what makes GAF such a fine, unique Community. People like what we talk in here, Video Games. We are always trying to give proper opinions on a game, helping each other with a purchase, or even we someone have some sort of Software or Hardware problems.

Piracy is not a problem that GAF like to help you sort out, it's a shame you made so many good people in this thread from this fine Website to lose their own time. It's a shame indeed. :(

To all the others finding this information, thank you to all, it's things like this that keeps improving this Community, this is indeed the best place to talk about what we like the most: Video games.

Don't know but it needs to be done. Too many of the usual faces too ready to hope MS was wrong so they can continue hating.

Is he using a flash console, shouldn't he still have access to the games he bought from the market place even if he is banned from it in general? I mean, he did spend money on it.

We were dealing with a complete lack of information - if you want to shame me for not knowing all about an event where I was mislead then go right ahead and do that.

Then again, I don't think I shat on MS but whatever, I don't see the point in gloating that some people's gut reactions were right and some people's weren't.

In light of recent evidence, clearly the OP deserved a banning.

Still doesn't change the fact that Microsoft (Or Valve, or Sony, etc) can ban an entire account and all of the properly purchased content on said account without any explanation or recourse.

Doesn't help that OP was clearly deceptive and deliberately misled his fellow GAFfers the entire time. No one would happily defend what this slippery mofo was up to, the Oman stuff was just the scapegoat.

When he will have refunded Microsoft the 90 pirated games, he could have his 10 games back. Sounds fair to me.

We aren't 100% sure since hes avoided people asking him, but he is selling a console with a custom dvd drive firmware on a website (the same console as in OP by the looks of things) and is on another website asking about a program that appears to either burn or create pirated xbox games (See: http://www.neogaf.com/forum/showpost...postcount=1248

The hilarious thing is that we still don't know what OP was actually banned for.

Thread starts with OP basically claiming innocence outside the Oman exploit, in a manner guaranteed to rile up the most anti-MS sentiment possible, especially given the popularity of the Oman exploit here. There's some discussion about the reach of the ban seeming sort of out-of-step with the complete lack of bans for almost everybody else involved in the Oman exploit.

Time passes, and various other shady activities the OP has been involved in come to light, culminating with evidence that OP has pirated Xbox360 games in the past. We still don't know what specifically got him banned, but evidence of piracy is enough to make it clear he's not an innocent little lamb being sacrificed by Microsoft to pay for their own failings in allowing the Oman glitch.

It wouldn't be terribly surprising to find out he was banned for something detective GAF hasn't turned up yet.
 
I knew it couldn't just be the Oman thing even though I quit doing those exploits just incase...
