Prosecutors had recommended a mandatory 25-year sentence, 100 years with 75 suspended, which is what state law calls for.

Instead, though, Judge McKeon handed down a far lighter sentence: a 30-year suspended prison sentence, which means the man will only serve it if he fails to meet the conditions of his probation.

Among those conditions, which McKeon called “quite rigorous,” was the requirement for the man to register as a sex offender, the Glasgow Courier reported. He also cannot access pornography and has limited access to the Internet.

In addition, the man will serve 60 days in jail, but McKeon gave him credit for the 17 days he already served, meaning he’ll only spend another 43 days in jail.

The judge claimed that news coverage obscured state law by failing to mention an exception to the mandatory 25-year prison sentence. According to McKeon, the law allows those arrested for incest involving someone under 12 years old to avoid prison if a psychosexual evaluation finds that psychiatric treatment “affords a better opportunity for rehabilitation of the offender and for the ultimate protection of the victim and society.”

The judge wrote this is one of Montana’s attempts “to encourage and provide opportunities for an offender’s self-improvement, rehabilitation and reintegration back into a community.”

In the note to the AP, McKeon also referenced letters written to him by the victim’s mother and grandmother. Both letters requested the convicted man not be sentenced to prison.

The victim’s mother, who walked in on the man sexually abusing her daughter, wrote that the man’s two sons love him and she wanted his “children have an opportunity to heal the relationship with their father,” according to McKeon.

The victim’s grandmother echoed this, calling the man’s behavior “horrible” but stating that the man’s children, “especially his sons, will be devastated if their Dad is no longer part of their lives.”

Oh yeah lets make sure his sons are happy and the family stays together... sooo he raped his daughter, that's not a big deal? A big birthday present will gloss that over for her and its not like he's going to do it again.

That poor girl. Her mother amd grandmother prioritize her her brothers having a relationship with her rapist father than protecting her.

Did they at least get that poor girl out of the home or does she have to live with him?

It sure sounds pretty terrible, but given that no one was actually in the court room to hear the evidence and know why the judge decided to hand down this sentence, it seems ill advised to get whipped up into a frenzy as this article obviously intends.

Without knowing anything about the judge, I'm going to begin with the assumption that he isn't some incompetent. Maybe this sentence really is the best option for those involved and for the rehabilitation of the criminal. I suppose it won't satisfy the bloodlust of a bunch of strangers though.

Not that that necessarily means that the judge is not incompetent and wrong, but absent additional information we should not jump to that conclusion.

For all these letters defending the convicted man, though, Deputy Valley County Attorney Dylan Jensen told the AP that no one spoke on behalf of the victim, a 12-year-old girl, at Friday’s sentencing hearing.

The petition to impeach McKeon highlighted this fact.

“No one spoke on behalf of the 12 year old child at trial,” it read. “No one. The victim was not given justice, but instead will have to live with the fear that she still has to face her rapist in their community

The father was found guilty, the mother witnessed it and the reason why the judge gave the sentence is in the OP so please gtfo of here with this devils advocate bullshit.

Poor girl. How in the world does a judge come to this conclusion, receiving those letters from the mother and grandmother should have made it even more clear that these kids need to be away from this family. WTF

I highly doubt it. That girl probably would've had a hard time recovering even if he was jailed. But having to live to continue living with him? There's no way this doesn't significantly impact her development.

I've seen that happen before and it's absolutely horrible. The whole "don't make this worse by complaining" after someone was sexually abused by a member of their own family.

It's disgusting. Prioritizing the two sons over the daughter that was raped is wrong on so many levels.

Why is rape culture so prevalent in many countries, let alone the US of all places? It makes my blood boil.

Makes me sick to my stomach, he should be behind bars and the judge should be severely punished for even thinking about allowing this outcome.

It was bad enough when she priorized her sons over her daughter but it's clear this mother is going to pressure if not force her daughter to "rebuild" her "relationship" with her rapist and a judge said sounds good to me ps I'm retiring in two months see ya and thanks for the pention.

Do you think the judge made his decision entirely for the one or two reasons listed in the article or do you believe that he would weigh up all the evidence presented before him when deciding on a sentence? Newspapers do not care to report the many, many details of an individual case, especially if it detracts from their opportunity to generate hysteria.
