The trailer I saw before ROTS actually showed the alien, not too clearly, it was through a window, but it wasn't like it was hard to tell what it looked like.

That's probably true, as you can see one of their heads in the new trailer they're playing before Star Wars, and I remember saying to my friend, "That looks a lot like the aliens in their battle armor in Independence Day" (when it came to their head).

This IS NOT concept art for War of the Worlds. A french artist saw the trailer and drew up some sketches of what he thought the Tripods would look like.

The above WOTW sketches are not "production sketches" - but rather were done by Kermici Farid - a professional production designer and storyboard artist from France - (worked on CRIMSON RIVERS among others) and he did these after he saw the latest trailer to satiate and make more clear sense regarding what he saw in the trailer. He is not associated with Spielberg's film, but very talented regardless.
