CBS hit with $550K Super Bowl halftime show fine

NEW YORK (CNN/Money) - Viacom Inc. was hit with $550,000 in fines for the Super Bowl halftime show in February that briefly showed singer Janet Jackson's breast, one of the largest fines ever imposed by the Federal Communications Commission.

The maximum $27,500 fine was levied on the 20 affiliates of CBS that are owned by the network. Affiliates with separate owners were spared the fine.

"No television event has ever received as many complaints from the American public -- over 540,000 -- as the Super Bowl XXXVIII halftime show produced by CBS," said a statement from FCC Chairman Michael Powell. "Indecency determinations, however, must be made cautiously and with appropriate restraint."

CBS, whose executives had earlier vowed to fight a fine, would only say Wednesday that it was reviewing options regarding an appeal.

"We are extremely disappointed in the ruling," said a statement from the network. "While we regret that the incident occurred and have apologized to our viewers, we continue to believe that nothing in the Super Bowl broadcast violated indecency laws. Furthermore, our investigation proved that no one in our company had any advance knowledge about the incident."

I'm sorry... but this just absolutely boggles my mind. As EdLuva implied, it seems to me that the only reason the FCC going this far is because so many people complained - they're trying to make people feel like their concerns are being "dealt with". The fact that so many people complained is just insane - you can see almost as much watching music videos. Never before has our double-standard regarding nudity been so apparent. I imagine that people around the world are laughing right now, and rightfully so. Unbelievable...

I'ld like to know the percentage of people that complained. How many people actually watch the the game. Also I would like to know the number of people that searched for a clip so they could see it after the fact. You would probable find like 1% of people complained, or at least I hope you would. The whole thing was a very funny joke that got even funnier when all the freaks in the freak kingdom got upset about it.

Stations that show music videos are governed by slightly different broadcast policies than the broadcast networks. Most music video channels are almost always broadcasting the teen rating or on cable where they can legally broadcast at the teen rating or higher without any issue (usually). Regular broadcast networks don't have that luxury - they have to conform to the decency guidelines imposed by the FCC.

That may be so; I'm not saying the FCC is stepping beyond their bounds in applying this fine. They have to enforce the rules that are established. But, I do question the "big picture" that led to the formation of the rules. I also wonder why 540,000 people went so far as to complain to the FCC about something that seems, to me at least, to be so trivial. It's the bigger issue that I find unbelievable - this FCC fine is just icing on the cake. All the outrage over this silly thing is just unreal (at least it seems so to me).

On the whole we're not, but it's stunning to see how different the TV standards are even between Canada and the US, nevermind the US versus Europe.

And this fine is stupid as fuck...it isn't like CBS told Justin and Janet to do their own take on Strip Tease. Granted they should've known exactly what they were planning to do, but telling Janet not to bare her nipple is the equivalent of telling Justin not to start a stage fire...it's pretty much assumed, common sense stuff that doesn't need stating.

So they don't complain about the two prior minutes of simulated sex that J & J were performing, but they complain about some one second long shot of a broached up nipple? Yeah, that's reasonable. Of course most of the complainers probably haven't had sex recently enough to remember what it's like, thus being oblivious to that lewd display.

Anyway, CBS has now been owned two days straight. So with tragedies generally coming in three's, what's gonna happen tomorrow? The entire cast of CSI walks off the job? The entire cast of Survivor drowns in a boat wreck? Mike Wallace dies?

and dont compare the news and music videos to this. with the news you know what you're gonna get especially with all the shit going on in the world today, which is a big reason a lot of parents dont let their young kids watch the news. and music videos are on cable and arent meant to be family entertainment.

movies and music videos can NOT be compared either. parents dont let their 8 year old kids watch mtv or bet, they also dont let them watch pg-13, r rated movies. obviously some do, because their parents dont care but most do not.

Since you obviously didn't read what I said earlier, I'm going to repeat it again. How the hell can these people NOT get offended by Justin and Janet having simulated sex on stage, yet raise a fucking uproar over a fucking nipple? Can you tell me how the fuck that works? Hell, the reason why I missed the nip shot live was because I was too put off by J&J's virtual sex routine to bother with the rest.

And this idea that the Superbowl is family entertainment is a crock of shit. At anytime you can see someone's leg get turned into an accordian, which is hardly a pretty sight. You've got cheerleaders wearing next to nothing doing dance routines that wouldn't look out of place at a strip joint. And do I even need to mention the commercials? Beer, beer, and more beer...with babes of course. Hell, one of the commercials during this year's Superbowl had a horse farting in the face of a woman. You call that family entertainment? Hell, I could see CBS getting fined for that...but for Justin disrobing Janet on their own accord? Get real.
 
CBC in Canada has certain rules about nudity and language...anything goes after 8:00pm I think :) French channel is anything goes after 6:00pm!

you can bring your kid to a circus and have the animals go nuts and the place turns into a riot with people getting trampled. does that mean its not family entertainment because of what COULD happen?

and if you read the many articles most of the people that complained, filed a complaint about the entire half-time performance, the tittie gets all the spotlight though.

Yeah, yeah, it's the principal of the thing.....but it's pretty clear that they decided to come up with a figure that CBS wouldn't waste their time contesting. That way it looks like they're doing their job. I don't think that the network should be held responsible for random "wardrobe malfunctions", but it would probably be more expensive for them to appeal the ruling anyway.

Ehm I don't know if in Europe we got a different Superbowl version or not but they moved the camera away so fast that I was really asking myself 'Was that a titty?' Certain Americans love to bitch about anything they can bitch about. No way you can tell me that any 7 or 8 year old has been negatively effected by seeing less then 2 seconds of Janet's tit.

I notice you had nothing to say about the other points BTW, but then there's nothing to say against it. Bottom line is that everyone's got a different take on what a "family show" is...I simply point out that the beer ads and near naked girls on the sidelines is hardly family-oriented viewing in my view (let alone a horse farting in someone's fucking face), yet little uproar is made about those elements.

I saw little said about the virtual sex show, which was ten times more offensive then the tit strip. All I heard about was the nipple. If those idiots actually decided to watch the entire sex simulation all the way through to the nipple disrobing, that's their fucking problem. It isn't that hard to change the fucking channel...it sure wasn't a problem for me.

The funny thing is that they're making a big deal about it being the biggest fine ever levied, as if I'm supposed to be wowed by the half million figure. They make that from a single advertising block during Survivor.
