What he's arguing is that DOJ should have given a presumption of constitutionality to the EO and allowed the courts to make the official determination.

It's a shit argument only based on him liking the EO and not about an actual principle of presuming constitutionality, but that's the argument.
 
It becomes even clearer why Trump Admin got rid of yates. Suggested charging Flynn with criminal charges etc. Her days were numbered

They might have wanted to ride out with Flynn, but with increased reporting on him and prior reporting (today) that he did not receive clearance yet before he left his post. Of course, that would require asking questions to current White House officials.
