I don't ever believe in this "Character X replaces character Y" if Snake's out, it's because he doesn't fit the Smash Bros style or Konami doesn't approve his usage

On Topic: Snake not returning would most likely be due to nothing MGS being released on Nintendo platforms soon (ever?).
It's not any different from Brawl, though. MGS4 was being heavily promoted at the time, and Snake still appeared in Smash and came with content from that game. Snake Eater 3D was released closer to SSB4's release date(s) than Twin Snakes was as well. He's (marginally) more relevant to Nintendo now than he was back in Brawl.
It's always possible that's the reason, but it's weird that they're pushing that now and not then.

Probably wasn't nearly as big a resource hog as SSE was during Brawl's development so there's that at least.
EDIT: I'm still 50/50 on Snake returning, though I don't feel like making a bet on it. I could see him being removed since he doesn't fit SSB4's cleaner more 'game-y' aesthetic or Konmai simply didn't push for him, but I can also easily see Kojima bullshitting like he normally does and they felt like showing him late just for the hell of it. I also feel Snake being revealed in the next Direct wouldn't be that anti-climatic given how Sonic was similarly shown off (albeit around the time of Lost World's release, though I'm expecting a Snake Eater-themed stage for Snake if he returns). Not having any recent MGS games on Nintendo systems means shit considering there was an even bigger gap when he was in Brawl.
If Snake is returning we'll get a "kept you waiting huh" trailer
I still wonder if the change of Sutherland becoming Snake is the reason he's out as Sutherland would be too expensive to license for the voice and perhaps Konami won't let Snake be in the game with a voice besides his new official one

In particular for this game I am excited for getting the Screw Attack item and just being a whirling ball of death and cheap aerials now that Smash DI is apparently gone.

I wonder if Smash will be one of the last fighting games to essentially ship 'complete'. What I mean by that is a full roster, extensive stages, etc. Sure, there will probably be DLC and the like, but by and large, when we get Smash 4 for the 3DS, and Wii U, they will be complete games.
But the rest of the industry is moving to selling fighting games piecemeal, and as free to play option. The FGC heavily took to Killer Instinct's F2P offering, both Tekken and Soul Calibur has F2P versions on PS3, Rise of the Incarnates is F2P, and Mortal Kombat 10 will likely have intensive DLC offerings.
I'm not even sad at the notion that Smash might be the last of its era.
Perhaps Smash 5, or whatever the next Smash is titled will join the ranks of F2P offerings, but for now, I'm glad that I can pay $60 for a complete game. (Or in my case, $40 after the discount Target is offering on this week's Buy two get one Free game).
Trends in the rest of the industry rarely have an effect in Nintendo's software, and Sakurai doesn't strike me as the person who'd embrace F2P as a gaming design philosophy. Here's hoping it stays that way!

- they are available
- experienced and has some top developers in Bamco
- has a good relationship with Nintendo
This team is going to be disbanded as soon as Smash 4 is done completely and the developers will go back to their own projects. We don't know when it will be done completely, I doubt it will be as soon as Smash 4 releases.
They would give a 3rd party, given their track record with those, the development of SSB?
