Killing Davis was lawful, Healey told the jury, if Dunn acted in the heat of passion or if he unintentionally caused Davis' death. The jury could also find Dunn not guilty if he was in danger, acted in self-defense and exacted a justifiable use of force, the judge instructed

I used to think the provocation/heat of passion defense was a sound one. Having now read multiple cases dealing with "heat of passion" defenses and reading more into it, I think it is complete bullshit 99.99% of the time. Only in the rarest of occasions can we be so blinded by our emotions that it would cause us to lose all of our human faculties and revert into essentially an animal state. Based on the evidence in this case I think the judges charge is completely irresponsible. Canada has basically eliminated "heat of passion" as a defense, but I doubt the US will adopt that any time soon.

And more importantly, is it noteworthy that this obvious murderer was found to have murdered the guy that he obviously murdered?

I had forgotten about the case, so reading the thread title I thought somebody had killed somebody else with loud music being the weapon. Now I see. Sounds like justice.

It's refreshing not to be outraged at the outcome of one of these incidents. I'm accustomed to these situations, where the correct verdict/course of action is rather apparent, and going the other way.

The guy thought he was in fear for his life though and thought he saw a weapon. I mean, he should be guilty of manslaughter but 1st degree is a bit much. What if there actually was a shotgun in the car? The kids not backing down with turning down their music didnt help things either.

Gawd damn, this is fucking great.

I'm thinking about another thread where a similar event was discussed, and where similarly ridiculous arguments were levied and continuously promoted under the guise of devil's advocacy. If that isn't enough of a clue, just re-read your tag.

This wasn't the Trayvon Martin case. I know small details like that can be difficult, but it's worth trying.

But just to be unequivocal, I don't argue on behalf of anyone or anything beyond my own sincerely held positions.

Good, but just to be clear, this is the case where the guy got charged for threatened the life of the survivors but actually dodge the charge of murdering the guy?

If so, still not a good look, this is the guy that went for pizza after doing that shit and a big reason of why he is in jail is because of the girlfriend?

Until we can build a time machine and right wrongs this is the best we can hope for.

I take some small comfort in knowing he won't be gunning anyone else down in cold blood cause he lost his temper after some Black kids DARED to not follow his demands.

Anyways, this happened in 2012? Man, time sure does fly by but I'm glad the right decision was made.
 
Imagine if he had been found guilty of a lesser charge? It would've set a very dangerous precedent: that you are entitled to open fire at any perceived threat. Glad the jury ruled correctly in this case.

How would a Murder 2 or Manslaughter conviction be a statement that you are entitled to open fire at a perceived threat?

I'm relieved the jury did the right thing. Far too often these seemingly obvious trials go the other way, and it's made me question what the hell is wrong with some jurors. Good to see Davis' family will get some justice after all this time.

How the hell do you remotely justify firing into a packed SUV because of loud music of all things?

and, prison is a fucked up system. No matter what. I'm finding it harder and harder to celebrate people going there. Its the same thing they say for us. Even when we haven't killed anyone as they know prison is just a torture/rape center.
