Private property, public property, neither matters in regards to the point I was making. That being that her actions do not violate the First Amendment.

Flag desecration has been declared protected speech by the Supreme Court. Her actions were specifically to deprive the protesters the ability to use the flag as part of their protest, in affect she was trying to stop their protest.

You are wrong.

No where in that does it say that a private entity does not have the right to curtail free speech. I can give an example. As an employer I am fully within my rights to fire an employee if I find their speech objectionable, like say if an employee were to call a customer a nigger. Calling someone a nigger is not illegal, but I'm well within my rights as a private citizen to fire the employee and therefore punish them for their free speech which in turn is a form of suppressing their free speech. The only thing that the First Amendment puts constraints on is the power of the government, nothing more.

Okay? Did someone say this wasn't the case?

No, I'm not, you've simply missed my point. The protesters actions are protected only to the extent that the Government cannot suppress their speech. Read, "the Government." Ms. Manhart is not a part of the Government and therefore she cannot violate the First Amendment.

What difference does that make?

She still stole their property.

Take a look back through the past 12 pages and read how many times members of this website state that it's hypocritical to state your support for the First Amendment and your support for Ms. Manharts actions simultaneously.

Take a look back at the thread and understand the difference between calling someone hypocritical and doing something illegal.

Actually it very much does. If a public entity (university) allows a private actor to infringe upon speech, then it can be seen as state action, ESPECIALLY in what is typically seen as a public forum where speech protection is at its highest. So spare us your con law lessons, thanks.

Yes, she did. This is unquestionably legally wrong. My position is that the law is in conflict with what's right. I say this knowing full well that this is a subjective opinion and one that is unpopular around these parts.

There is a big lack of patriotism and respect in our country. I'm not necessarily against free speech, but find it sad that some can't sympathize with the veteran trying to stop this act.

Blind patriotism is awful. Nationalism is awful. I'm a human being before I'm an American. In fact, I'm quite a bit ashamed to even admit what country I'm from. The so-called land of the free and home of the brave. What a joke.

Okay...fair position to take, but it doesn't matter because it's still legally wrong?

As I've made quite clear multiple times I do not question the illegality of her actions.

No, I'm saying people calling her hypocritical is not the same thing as saying she did something illegal. Yes she stole, that IS illegal but to call someone hypocritical does not necessarily mean she did something illegal it just means she's a fool to sit there and try to stop protesters while at the same time claiming to defend the flag which represents a country where free speech is a major component.

If you disapprove of the protest and/or the woman getting arrested for theft, just say so without trying to reinterpret the Constitution.

Nice sneak-in of "nigger" too

I don't fear words and it made my point. Also, there is no reinterpretation of anything in my post. If you disagree with what I've said please elaborate.

I completely disagree with his post but it is a perfectly valid and reasoned post. I don't know what to make out of yours, though, other than a passive aggressive jibe carrying an implied, baseless accusation of racism. I think it's unnecessary, but a lot of users use that word within the same context. Are they all racist, or just the ones that don't conform to your views?

You elaborated on your initial post later, so I don't have anything to add

In light of your comments on a variety of issues, I don't really feel like engaging you.

I already did. You don't understand the body of law you're discussing.

I wasn't referring to you, and I chose to ignore your earlier post because it had no bearing on my point and was needlessly hostile. The actions of the University are not in question here, whereas the actions of the woman have been for the duration of this entire topic. Your point is unsourced and irrelevant either way.

In short... You really have no idea what you're talking about.

Continue conflating "I don't like what you said!" with, "I don't like what you said so I'm going to commit a crime against you!"

Oh, hey, I know this lady. She was the training instructor for my sister flight in basic training. I will never forget because she got into trouble for being in Playboy like a year later.

"Personally, I think we should put people into gulags for speaking up against our beautiful country. Try it in China, try it in North Korea, see what happens. Respect the privileges 'MURICA gave to you, that all the other underdeveloped countries don't know. You are free to behave like the government wants you to. Show a little gratitude, guys!"

"I'm a small government guy, but I would say that it's time for our legislators to introduce something to make it illegal to disrespect a flag and maybe even treat it like a citizen."

I love people who preach small government but then what new laws whenever their beliefs are hurt. How do they not see the hypocrisy of that viewpoint? "Get the government out of my business except when people are doing things I don't like!"

It doesn't get any dumber than that.
