So basically they told Microsoft: "If you want CoD on GamePass, just pay us $70 billions, then it's all yours"

:messenger_beaming:
Pretty much

the ceo would probably get sacked as well. So 70b would be a nice retirement money

MS is free to outbid Sony on all these marketing & timed exclusivity deals which is EASILY doable for a trillion dollar company, but that's obviously not their goal so they're trying to buy one of the largest publishers & have permanent control over all that IP in the name of enabling "fair competition for the benefit of all gamers", lol. How stupid & cringy that sounds.

They all looked like amateurs these past few weeks : Nadella with the 'let us compete' bullshit argument, MS president Brad with the Netflix and Blockbuster comparison, Spencer with the flip flopping deals for CoD, 'we want to expand gaming for all' while simultaneously making multiplatform games exclusive, throwing meaningless 10 year 'commitment deals' left and right, all their childish Twitter snides
It's pure despair at this point.

Sony came out and said all Bungie games now and in the future will remain multiplatform.

Microsoft offered 3-10 year deals.

And as I just said, Microsoft apparently assured EU regulators that Bethesda games would remain on rival consoles and then backed out.

The only thing you have going is what MS has said through the media which is completely different behind closed doors. There's nothing else to be said. There's way more evidence that MS is not committed to having these games remain on PS.
Anyone who thought Starfield (including EU regulators) would launch multiplatform, before even announcing a platform is missing out on all the good deals I have on Bridges for sale. Offering Nintendo a binding contract which they accepted, to support COD for 10 yrs is different than "we will support Bathesda games on other platforms : TOS online, FO76 servers still active on PS

I haven't come to any conclusions about this, yet. But reading your post... I wonder if this is a win/win situation for MS, regardless of what happens.

Except Microsoft will be $3 billion poorer. Not sure I'd call that a win. Will AB and MS be closer? Eh....hard to say. I can see AB stockholder being pissed that MS didn't deliver on the deal. Kotick is toast no matter what though.

Your not entitled to have games on gamepass.
Huh? Who said that? It’s a want. A benefit to them acquiring the company. That’s not entitlement. Entitlement is an expectation for nothing given. Not us paying them money then wanting more content/ wanted content on their end.

Then people say you guys dont buy games suddenly everyone get offended.

Xbox fans aren’t a monolith. I personally utilize the means that work best for me.

This feels like it’ll delay the time-frame a bit. Last I heard the deal was expected to close mid-2023, but it feels like these kind of things can drag on for a bit.

It’ll be fun to follow this though, hopefully we’ll get some juicy leaks/interesting details from the legal documents.

He must have missed a memo where Redfall and Starfield were supposed to be released on PlayStation before Microsoft opened their briefcase. God of War was always intended to be a PlayStation exclusive, just like Halo game is a Xbox exclusive from the moment it is greenlighted.
Halo was actually a Mac/Windows game until it became an Xbox console exclusive lol

edit: I forgot that the original Halo did come out on Windows/Mac like two years after the Xbox launch

Then it’s clearly a people problem. For all the money they have and over 20 years in this business, it should be a slicker operation. Having all that money means fuck all if it’s not the right people spending it.

I get frustrated because, and I know some will laugh, Xbox has so much potential, they began to reach it with OG & 360 but now?

It says a lot people have to keep pointing out a decently priced subscription service as a defence for any failures or criticism.
My favorite part is how people pretend that Sony is some kind of OG in the industry and that Xbox is the newcomer when they entered the market like 7 years apart.

I do wonder, are you still of the opinion that this deal closes?

I know for a fact that Sony's shitty tactics and hypocrisy will be fully exposed in court for all to see.

This will be you when when you realise certain "tactics" are industry standard and used by all parties when negotiating mutually beneficial deals:

What's also funny is the fact that you think this is just about Sony. The PR has really done a number on some of you, I hope you enjoy your introduction to the real world.

Again, it's not realistic for them compete in exclusivity deals when the install base is so much in Sony's favor. They would have to pay a sim magnitudes greater than Sony to outbid them, making it unviable. This is why Sony is so desperate to keep their anti-competitive position.

If the deal is approved, it would set fire on the market.
Concession or no Concession, this deal would signal to the big dogs that gaming market is open business.

Expect big purchases with no limits, because activision was the biggest of all prizes.

