Kloriblle, a known fanboy and an MS employee, tweeted that in defense and these "journalists" just ran with it.
FTC never once said that MS had made commitments. Here is what they wrote:
Not commitment. MS said it had no incentive to withhold games. And they did say that. Right here.
EU saying they didn't break any commitment is true, because they never made any commitment in the first place. And it does not invalidate FTC's argument (which never once mentioned commitment).
But MS did lie and misrepresented and misled, saying that they had no incentive and it would not make sense to make games exclusive until they hit certain numbers, etc. But made the games exclusive without hitting those numbers the very next day the acquisition closed.
Kloribille intentionally confusing "commitment" and "lying" is disingenuous. Both things are true at the same time.
