A.I.M. and M.O.D.O.K. have frequent enough run-ins with Captain America to be considered connected to him. M.O.D.O.K. was outright described as a Captain America villain in an MvC3 press release.

That's a good question. My first thought would be that everything in the Zip leak would be something that's actually on the stage, so it includes bosses and enemies, so that may be why MODOK isn't included, but that would mean that Death would be something like that. Also there's the Thanos in his chair thing.
