I used to think the provocation/heat of passion defense was a sound one. Having now read multiple cases dealing with "heat of passion" defenses and reading more into it, I think it is complete bullshit 99.99% of the time. Only in the rarest of occasions can we be so blinded by our emotions that it would cause us to lose all of our human faculties and revert into essentially an animal state. Based on the evidence in this case I think the judges charge is completely irresponsible. Canada has basically eliminated "heat of passion" as a defense, but I doubt the US will adopt that any time soon.
