When you start an online match of Mario Kart 8, you get an option to either go play with the original 32 courses or with all 40 courses (the original 32 plus the eight DLC tracks). Likewise, when you create a tournament, you can select 32 or 40 courses, but you can also select to only play the DLC levels.
Of course, if you make a 40 course tournament, everyone that wants to join will need the DLC.
But you will never come across a situation where someone will get kicked out of a lobby because they dont have the new content. People with the DLC will also never have any disruption to their experience because other people didnt get the new courses.

Actually, we're getting 6 charactersWe're getting 8 characters right? And there are 7 weight classes? Perhaps they'll try to give every weight class something? If so, Link might be cruiser as Dry Bowser would likely be super heavy.

I think we should ditch the Normal one. Nobody plays it. I guess keep Frantic in case people w/o DLC want to play, though I think it's likely that most people w/o DLC will buy it quickly to play with as many peeps as possible. Wait, didn't consider that.Oh, yeah. If we do a 40-track tournament, the probability of at least one DLC course showing up in a given vote is just slightly under 50%:
(32/40) * (31/39) * (30/38) = 50.202% = the probability of no DLC courses showing up
100% - 50.202% = 49.798% = the probability of at least one DLC course showing up
And if one does show up, it's pretty much a guarantee that just about everyone will vote for it. So even if we do a 40-track tournament, we shouldn't have much of a problem playing on the DLC courses often.
(Of course, this is assuming that every track has an equal chance of being selected.)
