In the US sure, but this game isn't releasing in that market. Nintendo in particular hasn't been shy about threatening legal action over even broad similarities to their games before (Wiki, Emblem Saga, etc).... this seems pretty gutsy of Atari given they aren't planning a GC port this time around.

Nintendo might actually be glad. Atari or whoever developed must have respect for these franchises for them to have found their way into the game. Putting Nintendo on the mind of Ps2 owners is no bad thing. Gamers will appreciate the joke/homage.

It's an awesome idea... games tend to pay homage to movies and books all the time.... games paying homage to other games? It's a great thing to see even if it's going to take the piss / be tongue in cheek about it all.

I think their beef would be more about their "IP" showing up on a non-Nintendo machine. That'd be the key difference in motivation here, Nintendo doesn't tend to mind parody when it's on their own platforms.... though I'm not sure how Nintendo handled this before outside the Emblem Saga/Wiki scuffles. Did Capcom keep ROB in the PS2 port of Viewtiful Joe?

I can see NOA or NOE appreciating the homage to Mario Sunshine and whatever other Nintendo parodies show up and deeming it pretty harmless... the problem is, NOA and NOE don't ultimately call the shots. Lawsuit happy Japan does.
 
Aren't works of parody protected from litigation?

This law has never been tested in the field of videogames. I'd be rather shocked if a pissed-off party didn't try to stop this. I think the fear of litigation alone will keep any US publisher from touching it.

It may be perfectly legal, but I'd wager that noone wants to pay the court costs for a game that's not a guaranteed blockbuster.
 
Hate to say it, but Gex did the spoof thing first. Although he never made fun of other video game franchises. It was always limited to television and movies. Then of course we can't forget our fur-mapped little woodland friend, Conker, whose recently found a new lease on life on the Xbox (a game I need to buy ASAP).

The idea of game parodies makes me wish Gex would make a comeback next gen. :)
 
I really don't think Nintendo will allow part of their IP appearing on non Nintendo console and for Atari to NOT put this on GC is just asking for trouble. How retarted is it to put mario parody in the game and not put it on GC. I'd be none too pleased about that if I was on the Nintendo board of directors.

Not to mention their last Asterix game on GameCube too. From the same developer no less. :/
