No compo after 22yrs wrongly in jail
From correspondents in Port St John, Florida
September 13, 2004

A MAN who was freed in the United States after serving 22 years for a rape he did not commit walked out of jail with a few possessions in a plastic bag, and nothing else.

Wilton Dedge, 42, did no't get the $US100 ($144) that Florida gives even its most vicious ex-cons when he was released last month. He did not get the counselling or job referrals or temporary housing the state offers paroled murderers and rapists.

He did not even get a bus ticket home.

There was no compensation for the prison term Dedge received after a 17-year-old rape victim mistakenly identified him as her attacker. DNA testing proved his innocence.

"The system is not set up to deal with exonerees," said Nina Morrison, an attorney who fought for more than a decade to free Dedge on behalf of the New York-based Innocence Project.

"Ironically, instead of getting more, exonerees usually get less."

Debbie Buchanan, a spokeswoman for the Department of Corrections, said Dedge was not entitled to the benefits given to parolees because he was released from a county jail, where he was awaiting the outcome of the DNA test.

Because Florida has no wrongful-conviction compensation law, Dedge will have to sue the state or persuade a state legislator to sponsor a private-claims bill if he hopes to gain any state money.

Only 18 states and the federal government provide some compensation to those falsely imprisoned.

Still, Dedge has received cards, cash, a computer, free dental care and at least five job offers from friends and strangers, his mother said.peBut he said he spends his nights lying awake.

"My mind just jumps left and right, thinking about the people I was with in prison and things I need to do," Dedge told the Orlando Sentinel.

"I'm trying to get a normal life, but I really haven't had time to spend with myself."

Anyone else think this is more than a little rough. The state surely owe him something for fucking up his life!

I love telling this story. In the UK some guy was let out of jail having been wrongly convicted for....something or other, and he was charged for food and board.

What a wonderful world we live in.

EDIT: Oh yeah, he'd been in there a long time too, like this guy, wish I could remember what it was for.

Damn.... I think that there should be some legislation that says that folks are entiteled to some form of compensation no matter what state they are in.

well.. that might be a little TOO much money.

Shit, I don't think so. Especially after taxes. The man lost the best years of his life and he'll never get those back. He should, at the very least, be provided with the means to enjoy the remainder of his life. 11 or so million after taxes should about cover it.

22 years for rape? And that was because they released him after finding out he was innocent. He should have killed her, he'd have gotten off earlier with good behavior. :p As for the accuser, they should put her in jail for 22 years to make things 'fair'.

Damn that's as long as I've been alive. I can't imagine being in jail and assraped for my entire life till now. 1 million per year wouldn't even be enough IMO.

Still, I wonder if this is a case of getting someone to take the fall to ease the pain of the victim or a case of "allayall look alike"

In a twisted way, I'd find it amusingly ironic if the guy actually went out to rape the girl that got him in there.

This is BS. He needs to be set up for life or if not that 22 years. Assuming he had any college education anything he has learned is now obsolete. The best he can do is sack groceries or work warehouses. I'm sure you're going to have some asshat Republican/Conservative scream that he shouldn't get anything and mistakes happen. Shit like this scares the fuck out of me, especially being black.

i would go get a good lawyer and sue the fuck out of everyone involved...its no way a jury would not give you punitive damages.

There also might be a cap on liability damages depending on the state. I know in Texas they just passed a law saying the max punative damages you can get is 250,000.

I cant even imagine how much rage this man has inside, can you possibly even have hope for humanity when leaving that jail? I think i would go on a killing spree, giving them a REAL freaking reason to get me inside.

Small balls, big fun!
The situation of exonerees (what a weird word) should be easy to fix. Some clever and ambitious politician can seize on it as a small, symbolic issue, and who the heck would oppose them? "No, I don't think we need a support system for the wrongfully imprisoned."

MASB: Don't get too far ahead of yourself. I may be bending over backwards, but if DNA evidence says this guy didn't do it, that doesn't mean there wasn't a rape (especially depending on what evidence they were checking against his DNA). Still, I wouldn't begrudge him any animosity he has towards everyone involved.

Jeez. Your 20's and 30's, gone.

Ugh don't bring race into this. I think most Republican/Conservatives would be in favour of giving him something.

I think he should get a free pass to do whatever the hell he wants with the rest of his life, including murdering the bitch that sent him down.

I think what he was getting at is that blacks are more likely to be in jail than whites, and that blacks are more likely to be wrongly imprisoned than whites.

*insert random prison statistics here*

to steal an idea from double jeopardy.... he already served the time of the crime, so why not commit it? :p

Because the premise of Double Jeopardy was even dumber than this guy not getting compensated.

You cannot go and do a crime you were wrongly convicted of after you get out. You will be sent back. Wrongful convictions are not a get-out-of-the-legal-system-free card.

Yeah but I'm black and this shit happens 9 out of 10 times to a black dude. There have ben several cases like this in Texas where I live, yes I know this happened in Florida, where guys black and white have been sitting in jail, and some still are there even after DNA tests have proven they are innocent. It sucks if you are any race sitting in jail for 22 years for simething you didn't do, but again it's more likly in this society that a person who looks like me is going to get the rail road versus a wgite guy. that's why as a black man this shit scares me. Hell it scares me more now that you have pointed out he was a white guy.
