yfarren writes "According to cdfreaks.com the RIAA has lost the case against the mother of a 13 year old girl accused of file-sharing violations." From the article: "The case was dismissed with prejudice, which prevents the case from being advanced against the defendant. Finally, the RIAA tried asking the Judge to amend the judgment in order to allow them to sue the child through a Guardian Ad Litem. However the court denied [the] RIAA's request."

they are such pieces of shit.

Welcome to the RIAA, we're in it for the music.

That's sick. Sue the child so which would in turn force the parents to pay anyway.

Great job RIAA, you have my vote.

So let me get this straight. The RIAA asked the Judge to change the law so they could directly sue the child after they couldn't sue the mother? The RIAA are assholes..

Well, not to change the statute, just that particular suit. Basically, the RIAA filed suit against the mother, the suit was dismissed, and then the RIAA tried to amend the suit so that they were also suing the child. (But the motion to amend the suit was also dismissed.)

I pray for the day RIAA and the Majors they so zealously fellate crash and burn in spectacular, beautiful fashion. Fucking leeches.

Yeah... well, I guess even Orson Scott "Mormon fundamentalist nutjob" Card can show the rare flash of sanity.
I'm a big Card fan. His Ender books were fantastic.

That said, I really enjoyed almost all of his article. The only part I didn't like was where he went off on porno ruining families.

Crazy mormon.

"This is a crap suit, case dismissed with prejudice."
"Can we change it so we can sue the kid?"
"You... you want me to change the suit so you can sue a 13 year old girl?"
"Yes."
"You make me sick (slams gavel)"

That's how I imagine it happened.

Every time I see the RIAA rear their heads, I think about Orson Scott Card's editorial on the subect.

wow. I've never read that before. That is possibly one of the most well-balanced articles I've read on the subject. Just wow. And the guy arguably has just as much a stake in copyright protection as any music company, given the popularity of his books and the eventual movie adaption of Ender's Game.

Fuck the RIAA. The only REAL CDs I buy anymore are used. If I have to buy music new I'll get it from iTunes where at least the prices are usually much lower (though I suppose they probably see more money from me on iTunes than the CD store).

Why the fuck aren't we seeing more independent publishing by larger bands? I figure all it takes is a U2, Pearl Jam, Offspring or whatever to independently publish and release a new CD/download with no label to get the ball rolling. Yeah I know Pearl Jam has those bootleg's coming out, but I meant more original music.

Pearl Jam tried it with the single for the song they did for Big Fish. No hard numbers were released, but I think they did ok. They still went on to sign with BMG so I guess it wasn't too lucrative. and they are doing something novel with their current tour: no DRM on the mp3s and the mp3s are at a decent bitrate (192) as well. Of course, they also aren't playing any[i/] new songs on this tour. :/

seriously. how hard would it be for a group like U2 to produce their own songs (I'm pretty sure they already do for the most part), ship off digital copies to Apple and Napster, and sell them that way. They could still ship discs to radio stations for airplay and then sell CDs on tour for a much reduced rate. The artists themselves would see a bulk load of the revenue and as enough artists started doing it they could probably, taking into account the screw job by the RIAA when it comes to royalties, see as much revenue from music sales as the currently do from CD sales.

just an uninformed thought on the subject.

Its too bad these RIAA fools dont realize how much music i bought after grabbing some mp3s from the original napster days up to today. Im sure im not alone in this. some of the cd's i wouldnt have picked up prior to hearing the 'evil' mp3s:

Wilco: YHF and A Ghost is born
Flaming Lips Yoshimi and Soft Bulletin
Death Cab for Cutie :Trans..
Jet: Hot Fuss

P2P has become the new radio for me, as i listen and buy quite a bit from listening to mp3s as the radio stations around here suck. Unfortunately in the US you cant really share much anymore without fear of getting busted.

I was the same way. In fact I didn't buy CDs at all until I was able to download shitloads of music off of Napster.