Your favorite publisher is going to be bought, by someone you dont like.

I personally want it to fail hard, so these shit dont happen. I already lost bethesda to MS.
You didn't lose anything to anyone, you can still buy an Xbox or play on PC. Just like Xbox players can still buy playstation or play on PC. Next Bungie game may be exclusive to ps and I wouldn't be surprised to see Sony fans dancing in the streets

Soo... Ummm...

The publishers reach out and sign agreements early in the development phase of an IP, with intended platforms. Years in advance. They don't just get released and pop up on the platform. There's an entire infrastructure and framework behind the scenes for each release.

Bethesda would have reached out to PlayStation years in advance. Years before a trailer is released to the gaming public.

It was meant to be on Mac until MS bought them and made it exclusive to Xbox.

With COD? Legally can't (pending the deal goes through) as Nintendo, steam have already accepted. With Starfield? No such deal exist. They promised to support Bathesda tittles on competing platforms. all existing Bathesda titles remain supported on competitor's hardware, deathloop's time exclusivity honored.

Sony has created and dictated the direction of the industry so long that their way of doing business is now being accepted as the only way to do it and being regulated that way. We all know that Microsost is at a huge disadvantage in this situation due to consoles in the market.

That is wild when you think about it but I'm sure most people won't think beyond "haha Sony wins" or "haha Xbox wins."

I am very curious to see what happens with Activision if this deal is blocked. They wanted to be sold but I'm not sure how that happens if this deal falls through.

Oh, that's easy. The FTC didn't a raise anti-suit over Disney buying Fox, which many observers had anti-trust reservations about. However, its new leader, Lisa Khan, has taken a staunch "anti-big tech" stance, effectively saying that even though things are legal, or that anti-trust laws don't apply, it doesn't make them ok (article has her direct quotes). That's not the mandate of any competition regulator, its just people using a regulatory body to push an ideological position. Khan's FTC tried and failed with Amazon's MGM take-over, and it reads like they're going to try again - and they'll fail again, because the laws haven't changed. Khan not liking "big tech" doesn't make their actions illegal.
So, actually nothing.

So we shouldn't believe what corporate lawyers say to regulators? Where have I heard that before?

Will Smith Reaction GIF

"But there never was a PS5 version" and "you can't take away what never existed".

Good thing the regulators have access to what's really going on behind the scenes. All of these disingenuous takes/posts we've had to endure for some time are getting exposed for what they really are.

What do you think MS is coming to the table with? Tons of Sony dirt is going to be unearthed.
And they will lose if they do that. The FTC was quite clear about what the issues were and whataboutism isn't going to win this for them because according to Microsoft itself Sony isn't a competitor. It's the other tech giants.

Devil's advocate here: Redfall and Starfield were never announced PlayStation titles. In fact, according to Todd Howard's most recent pod-cast appearance, they basically build all their games for Xbox first and port them to other platform late in the process.

As for Halo: Halo was originally a Mac title, until Microsoft decided it needed a launch title for its new console. Gates' Microsoft 101: buy up what you can't beat. Nadella seems to be running a slightly different ship, however.

Also worth noting that this suit is being handled internally in the FTC's court not Federal Court. The FTC has purposefully not seeking a preliminary injunction....which is to say the deal can quite possibly go through and they are suing MS. So more concessions are likely.

It mentions Starfield and Redfall.

Did MS back out or not?

I don’t get all the ways people all over are trying to spin this. The FTC is literally going to try to block this.

Back when ABK issued that statement about them being prepared to fight for the sale I had wondered if this would be coming.

It will be interesting to see how it turns out. Ridiculous federal overreach IMO, 9% of the software market (with much of that already outside the reach of the console space) being picked up by the smallest console player shouldn't warrant this response. Really it seems more like they have an axe to grind with big tech more than anything else. MS, ABK and their army of lawyers are already hard at work I'm sure.

Starfield was announced at E3 2018 almost 3 years before Microsoft bought Bethesdsa.

I think it's fair to say that it was intended to be a multiplatform game until Microsoft wrote a cheque to buy the company....
Also the ps5 and series weren't official by then. Both Starfield and elder scrolls were announced for next gen consoles.

No one and their mother believes Bethesda would skip the most successful console to make xbox exclusive

Still not entitled to games on gamepass. You have to stop with this.
