Well said and completely agree. Look at all the arguments caused and people worried about their accounts because the OP neglected to mention he pirates games.
On the plus side, I did get a reminder on why I don't buy digital because whether the OP's ban was legit or not, I would hate to forever lose access to my games and that does suck for him.

Op decided not to mention he pirated games. This entire thread would have been closed before the second page if he did.
Still think Microsoft should have told OP what he got banned for in the email, or maybe they did i dont know anymore.

Then the user should be refunded for the purchases he no longer has access to.
Because if I purchased something I should be able to use it. If something is preventing me from doing so then something should be implemented to circumvent the system.

Well, it all due respect sir, but: You are NOT a fellow GAFfer. You started a Thread in this fine Community and many people tried to help you because no company is perfect and they make their own mistakes. Many good GAFfers in here were trying to help you, finding a solution for your problem but it seems that your problem is that your 360 was banned for Piracy. And that's is very easy to understand.
I almost feel sorry for the kind souls, discussing in here to help you while taking their own time to provide you solutions to your problems only to find out that it was your own fault from the very start. It's always sad because you do not understand what makes GAF such a fine, unique Community. People like what we talk in here, Video Games. We are always trying to give proper opinions on a game, helping each other with a purchase, or even we someone have some sort of Software or Hardware problems.
Piracy is not a problem that GAF like to help you sort out, it's a shame you made so many good people in this thread from this fine Website to lose their own time. It's a shame indeed.
To all the others finding this information, thank you to all, it's things like this that keeps improving this Community, this is indeed the best place to talk about what we like the most: Video games.

I had to look the thread becuase of the title change.
You didn't tell you were pirating games in your original post. More over, you used the banning as a way to fuel console wars when you violated the terms of agreement, so the fault solely falls on you.
I'm not sure if this is supposed to be a joke or not but they most certainly do.

Most of the time it really is. Microsoft does not fuck around with their policies, I rarely see a time where someone was banned where they did not deserve it (before you say games before release date, this has been a known thing for a long time that they enforce bans for that).

in light of this thread can I make two suggestions?
1) Ban Marketplace Theft threads. Many years ago like many people here I took part in the Coca-Cola MS points deal and managed to redeem a large number of free points. Looking back on that I realise it was a pretty stupid and careless thing to do given that MS are acting pretty strongly in a number of cases. Looking at the Oman thread I can't see how anyone who used it can think of it as anything but Marketplace theft, it was clearly an error on MS' behalf.
2) Ban 'my console/account got banned' threads. There might need to be a bit of refinement to this as there will almost certainly be cases where a user gets unfairly screwed over, but having gone through this thread I'm pretty sick of seeing this kind of story. Perhaps make it so that a thread like this can only be posted where you've got a 'final' response from the relevant company (i.e. a response in a support thread or formal complaint).
Side note: I work in eCommerce in an unrelated industry and I think my experience there colours my judgement on this kind of thing a little bit. I don't have much respect for people who patently abuse honest errors in business, whether it's by a big soulless multinational or a small business, it'll probably end up being just one guy that gets all the blame.

I agree too, I was worried (even to the point of being physically sick, but that's also not helped due to stressing out about life in general at the moment)
I was supicious when OP mentioned his "legit" games, and avoided the questions about the illegitimate games
So now he deserves a refund? OK. Yeesh.
He agreed to the tos. He could play his games as long as he didn't break the rules. Not a hard thing to follow. He played with fire so why does he deserve a refund. That's like him not being punished at all

Again, two wrongs don't make a right. If he legitimately purchases something and no longer has access to it due to other activity, that doesn't change the fact that he legitimately purchased that content and no longer has access to it.

Why drag us all through this crap? Did you really think MS would un-ban you simply because you didn't tell us the real reason?
I am sure that the enforcement team sometimes makes mistakes, everyone does, but BS like this just gives everyone the inclination to always assume that every ban is completely just.
